RESOLUTION PROVIDING FOR THE VACATION OF A PORTION OF DRAINAGE
AND UTILITY EASEMENTS LOCATED ON LOTS 1 AND 2, BLOCK 2,
WATERFRONT PASSAGE ADDITION

WHEREAS, a petition for the vacation of drainage and utility easements has been duly
presented to the City of Prior Lake, signed by the owners of the property
abutting the following described easement situated in the City of Prior Lake,
Scott County, Minnesota to wit:
LEGAL DESCRIPTION:
A 40.00 foot easement for drainage and utility purposes lying over, under and
across part of Lots 1 and 2, Block 2, as delineated and dedicated on Waterfront
Passage Addition, according to the recorded plat thereof, Scott County,
Minnesota. The center line of said easement is described as follows:
Commencing at the Southeast comer of said Lot 2; thence on an assumed
bearing of North 00 degrees 10 minutes 44 seconds East, along the East line of
said Lot 2, a distance of 20.00 feet to the point of beginning of said center line;
thence continuing North 00 degrees 10 minutes 44 seconds East, along said
East line, a distance of 188.00 feet and there terminating; and
WHEREAS, notice of the hearing on said petition has been duly published and posted in
accordance with the applicable Minnesota Statutes, and
WHEREAS, a Public Hearing was held on said petition on Monday, October 19, 1998, at
7:30 p.m. in the Council Chambers at the Prior Lake Fire Station #1; and
WHEREAS, the City Council then proceeded to hear all persons interested in said petition
and persons interested afforded the opportunity to present their views and
objections to the granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the vacation of said
drainage and utility easement would be in the public interest.
NOW THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF PRIOR
LAKE, that pursuant to Minnesota Statues 412.851, the above described drainage and
utility easement situated in the City of Prior Lake, Scott County, Minnesota is hereby
vacated.

RESOLUTION 98-XX APPROVING THE VACATION OF A
DRAINAGE AND UTILITY EASEMENT LOCATED IN LOTS 1
AND 2, BLOCK 1, WATERFRONT PASSAGE ADDITION
History: This petition is part of a land transaction between the EDA
and Gary Horkey, d.b.a Keyland Homes. Mr. Horkey is in the process
of purchasing an additional half acre of land from the city to be
combined with his existing parcel, thereby creating a 2.14 acre parcel.
The administrative subdivision was approved in August. This vacation
will remove an existing utility and drainage easement located between
the existing lot and the lot to be combined. The combined lot with the
vacation will accommodate a future addition to the Keyland Homes
building. Drainage and utility easements will be granted on the newly
created lot lines as part of the land transaction.
The Planning Commission reviewed this vacation request on
September 28, 1998. The Planning Commission adopted Resolution
98-028PC recommending approval of the proposed vacation. The
granting of the additional easements, on the property being purchased,
was a condition ofthe administrative subdivision.
Current Circumstances: There are no utilities located in the easement
to be vacated. Since additional easements will be granted, which will
encompass the entire parcel after the land transaction is completed,
there is no need for the City to have a claim to this easement. The
vacation of the easement will make the proposed future addition to
Keyland Homes' property easier to accomplish when the time comes.
The Issues: State Statute 412.851 allows the Council to vacate
easements or right-of-way by resolution. The statute states that "no
such vacation shall be made unless it appears to be in the public
interest to do so".
The existing drainage and utility easement is used for primarily for
drainage. Considering the proposed land transaction and the granting

of drainage and utility easements on the property to be combined with
this parcel, there is no public interest in maintaining the easement.
Conclusion: The proposed vacation is consistent with the
Comprehensive Plan and is in the public interest. On this basis, the
staff recommends approval of the vacation of the drainage and utility
easement.
Budfet Impact: There is no budget impact with the approval of this
request. Vacating the easement will facilitate the construction of an
addition to the existing building which will add to the City's tax base.
The City Council has three alternatives:
1. Adopt Resolution 98-XX approving the vacation as requested.
2. Deny Resolution 98-XX.
3. Defer this item and provide staffwith specific direction.
Conduct the public hearing. If no new information is offered, make a
motion and second to approve Resolution 98-XX approving the
vacation of a portion of the drainage and utility easement located in
Lots 1 and 2, Block 2, Waterfront Passage Addition.

WHEREAS, the Planning Commission of Prior Lake has considered the
vacation of drainage and utility easements on the property located
in Lots 1 and 2 Block 2, Waterfront Passage Addition; and
WHEREAS, the Planning Commission has determined that the proposed
vacation is compliant with the Comprehensive Plan; and
WHEREAS, the Planning Commission has determined that there is not a public
need for the drainage and utility easements.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PRIOR
LAKE, recommends to the City Council that the previously dedicated
drainage and utility easements legally described and shown on attached
Exhibit A, be vacated.

