JJ f' From: Don Rye ~ Subject: Jerry Mahoney questions In your memo of May 10, you asked 7 questions concerning Jerry Mahoneys property on Arctic Circle. The questions and responses follow. 1. Does he have to hook up to sewer and water under Code provisions? The short answer is yes. Both the zoning ordinance and Title 9 of the Code require hookups "where available". In Jerry's case, both sewer and water are available within 65 feet of his property, although he has indicated that his house would be located approximately 400 feet from the connection point. He also indicated he was not adverse to connecting to the City system if the costs were comparable to a well and septic system. I am told by Engineering that a sewer and water service can be installed for approximately $20 a lineal foot. In addition, sewer and water area charges would be collected. The total cost, assuming normal conditions, would be in the vicinity of $18,000. A mound septic system costs from $7,000 to $8,000. A 250 foot deep well would cost approximately $6,000. The cost differential is about $4,000. 2. Why wasn't his neighbor required to hook up to sewer and water? Unknown.. A permit was issued for the septic system in 1996 by the former Building Official. 3. Can he build a 30x60 structure on the property without a principal structure? No. He is limited to an accessory structure which does not exceed 832 square feet under the current zoning. 4. Under what conditions could he construct a pole building? If the property were zoned Agricultural, there is no limit on the size of the accessory structure. For residential structures, prefinished metal is acceptable under the Architectural Design section of the zoning ordinance. 5. What is the process he needs to follow in pursuing a rezoning or variance? He needs to submit an application along with the required fees. A copy of our application form is attached. 6. He gave us a list of questions which we agreed to research and respond to. As I recall, the questions are as follows: 1. Does he have to hook-up to sewer and water under the City Code provisions? 2. Why wasn't his neighbor in RLS 36, Tract B required to hook-up to sewer and water? 3. Can he build a 30 x 60 structure on one of the properties without a principal structure? 4. Under what conditions {rezoning/variance} could he construct the pole building? 5. What is the process he needs to go through for the rezoning or variance? 6. Why is the R-1/C-1 line drawn where it is? 7. How does he get access to his new home {Arctic Lake or the public street} and who pays? Because of the number of questions, would you prepare your response in the form of a memo we can share with Jerry and the City Council since he will have contacted most of them by that time.
