Pro Finishers Inc. is a wholesale and retail auto body shop. It has been in business since 1992. We need a
Wholesale Dealers License to purchase cars from dealers. These cars will be restored at the current
location and sold at auto auctions. The cars will be stored offsite or within the building. Pro Finishers will
not advertise these cars to the general public.

Dear Brad,
This letter is written in response to your request for City approval of a Minnesota Dealers
License. Under the Zoning Ordinance, your property is Zoned C-4. Offices are
permitted uses. Motor Vehicle Sales requires a Conditional Use Permit within the C-4
zoning district. Motor Vehicle Sales is defined as the display, sale and rental of
automobiles outside an enclosed building.
If your intended use with your dealers license is to conduct office functions only, and the
vehicles will be stored off-site or within your building, the City will not object to the
license. We will need a letter from you stating your intentions with your dealers license.
Where will the cars be stored? What function will your current space serve with a dealers
license, etc. However, if vehicles are stored outside and/or are advertised for sale the city
cannot approve of your dealers license.

RE: Conditional Use Permit Application
Dear Mr. Hanson:
Enclosed is the application for a conditional use permit you requested. This application
packet includes an instruction sheet as well as a checklist detailing the information you
must submit with the application.
As noted in this information, a conditional use permit requires a public hearing before
the Planning Commission and approval by the City Council. The Planning Commission
meets on the second and fourth Monday of each month. Your completed application
must be submitted at least 30 days prior to the Planning Commission meeting.

Thank you for your inquiry regarding dealer license requirements. Following is some general
information that may help you determine whether you are required to have a dealer license and
whether you are interested in applying for a license.
The attached chart reflects basic requirements and the activity limitations of each type of license
offered.
WHO MUST HAVE A DEALER LICENSE?
-- Motor Vehicles
Anyone who wishes to advertise, offer, solicit or engage in the business of leasing, selling new or used
motor vehicles or arranging the sale of motor vehicles. MS168.27
Anyone who has leased or sold more tllan fivE motor vehicles, either wllolesale or retail, in a twelve
month period is considered to be in the business of buying and selling motor vehicles and is required
to be licensed. .

-- used vehicle parts I Scrap Metal
Anyone who is in the business of selling used motor vehicle parts or processing and selling scrap metals
from motor vehicles is required to be licensed. MS168.27 .
-- Consignment Sales I Brokered Sales and Leases
Anyone who conducts consignment sales or arranges sales or leases must be licensed.. MS168.27
MOTOR VEHICLE SALES TAX I TITLE TRANSFER REQUIREMENTS:
Anyone who is licensed as a motor vehicle dealer is exempt from paying motor vehicle sales tax on
their acquisition of any motor vehicle for which they are licensed to lease or sell and is not required to
title the vehicle into the dealership name (due to the Federal Truth In Mileage Act there are some
exceptions to the title requirement>. Any vehicle used for lease must be titled into the lessor's name.
Anyone who is not licensed to lease or sell motor vehicles must pay applicable taxes and fees, including
motor vehicle sales tax, on their acquisition of each motor vehicle and transfer each motor vehicle into
their name before they can sell that vehicle. MS297B.035 subd 1 MS168A.10 subd 2 MS168A.11 subd 1
ACCESS TO MOTOR VEHICLE AUCTIONS:
Motor vehicle auction companies (North star, MAA, etc) are free to chose whom they wish to do
business with. More often than not, they chose to do business with licensed motor vehicle dealers.
LICENSE TYPES:
This state does not offer a "hobbyist" or "part time" license. See the attached chart.
ZONING:
A dealership of any type is considered to be a commercial operation. Generally, zoning authorities do
not approve commercial activity in areas that are zoned residential. In agricultural and industrial areas,
zoning officials may consider issuing special use permits for a commercial operation. In any case, the
applicant must review their intentions with the local zoning officials and obtain their written consent
for the type of business the applicant wishes to conduct.
· LOCATION REQUIREMENTS:
Asa licensee you are required to have a completed location designed for the exclusive use of the
dealership that meets all of the location requirements and attest to their existance at the time of
application. If it is determined that, upon the State's inspection of your business site, you have not met
the minimum requirements, your license may be denied. The attached chart offers you information on
the basic location requirements.
EXClusive use requirements
In the event that the dealership will be operating in a building where other businesses are located, the
dealership location must be set up in such a way that it is clearly separated.
The dealership must have an address that is separate from the address of any other business in the
building (suite number would qualify).
The dealership must be enclosed with floor to ceiling walls with a door that can be shut and locked to
close off the entire entrance and is designated for the exclusive use of the dealership.
There must be a separate and identifiable entrance to the dealership that leads to the outdoors or to a
public area. Note: shared office space such as a reception area or secretary pool does not qualify as a
public area. LESSOR, BROKER, and WHOLESALER exempt
The dealership cannot be accessed by entenng through any other business or residence that is located
in the building. LESSOR, BROKER, and WHOLESALER exempt
Used Motor Vehicle parts I Scrap Metal licensees are required to have only an address where the
records will be maintained and made available for inspection and telephone answering services.

LICENSE RENEWAL
All licenses expire at midnight, December 31st. They are renewed via a renewal application issued by
the department. Renewal fees are $103.50 for DT / DLR licenses, and $13.50 for DSB (trailer> licenses.
