REQUEST TO VACATE A WATER MAIN EASEMENT LOCATED ON LOT 94,

WHEREAS, a petition for the vacation of a water main easement has been duly presented to the City
of Prior Lake, signed by the owners of the property containing the described easement in
Exhibit A and situated in the City of Prior Lake, Scott County; and
WHEREAS, notice of the hearing on said petition has been duly published and posted in accordance
with the applicable Minnesota Statutes, and
WHEREAS, a Public Hearing was held on said petition on Tuesday, January 19, 1999, at 7:30 p.m. in
the Council Chambers at the Prior Lake Fire Station #1; and
WHEREAS, the City Council then proceeded to hear all persons interested in said petition and persons
interested were afforded the opportunity to present their views and objections to the
granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the vacation of said water main
easement would be in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that pursuant to
Minnesota Statutes 412.851, the previously dedicated water main easement legally described and shown on
attached Exhibit A and situated in the City of Prior Lake, Scott County, Minnesota is to be vacated with
the following conditions:
1. A 15 foot utility easement, centered over the existing water main be granted to the city from the property
owner (Lee Nelson) provided that Mr. Nelson grants to the City an easement. Attached is Exhibit B
indicating the legal description of such property.
2. The documentation relating to this vacation and granting of the proper easement be recorded within 60
days of approval or the vacation will be null and void.
Passed and adopted this 19th day ofJanuary, 1999.

A strip of land 15.00 feet in width the centerline of which is described as follows:
Commencing at the most westerly comer of said Lot 94; thence South 31 degrees 30
minutes 51 seconds East assumed bearing along the southwesterly line of said Lot 94, a
distance of 219.06 feet to the point of beginning of the centerline to be described; thence
North 61 degrees 43 minutes 42 seconds East to the northeasterly line of said Lot 94, and

RESOLUTION RECOMMENDING THE VACATION OF A WATER MAIN
EASEMENT LOCATED ON LOT 94, NORTHWOOD

WHEREAS, the Planning Commission of Prior Lake has considered the
vacation of a water main easement on the property located in Lot
94, Northwood;and
WHEREAS, the Planning Commission has determined that the proposed
vacation is compliant with the Comprehensive Plan; and
WHEREAS, the Planning Commission has determined that there is not a public
need for the water main easement.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PRIOR
LAKE, recommends to the City Council that the previously dedicated water main
easement legally described and shown on attached Exhibit A, be vacated with
the following conditions:
1. A 15 foot utility easement, centered over the existing water main be granted
to the city. Attached is Exhibit B indicating the legal description of such
property.
2. The documentation relating to his vacation and granting of the proper
easement be recorded within 60 days of approval or the vacation will be null
and void.

Council Meeting Minutes
January 19. 1999
PRESENTATIONS:
Scott County Issues presented by Scott County Board Chair Barbara Marschall and Scott
County Administrator David Unmacht.
Scott County Board Chair Barbara MARSCHALL introduced Mr. Unmacht and advised the Couocil
of the intentions with respect to this presentation.
County Administrator David UNMACHT introduced the presentation and thanked the Council for the
opportunity to talk about the issues to be addressed by the County in the coming year.
(1) Intergovernmental Relations - Stated the need for input on the specific steps the County needs
to take to improve and advance sometimes competing interests between Staffs and elected
officials. Briefly highlighted the County accomplishments in 1998. With regard to the County
Budget, referred to Barbara Marschall's article in the Prior Lake American addressing the issues of
supplying more services at a low budget to a high-growth community.
(2) Business issues affecting the County: (a) Courthouse remodel; (b) Prior Lake Library; (c)
SMSC Tribal Relations (cooperation even in disagreement); (d) County Road Projects; (e) Growth
and Development issues; (f) Electronic communications.
(3) Suggests a County Government Primer to local elected officials. We could learn from each
other by understanding each of our roles in government.
(4) Mission Statement: We all share different perspectives, but our end goals are the same:
providing public services in an effective, efficient and proficient manner.
Each of the Council members thanked Mr. Unmacht for the presentation, and liked the idea of a
Government Primer. Councilmember SCHENCK encouraged pursuing Joint Powers Agreements
between communities in order to provide more public services.