INTRODUCTION
This petition is part of a land transaction between the EDA and Gary Horkey,
d.b.a Keyland Homes. Mr. Horkey is in the process of purchasing an additional
half acre of land from the city to be combined with his existing parcel, thereby
creating a 2.14 acre parcel. The administrative subdivision was approved in
August. This vacation will remove an existing utility and drainage easement
located between the existing lot and the lot to be combined. The combined lot
with the vacation will accommodate a future addition to the Keyland Homes
building. Drainage and utility easements will be granted on the newly created lot
lines as part of the land transaction.
As required by State Statute 462.356 Subd.2, the Planning Commission is
required to make a recommendation to the City Council regarding the disposal or
acquisition of public lands as it relates to the compliance with the
Comprehensive Plan.
Upon proper notification, State Statute 412.851 allows the Council to vacate
easement or right-of-way by resolution. The statute also states that "no such
vacation shall be made unless it appears to be in the public interest to do so".
DISCUSSION
The Planning Commission must make two determinations. Does the vacation of
the existing drainage and utility easements comply with the Comprehensive Plan
and is there a public need or anticipated future need for the dedicated property?

Comprehensive Plan Review
The proposed vacation of the drainage and utility easement is consistent with the
Comprehensive Plan.
Public Need
There is no need for the city to keep the existing drainage and utility easements,
as new easements encompassing the entire parcel will be achieved, upon
completion of the land transaction.
RECOMMENDATION
Considering that the proposed vacation is consistent with the Comprehensive
Plan and will not eliminate a public need, staff recommends approval of the
vacation of the drainage and utility easements:
ALTERNATIVES:
1. Adopt Resolution 98-28PC, recommending the City Council approve the
proposed vacation of the drainage and utility easements as presented or
with changes recommended by the Commission.
2. Continue the discussion to a date and time certain to allow the developer
and/or staff to provide additional information specifically requested by the
Planning Commission.
3. Based upon expressed findings of fact, recommend the City Council deny
part or all of the applications based upon inconsistency of the proposal
with specific regulations of the Zoning and Subdivision Ordinances and/or
specific policies of the Comprehensive Plan. In this case, staff should be
directed to prepare a resolution with findings.
RECOMMENDATION:
Alternative #1.
ACTION REQUIRED:
Motion to adopt the proposed Resolution as written or with changes directed by
the Planning Commission.

vacation of drainage and utility easements on the property located
in Lots 1 and 2 Block 2, Waterfront Passage Addition; and
WHEREAS, the Planning Commission has determined that the proposed
vacation is compliant with the Comprehensive Plan; and
WHEREAS, the Planning Commission has determined that there is not a public
need for the drainage and utility easements.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PRIOR
LAKE, recommends to the City Council that the previously dedicated
drainage and utility easements legally described and shown on attached
Exhibit A, be vacated.

Nelson: Wants fairness in the assessment.
Wuellner: What is the process for determining whether it is fair?
Teschner: The Court will look at what the City is providing. The cost to bring the system up
to standard so the property can be marketed in the future is a major consideration. The City's
position is the cost incurred for the benefit received. A first time improvement such as this is
normally assessed at 100%. The judge decides, frequently in the City's favor. The City feels
the benefit is there, with the cost to update the septic system and the fact that the City has
already written down the cost to a 40% assessment.
Mader: Does the resolution keep the hearing open?
Boyles: Staff recommends continuing this to November 2nd without acting upon the
resolution.
Nelson: Said they were not notified in writing 14 days before the hearing. It was in the
newspaper. Received a new letter saying that the hearing was continued. Difficult for them
to be there.

easement is described as follows: .

462.356 PROCEDURE FOR PLAN EFFECTUATION; GENERALLY.
Subdivision I. Recommendations for plan execution. Upon the recommendation by
me planning agency of the comprehensive municipal plan or sections thereof, the planning
agency shall study and propose to the governing body reasonable and practicable means for
putting the plan or section of the plan into effect. Subject to the limitations of the following
sections, such means include, but are not limited to, zoning regulations, regulations for the
subdivision of land, an official map. a program for coordination of the normal public im-
provements and services of the II).unicipality, urban renewal and a capital improvements pro-
gram.
Subd. 2. Compliance with plan. After a comprehensive municipal plan or section
thereof has been recommended by the planning agency and a copy filed with the governing
body, no publicly owned interest in real property within the municipality shall be acquired or
disposed of, nor shall any capital improvement be authorized by the municipality or special
district or agency thereof or any other political subdivision having jurisdiction within the
municipality until after the planning agency has reviewed the proposed acquisition. disposal.
or capital improvement and reported in writing to the governing body or other special district
or agency or political subdivision concerned. its findings as to compliance of the proposed
acquisition. disposal or improvement with the comprehensive municipal plan. Failure of the
planning agency to report on the proposal within 45 days after such a reference. or such other
period as may be designated by the governing body shall be deemed CO have satisfied the re-
quirements of this subdivision. The governing body may, by resolution adopted by two-
thirds vote dispense with the requirements of this subdivision when in its judgment it finds

