SECTION 100:
PURPOSE
101: The purpose of the Lakes Advisof\' Committee bylaws is to provide a set
of operatino procedures for the Lakes Advisorv Committee, and to
establish a code of ethics and conduct.
102: The Bylaws shall be reviewed annually bv the Lakes Advisorv Committee.
?nd any chanoes or amendments aareed to bv a maiority vote of the
90mmission shall be recommended to the City Council for adoption at its
annual meetino. The City Council conducts is annual meetino as the first
meetina in January of each Year.

201: COMMITTEE CREATED: A Lakes Advisorv Committee is herebv created
for the City. its puroose to be of an advisory nature to the City Council
and staff on issues related to lakes and other water resources within the
Citv of Prior Lake.
Said Lakes Advisorv Committee shall be composed of five 15\ members.
appointed by the Citv Council. On Iv residents of the Citv who are at least
18 years old shall be considered for appointment. Said members shall
serve three (3) Year-terms beainnina Noyember 1st and endina October
31st.
The members of the Lakes Advisorv Committee shall annually elect
officers in accordance with the procedures of oaraaraph 205 herein.
202: DUTIES OF THE COMMITTEE: The duties of the Lakes Advisorv
.Committee are as follows:
1. Research. study and make recommendations to the City Council on
the information contained within the "Comprehensive Lake
Manaaement Plan."
2. Research. studv and make recommendations to the Citv Council on-
the information contained within the "Storm Water Pollution
Prevention Plan." includino conductina reauired public hearinos.
203: APPOINTMENT: The Committee shall consist of five 15\ members
appointed by the Prior Lake City Council for a term of three 13\ years. The
Committee shall be representative of the citizens who live in Prior Lake.
Committee members may serve additional terms upon approval bv the
Prior Lake Citv Council. based upon satisfactorv attendance and
participation. continued residence within the coroorate limits of the Citv of
Prior Lake. and in accordance with the term limit policv established
herein. Committee members may serve additional terms uoon aooroval
of the City Council.
204: VACANCIES: If the office of Chair becomes vacant. the Lakes Advisorv
Committee shall appoint a replacement as set forth in paraaraph 205
herein. If the Office of Vice-Chair becomes vacant the Committee shall
elect a successor from its membershio at the next reoular meetina. and
such election shall be for the unexpired term of said office.
If an apoointed member of the Lakes Advisorv Committee resions. is
terminated. reaches a term limit. or otherwise vacates a seat of the
Committee. the Prior Lake Citv Council shall appoint a replacement in the
followino manner:
1. Applications are solicited. A Notice of the vacancy is made public and
individuals mav be encouraoed to consider the position.

2. The Citv Manaaer or his desianee. the Citv Council member who has
been apoointed as the liaison to the Lakes Advisorv Committee, or
who has been appointed to serve on the work aroup. and the
committee chair (unless the aooointment is the committee chair
aooointment or re-aooointment. or in the case where no chair has
been determined) shall interview all candidates and make a
recommendation to the full City Council. No person will sit on any
advisorv authoritv charaed with the selection of the successor for that
person.
3. The recommendation of the interview panel shall be presented to the
Citv Council and the Council mav accept or reiect the
recommendation. If the recommendation is reiected. the City Council
shall appoint another individual or decide to reopen the vacancv to the
public for new candidates.

Committee shall elect from amona its members a ee-a-Chair, and a Vice-

as Secretary of the Committee.

Council. and representation of the Committee as aopropriate.

Vice-Chair: - The Vice-Chair shall be selected annually by the Committee
and shall perform the duties of the Chair in his/her absence. The Vice-
Chair shall assume such other duties as assigned by the Chair.
Secretarv: - The City Manager or his/her designee shall act as the
Secretary and shall be responsible for recording and compiling a written
summary of all official activities of the Committee.
Section E.206: ,l\ppointmont Term Limit: It is the policv of the Prior Lake City
Council to impose a three term (9 vear) service limitation for all appointed
positions to the Lakes Advisorv Committee. Partial terms do not count
toward the term limitation. The puroose of the term limit policv is to
encouraae resident participation on City advisorv bodies and provide
communitv members with the opportunitv to participate in their local