PUBLIC HEARINGS:
Consider Approval of Resolution 99-XX Approving the Vacation of a Dedicated Water Main
Easement located on Lot 94, Northwood.
BOYLES introduced the item in connection with the Staff Report and advised that the water main
easement is a problem because the actual water main is off center in the current easement area.
Work to the area would mean trespassing onto private property. He also advised that the property
owner has been contacted and it is the staff's understanding that the property owner is amenable
to granting a new easement over the appropriate property at no cost to the City.
MADER asked for any public input.
MOTION BY WUELLNER, SECOND BY KEDROWSKI TO CLOSE THE PUBLIC HEARING.
VOTE: Ayes by Mader, Kedrowski, Petersen, Wuellner and Schenck, the motion carried.
MOTION BY KEDROWSKI, SECOND BY SCHENCK TO APPROVE RESOLUTION 99-XX

94, NORTHWOOD
DISCUSSION: History: This petition is part of the City's effort to
clear-up questionable easements within the City. As the situation
exists, the City has a water main easement and separate sanitary sewer
easement on Lot 94, Northwood. The existing water main is located
within the water main easement, however, it is not centered in the
easement. This is a problem for the City, since we would have to work
within the easement should the line need repair or replacement. It
would be very difficult to work on the water main and remain in the
existing easement.
Additionally, the property owner intends to construct a garage
addition. A permit has been issued with the proposed garage located
on a portion of the existing water main easement. The permit was
issued with the intent of the City to correct the easement situation on
the lot. Mr. Nelson is willing to grant the City the proper easement (15
foot centered over the existing water main) at no cost to the city, as
part of this vacation. After such dedication, the proposed garage will
not be located on any easement.
Current Circumstances: The Planning Commission reviewed this
vacation request on December 15, 1998. The Planning Commission
adopted Resolution 98-035PC approving proposed vacation with the
condition a new easement be granted. The Planning Commission is of
the opinion there is no public need for the incorrect easement, as the
proper easement will be granted and the vacation is consistent with the
Comprehensive Plan. The applicant concurred with the staff report
and recommendation of the Planning Commission.

The Issues: Minnesota Statutes 412.851 allows the Council to vacate
easements or right-of-way by resolution. The statute states that "no
such vacation shall be made unless it appears to be in the public
interest to do so".
The vacation of the existing water main easement and granting of the
proper water main easement will be in the public interest. Any future
maintenance on this portion of the water main should be accessed
within the proposed easement. Hence, future maintenance of the pipe
should not disturb the owners' property outside of the easement
resulting in possible financial costs to the City and public.
Conclusion: The proposed vacation is in the best public interest with
the condition the proper easement be granted.
The City Council has three alternatives:
1. Adopt Resolution 99-XX approving the vacation as requested.
2. Deny Resolution 99-XX.
3. Defer this item and provide staff with specific direction.
Staff recommends Alternative #1. A motion and second to approve
Resolution 99-XX approving the vacation of the water main easement
located on Lot 94, Northwood, with the specific condition that a 15
foot easement be granted as stated in the resolution.

WHEREAS, the Planning Commission of Prior Lake has considered the
vacation of a water main easement on the property located in Lot
94, Northwood; and
WHEREAS, the Planning Commission has determined that the proposed
vacation is compliant with the Comprehensive Plan; and
WHEREAS, the Planning Commission has determined that there is not a public
need for the water main easement.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PRIOR
LAKE, recommends to the City Council that the previously dedicated water main
easement legally described and shown on attached Exhibit A, be vacated with
the following conditions:
1. A 15 foot utility easement, centered over the existing water main be granted
to the city. Attached is Exhibit B indicating the legal description of such
property .
2. The documentation relating to his vacation and granting of the proper
easement be recorded within 60 days of approval or the vacation will be null
and void.