, The council may by resolution vacate any street, alley, public grounds, public way,
or any part thereof, on its own motion or on petition of a majority of the owners ofland
abutting on the street, alley, public grounds. public way, or part thereof to be vacated.
When there has been no petition, the resolution may be adopted on.\y by a vote of four-
fifths of all members of the council. No such vacation shall be made unless it appears
in the interest of the public to do so after a hearing preceded by two weeks' published
and posted notice. The council shall cause written notice of the hearing to be mailed
to each property owner affected by the proposed vacation at least ten days before the
hearing. The notice must contain, at minimum, a copy of the petition or proposed reso-
lution as well as the time, place, and date of the hearing. In addition, if the street, alley,
public grounds, public way, or any part thereof terminates at or abuts upon any pub-
lic water, no vacation shall be made unless wrinen notice of the petition or proposed
resolution is served by certified mail upon the commissioner of natural resources at
least 30 days before the hearing on the matter. The notice to the commissioner of natu-
ral resources is for notification purposes only and does not create a right of intervention

Subdivision 1. Complaint. All prosecutions for violation of ordinances shall be
brought in the name of the city upon complaint and warrant as in other criminal cases.
If the accused be arrested without a warrant. a written complaint shall thereafter be
made, to which the accused shall be required to plead. and a warrant shall issue thereon.
The warrant and all other process in such cases shall be directed for service to any police
officer, marshal, process officer, court officer, or constable of any town or city in the
county, to the sheriff of the county, or all of them.
Subd. 2. Fonn and C1)otents of complaint. It shall be a sufficient pleading of the ordi-
nances or resolutions of the city to refer to them by section and number or chapter.
They shall have the effect of general laws within the city and need not be given in evi-
dence upon the trial of civil or criminal actions. Judgment shall be given. if for the
plaintiff. for the amount of fine, penalty, or forfeiture imposed, with costs; and the judg-
ment shall direct that, in default of payment. the defendant be committed to the'county
jail for such time, not exceeding 90 days, as the court shall see fit. The commitment shall
state the amount of judgment, the costs, and the period of commitment. Every person
so committed shall be received by the keeper of the jail and kept, at the expense of the
county, until lawfully discharged. The committing court may release the defendant at
any time upon payment of the fine and costs.
Subd. 3. Appeal to court of appeals. Appeals may be taken to the court of appeals
in the manner prescribed by court rule. On appealing, the defendant shall give bond
to the city, to be approved by the court, conditioned that, if the judgment be affirmed
in whole or in part, the defendant will pay the judgment, and all costs and damages
awarded against the defendant on the appeal. In case of affirmance, execution may issue
against both defendant and the defendant's sureties. Upon perfection of the appeal,
defendant shall be discharged from custody.

parcel conveyed in violation of the provisions of this section.
Subd. 6. Variances. Subdivision regulations may provide for a procedure for vary-
ing the regulations as they apply to specific properties where an unusual hardship on
the land exists, but variances may be granted only upon the specific grounds set forth
v in the regulations. Unusual hardship includes, but is not limited to, inadequate access
to direct sunlight for solar energy systems.
Subd. 7 . Vacation. The governing body of a municipality may vacate any publicly
owned utility easement or boulevard reserve or any portion thereof, which are not being
used for sewer, drainage, electric, telegraph, telephone, gas and steam purposes or for
,boulevard reserve purposes, in the same manner as vacation proceedings are conducted
for streets, alleys and other public ways under a home rule charter or other provisions
of law.
A boulevard reserve means an easement established adjacent to a dedicated street
for the purpose of establishing open space adjacent to the street and which area is des-
ignated on the recorded plat as "boulevard reserve".
'-', Subd. 8. Plat approval under other laws. Nothing in this section is to be construed
as a limitation on the authority of municipalities which have not adopted subdivision
regulations to approve plats under any other provision of law.
"'" Subd. 9. Unplatted parcels. Subdivision regulations adopted by municipalities
may apply to parcels which are taken from existing parcels of record by metes and
: bounds descriptions, and the governing body or building authority may deny the issu-
." 'ance of building permits to any parcels so divided, pending compliance with subdivi-
sion regulations.
.. Subd. 10. Limitations. Nothing in this section shall be construed to require a
