Dear Mr. Gustafson:
On October 1, 1998, we received a letter from you stating you intended to move forward
with your applications for a mini-storage facility. The original application was submitted
in August, 1998. We met with you on August 25, 1998, to discuss the items required to
complete your application.
It has been more than two months since your last letter, and more than four months
since you submitted an application. However, as of this date, we have not received any
additional information. We are therefore returning the remaining materials in your file,
and closing this file. A refund of the $350.00 application fee is being processed and will
be sent to Mr. Soderman as soon as possible.
You may, of course, resubmit this application in the future. Please keep in mind we will
not process the application until all of the necessary information has been submitted.

Dear Mr. Gustafson:
Based on the comments in your letter dated October 1, 1998, there seems to be some
misunderstanding of the application process for your proposed project. Based on the
information you submitted, the location of these buildings will require a variance. You
may submit a variance application prior to the conditional use permit application.
Attached is an application for a variance. Along with this application, you must submit
the following items:
1) A filing fee of $150.00
2) A certificate of survey showing the property lines and the proposed building,
including all setbacks, easements, and so on.
3) The certificate of survey should also identify the following features for the property in
question and the properties within 300 feet:
. Property lines
. Topography and proposed drainage
. Existing and proposed buildings
. Easements
. Utilities
4) Building elevations for the proposed buildings
5) A list and mailing labels with the names and addresses of owners of property within
100 feet of the exterior boundaries of the subject property. This list must be
prepared and certified by the County Auditor or by a certified abstract company. It
must also be accompanied by a map identifying the subject site and the properties to
be notified.
Please keep in mind we will not process the application until all of the above information
has been submitted. The information you submitted with your original application was
not complete.
The staff reviews variances based on the criteria outlined in the attached handout. In
essence, you must show a hardship which is not a result of economic factors or mere

convenience. The Planning Commission makes the final decision on whether or not a
variance should be granted. You, or any other property owner, may appeal the decision
of the Planning Commission to the City Council.
If you choose to file the variance separately, we will complete that process before
accepting an application for a conditional use permit. You may also run the applications
concurrently. As you know, the development of this property also requires a preliminary
and final plat since a portion of the site is an outlot. The City Subdivision Ordinance
does not allow buildings on an outlot. Once again, we will not process any applications
until all of the necessary information is submitted. .

As of this date, we have received no additional information. Since it has been more
than a month since our last conversation, we are looking for some indication of your
intentions with regards to this matter.

Dear Mr. Gustafson,
On August 18, 1998 the City sent you a letter detailing additional information required
for review of your CUP application. Since then, it has been brought to our attention, that
part of the property you propose to construct the mini-storage building on is located on
an outlot. According to our records, the entire outlot is a separate parcel from Lot 1,
Block 2 Envid First Addition. Under current City Code, outlots are unbuildable pieces of
land. Therefore, if you wish to combine part of the outlot with Lot 1, Block 2, you must
subdivide the property to modify the lot line to be as indicated on your plan. I have
enclosed a subdivision application and checklist. The subdivision process is
approximately 120 days.
In light of this information, we cannot proceed with your application until the property is
subdivided or until the mini-storage buildings are located entirely on Lot 1, Block 2 Envid
First Addition and meet all required setbacks (unless a variance is requested).

required. A map highlighting the properties listed is also required. The list
submitted is for a 350 foot radius.
. A grading and drainage plan with existing and proposed contours is necessary
as well as a utility plan.
. A survey indicating the boundaries of the property.
. The site plan must indicate proposed setback of structures to all property lines.
The plan indicates distances to east and west lot lines, not the north or south
property lines.
. A lighting plan must be submitted indicating the location of all light sources and
foot candles at the property lines.
In addition, the following information will be required upon submittal of a building permit,
once the CUP has been processed.
. The City has an architectural materials ordinance which must be complied with.
Building specifications with construction detail and proposed materials is
required.
. Hydrant locations and proposed hook-ups.

. The landscape plan must be signed by a registered landscape architect. Built-in
irrigation plan is required.
In addition, your plan indicates a building setback closer than the required 60 foot
setback from the property line adjacent to property zoned residential (south lot line). A
variance will be required. Once the proposed setback has been indicated on your
survey, we will know exactly to what dimension a variance is required. Enclosed isa
variance application. The fee is $200.00 for a commercial property, We can run it
concurrently with your CUP application and can also use the same mailing list.
Once we receive the necessary documents, it will take approximately 3-4 weeks to
schedule the public hearing. The public hearing is conducted by the Planning
Commission which meets on the second and fourth Monday of each month. Their
recommendation is then forwarded to the City Council which meets on the first and third
Mondays of each month.
