Requirements
Dear Mr. Bates:
Attached is the application you requested. I have also enclosed a copy of Section 6-10
of the City of Prior Lake Subdivision Ordinance for your information. Please submit this
application, along with a certificate of survey identifying both the existing and proposed
parcels. We must receive this application at least 15 days prior to the City Council
meeting. As you know, the Council meets on the first and third Monday of each month.

The transfer of property you are requesting is regulated by Section 6-10 of the City of
Prior Lake Subdivision Ordinance (see attached). The conveyance of property by metes
and bounds is permitted only in specific circumstances. The Vierling conveyance does
not meet any of these requirements. In order to convey this property, the property must
be platted, or the City Council must waive the requirements by resolution.
If you wish to ask the Council for a waiver, please submit your request in writing, along
with a certificate of survey identifying both the existing and proposed parcels. If you
would like to proceed with platting the property, please contact me and I will provide you
with the necessary forms.

CONVEYANCE BY METES AND BOUNDS

Council Resolution Waiving Requirements
Building Permits in Violation of this Chapter
6-10-1: PARCELS OF RECORD: No conveyance of land within the City shall
{ be filed or recorded, if the land is described in the conveyance by metes
and bounds,~by reference to an unapproved registered land survey made after April
1961, or by reference to an unapproved plat made after March 18, 1974. The foregoing
provision does not apply if the land described in the conveyance:
(A) Was a parcel of record prior to March 18, 1974. ~~
(8) Is a parcel of land not less than five (5) acres and having a width of not less
than three hundred feet (300').13~
(C) Is a parcel of land not less than one acre and is located in the rural service
area as defined by the City Comprehensive Plan.
6-10-2: COUNCIL RESOLUTION WAMNG REQUIREMENTS: In any case
in which compliance with the foregoing restrictions will create a
unnecessary hardship and failure to comply will not interfere with the purpose of this
Chapter, the Council may waive such compliance by the adoption of a resolution to
that effect and the conveyance may then be filed.
6-10-3: BUlLDING PERMITS IN VIOLATION OF THIS CHAPTER: No
building permits shall be issued for construction or alteration of any
building or structure on any parcel of land which is conveyed in violation of the provisions
in Chapter 10 of this Title. (Ord. 87-10. 8-17-87)
