HomeMy WebLinkAbout10B - Dakota St. Comp Plan Amen MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT JULY 7, 2003 lOB JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION DENYING AN AMENDMENT TO THE COMPREHENSIVE PLAN FOR THE PROPERTY AT 4666 DAKOTA STREET (Case File #03-054) History: Wensmann Realty has filed an application for a Comprehensive Plan Amendment for approximately 7,500 square feet ofland located on the north side of Dakota Street, and east of Erie Avenue and the Lakefront Plaza building. The proposal is to amend the 2020 Comprehensive Plan Land Use Map from the current R- L/MD (Low to Medium Density Residential) designation to the C- TC (Town Center) designation. This property is presently zoned R-2 (Low-Medium Density Residential) and is designated as R-L/MD (Low to Medium Density Residential) on the 2020 Comprehensive Plan Land Use Map. There is an existing single family dwelling located on the property. At this time, the applicant is proposing to develop this site into a parking lot for the Lakefront Plaza building. In order to do so, the Comprehensive Plan must be amended and the site rezoned to the C-3 (Town Center) district. Parking lots are permitted as an accessory use in the C-3 district. The Planning Commission reviewed this request at a public hearing on June 23,2003. Three neighboring residents testified about the proposed amendment. They were basically concerned about the impact of the proposed parking lot on their property. The Commission voted to recommend denial of this Comprehensive Plan amendment on the basis that it is inappropriate to review the plan on a piecemeal basis. The change should be reviewed as part of the overall downtown plan. This review is scheduled to occur in the next several months. Current Circumstances: The total site consists of approximately 7,500 square feet. Sewer and water services are available to this site from the existing services in Dakota Street. To the north of this property is Lakefront Park, currently zoned R-1 and designated for Low to Medium Density Residential uses. To the south, across Dakota Street, is an office building, zoned C-3 and designated for C- TC uses. To the east is the Lakefront Plaza building, also zoned C-3 and designated for C-TC uses. To the west is a single family dwelling, zoned R-2 and designated for Low to Medium Density Residential uses. The Issues: The applicant is proposing to develop this property as an accessory parking lot for the Lakefront Plaza building. The request to amend the Comprehensive Plan would be the first step in developing this parking lot. The Comprehensive Plan goals and objectives that are applicable to this request are as follows: GOAL: ECONOMIC VITALITY: Pursue a prudent use of available resources and the optimum functioning of economic systems. OBJECTIVE No.1: Determine and strive for a balance of commerce, industry, and population. OBJECTIVE No.2: Encourage a diversified economic base and a broad range of employment opportunities. OBJECTIVE No.3: Promote sound land use. OBJECTIVE No.4: Maintain high standards in the promotion and development of commerce and industry. The proposed C- TC designation is consistent with the above stated goals and objectives in that it will allow additional parking for the multi-use Lakefront Plaza building. The C-3 Zoning District includes stringent design standards which will lessen the impact of a commercial use on the adjacent residential property. The City of Prior Lake 2020 Vision and Strategic Plan also includes a Downtown Redevelopment element. Some of the tasks within this element include: . Complete construction of Lakefront Plaza. . Develop a downtown parking plan. . Complete redevelopment plan tying Downtown to the Lake. . Expand Downtown for commerciaVcondominium development. 1:\03 files\03 comp amend\lakefront\cc report. doc Page 2 FISCAL IMPACT: ALTERNATIVES: RECOMMENDED MOTION: REVIEWED BY: The proposed C- TC designation is also consistent with the goals of the 2020 Vision and Strategic Plan. Conclusion: The Planning staff recommends approval of the proposed amendment with the finding that the Comprehensive Plan designation is consistent with the goals and objectives of the Comprehensive Plan and with the 2020 Vision and Strategic Plan. The Planning Commission, on the other hand, believes this area should be reviewed as part of an overall review of the Comprehensive Plan designation for the Downtown area and therefore recommends denial ofthis request. Budl!et Impact: There is no direct budget impact involved in this request. The City Council has three alternatives: 1. Adopt a resolution denying the proposed amendment to the Comprehensive Plan as recommended by the Planning Commission. 2. Continue the review for specific information or reasons per City Council discussion. 3. Approve an amendment to the Comprehensive Plan as proposed. In this case staff should be directed to prepare a resolution with findings of fact. The Planning Commission recommends Alternative #1. IN this case, the following motion is required: . A motion and second to adopt a resolution denying the Comprehensive Plan Amendment to designate the property as Town Center (C- TC) is required. The staff recommends Alternative #3. In this case, the following motion is required: . A motion and second to direct staff to prepare a resolution approving the Comprehensive Plan Amendment to designate the property at 4666 Dakota Street as Town Center (C-TC) for review and approval of the City Council as part ofthe Consent Agenda at the July 21, 2003 City Council meeting. Approval of this amendment r quires a 4/5 vote of the City Council. ( 1:\03 files\03 comp amend\lakefront\cc report. doc Page 3 T RESOLUTION 03-XX RESOLUTION DENYING A PROPOSED AMENDMENT TO THE 2020 COMPREHENSIVE PLAN LAND USE MAP FOR THE PROPERTY LOCATED AT 4666 DAKOTA STREET MOTION BY: SECOND BY: RECITALS WHEREAS, The City of Prior Lake received an application for an amendment to the City of Prior Lake 2020 Comprehensive Plan Land Use Map from the R-UMD (Low to Medium Density Residential) designation to the C-TC (Town Center) designation for the property legally described as follows: I I il I The East 37.5 feet of Lots 3, 4,5 and 6, Block 8, Prior Lake Original Plat. and WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS, The Planning Commission conducted a public hearing on June 23, 2003, for those interested in this request to present their views; and WHEREAS, On July 7,2003, the Prior Lake City Council considered the proposed amendment to the 2020 Comprehensive Plan Land Use Map to change the designation of the above described property to the C-TC (Town Center) designation and; I I WHEREAS, The City Council received the staff reports, Planning Commission minutes and other : I information; and 1 ! WHEREAS, the City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitals are herein fully incorporated herein as set forth above. 2. The City Council hereby adopts the following findings of fact: (a) The burden is on the applicant to demonstrate that the Comprehensive Plan designation is in error and that a change is justified.