SeGti9A G.207: PERFORMANCE CRITERIA: - Annually the Committee shall
perform a written self-evaluation on the following:

. Implementation of the P-F'2~~':"':)~ommittee's ouroose.
. Achievement of Goals and Objectives.
. Compliance with Bylaws.
. Formulation of proposals and recommendations and overall
accomplishments.
. Visitations of subject sites as applicable.
. Annual personal attendance record of at least 75%.
The Committee shall forward this evaluation to a review committee
comprised of the staff member assigned to the Committee, City Manager,
Mayor, and one member of the City Council. The review committee shall
present this report and any additional comments to the Council by the first
week of December for action and recommendation at the annual meeting
in accordance with the Council Bylaws.

309: EMPLOYMENT AND INVESTMENT: No elected or appointed official.

CONDUCTING MEETINGS

the Minnesota Open Meeting Lawall meetings of the Committee are open
to the public. Regular meetings shall be held on the third Tuesday of

In the event that such a date shall fall on a legal holiday, the meeting shall

circumstances and subject to the approval and consent of both the Chair
and/or Vice-Chair. Reaular and special meetinas of the Lakes Advisory
Committee shall be televised on cable television.

2. A copy of the notice, agenda and accompanying material shall be
prepared by staff and received by the Committee, City Council,
staff and others designated by the City Council, no later than the
Thursday prior to the Tuesday meeting and in no case later than
two (2) days prior to a special meeting.
SeGtion C.~ SPECIAL MEETINGS: - Special Meetings of the Committee may
be called by the Chair, or two (2) members of the Committee for the
purpose of transacting any business designated in the call. Staff may
recommend calling a special meeting, but must receive approval from
either the Chair or two members of the Committee. The call for a special
meeting may be delivered prior to the time of the proposed meeting to
each Committee member of the Committee at least two (2) days prior to
the special meeting. At such meetings, no business shall be considered
other than as designated in the call. The notification provisions of Section
B of tho :uticlo102 shall be followed.
SeGtion D.404: QUORUM FOR REGULAR AND SPECIAL MEETINGS:. - A
majority of Committee members shall constitute a quorum for the purpose
of conducting its business, but a smaller number may adjourn from time
to time until a quorum is obtained. When a quorum is in attendance,
action may be taken by the Committee upon a vote of a majority of the
Committee present.

Staff and/or a consultant make a presentation or report on the subiect-
matter for the hearina.
The oresidina officer asks Lakes Advisorv Committee members if thev-
have questions of the staff or consultant. if anv.
The presidina officer reauests a motion and second to open the oublic-
hearina..
The oresidina officer announces that input will be received from the-
citizens. Formal input includes the name and address of the speaker
delivered from the podium.
After all persons have been heard. the presidina officer requests a motion-
1. Close the public hearina and the Lakes Advisorv Committee. votes on
the motion. Once the vote is taken. the hearina is closed for the
record. or
2. Continue a oublic hearino. If the Lakes Advisorv Committee. votes to
continue the hearina. the presidina officer. in consultation with the
Lakes Advisorv Committee.. shall select and announce a time and
date certain for the continued Dublic hearina. No additional publication
or notice reauirements are needed if a hearina is continued to a later
date. However. no public hearina mav be continued more than once
without re-notice and publishino the time. date and location of the
hearinq.
The Lakes Advisorv Committee addresses the subiect matter throuch-
deliberation. auestions to citizens and staff. and reactions and statement
of position on the subiect.
If the public hearinG is closed. the Lakes Advisorv Committee should take-
action on the application beforB them in the form of a motion bv
resolution. However. the Committee mav formulate a recommendation
which outlines the parameters under which an approval would be oranted.
The reasons and conditions shall be stated in the motion or resolution for
approval or denial. Continuation of an action mav occur in the event
insufficient information is oresent to make a decision. The Lakes Advisorv
Committee. shall delineate the missinq information before continuina the
item.

capacity to the Prior Lake City Council and shall advise the City Council

the Committee. Semiannually, or as otherwise required by the Council,
the Committee Chair shall give an accounting of the Committee's
activities with respect to its goals and objectives before the City Council.
Additionally, specific powers, duties and responsibilities may be assigned
to the Committee upon approval of the City Council.