INTRODUCTION
This petition is part of the City's effort to clean-up easements within the City. As
the situation exists, the City has a water main easement and separate sanitary
sewer easement on Lot 94, Northwood. The existing water main is located
within the water main easement, however, it is not centered in the easement.
This is a problem for the City, since we would have to work within the easement
should the line need repair or replacement. It would be very difficult to work on
the water main and remain in the existing easement.
Additionally, the property owner intends to construct a garage addition. A permit
has been issued with the proposed garage located on a portion of the existing
water main easement. The permit was issued with the intent of the City to
correct the easement situation on the lot. Mr. Nelson is willing to grant the City
the proper easement as part of this vacation. After such dedication, the
proposed garage will not be located on any easement.
As required by State Statute 462.356 Subd.2, the Planning Commission is
required to make a recommendation to the City Council regarding the disposal or
acquisition of public lands as it relates to the compliance with the
Comprehensive Plan.
Upon proper notification, State Statute 412.851 allows the Council to vacate
easement or right-of-way by resolution. The statute also states that "no such
vacation shall be made unless it appears to be in the public interest to do so".
DISCUSSION
The Planning Commission must make two determinations. Does the vacation of
the existing water main easement comply with the Comprehensive Plan and is
there a public need or anticipated future need for the dedicated property?

Comprehensive Plan Review
The proposed vacation of the water main easement is consistent with the
Comprehensive Plan.
Public Need
There is no need for the City to keep the existing water main easement, as the
existing easement is not centered over the water main itself and a new easement
centered on the water main will be granted as part of this vacation.
RECOMMENDATION
Considering that the proposed vacation is consistent with the Comprehensive
Plan and will not eliminate a public need, staff recommends approval of the
vacation of the water main easement with the condition a utility easement be
granted encompassing the location of the existing water main.
ALTERNATIVES:
1. Adopt Resolution 98-35PC, recommending the City Council approve the
proposed vacation of the water main easement as presented or with
changes recommended by the Commission.
2. Continue the discussion to a date and time certain to allow the staff to
provide additional information specifically requested by the Planning
Commission.
3. Based upon expressed findings of fact, recommend the City Council deny
part or all of the applications based upon inconsistency of the proposal
with specific regulations of the Zoning and Subdivision Ordinances and/or
specific policies of the Comprehensive Plan. In this case, staff should be
directed to prepare a resolution with findings.
RECOMMENDATION:
Alternative #1.

the Planning Commission.

A strip ofland 15.00 feet in width the centerline of which is described as follows:
Commencing at the most westerly comer of said Lot 94; thence South 31 degrees 30
minutes 51 seconds East assumed bearing along the southwesterly line of said Lot 94, a
distance of219.06 feet to the point of beginning of the centerline to be described; thence
North 61 degrees 43 minutes 42 seconds East to the northeasterly line of said Lot 94, and

On January 19, 1999, the City Council approved the vacation of existing water easement.
A condition of the approval included the granting of the proper 15' easement centered
over the water line. Enclosed is a Quit Claim Deed granting the City such easement.
Please sign (you and your wife) and have your signatures notarized. We can do this for
you at City Hall for no charge. Once signed, please return the deed to me for recording.
We will record the deed and the resolution approving the vacation. Please call me if you
have any questions.

I am processing Mr. Nelson's request to vacate the existing water/sewer
easement. Please provide me with the legal description of the existing easement
(to be vacated) and the description of the proposed easement to cover the actual
service lines. I would also like a drawing. Once we receive the information, I will
proceed with the application. It is my understanding the Planning Department
will take the request to the Planning Commission and the Engineering
Department will take the request to the City Council. Furthermore, we will
consider such requests on a case-by-case basis rather than to vacate the entire
Northwood Road easements.
