The Letter of Credit should have been extended until 8/2/00 prior to the issuance of a final Certificate of Occupancy. This is one year after the landscaping was installed and inspected. After to speaking with John Breichtbach, Prior Lake State Bank, he stated the LaC will be extended prior to it expiring in May 2000. On April 13, 1999, I spoke with John Breitbach at Prior Lake State Bank regarding an extension of this date due to the renewal of your line of credit coming up later in the month. Therefore, I am granting an extension until April 30, 1999 for you to provide the City with the extended LOC. In addition, he had inquired about releasing the LOC after the landscaping was installed. I did discuss this with the City Attorney, as the new zoning ordinance, effective May 1, 1999, does not necessarily require a LOC to be held for one year. It is the City's desire to be consistent with ordinances in effect upon issuance of the building permit. Therefore, considering the building permit for the structure was issued with the requirement for a one year hold on the LOC after plant installation, we must adhere to it. As you are aware your LOC expires on May 22, 1999. Failure to provide the City with an extended LOC by April 30, 1999 will result in the City proceeding to draw upon the LOC to ensure the landscaping is completed. You may plant spruce trees to provide more effective screening. . We would like to see the berm completed and fence in place prior to construction of the building. You can get a separate grading permit for this work ($50.00) while your site plan and building permit application is being reviewed. . It is the responsibility of the owner of the Subject Property to maintain the berm, fence and landscape materials in order to prevent excessive arid unnatural erosion cause~ by drainage and run off. The owner of the Subject Property accepts all risks associated with the berm. Any erosion of the berm or degradation of the fence or landscape materials will be repaired and properly maintained by the owner of the Subject Property . 3.
