Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: SEPTEMBER 2, 2008 AGENDA#: 5B PREPARED BY: ROSS BINTNER, WATER RESOURCES ENGINEER AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION TRANSFERRING LOCAL GOVERNMENT UNIT (LGU) PERMITTING AUTHORITY FOR WETLAND AND STORMWATER REGULATION FOR THE COUNTY ROAD 21 EXTENSION PROJECT DISCUSSION: Introduction The purpose of this agenda report is to recommend the City Council transfer wetland and stormwater LGU permitting authority for the County Road 21 northern extension project to the City of Shakopee (for wetland delineation, impact and replacement permitting) and to the Prior Lake Spring Lake Watershed (for stormwater permitting). Historv The County Road (CR) 21 project will extend 21 from CR 42 to Trunk Highway 169. This project includes grading previously undisturbed soil and changing drainage patterns, modifying wetlands and ultimately street construction. The City of Prior Lake is the LGU for the Wetland Conservation Act within the City limits and administers permitting for wetland delineation, impact and replacement. The City is also the LGU for stormwater and water quality standards through a Memorandum of Agreement with the Prior Lake Spring Lake Watershed District (PLSLWD). Current Circumstances Because the extension of CR 21 spans multiple LGUs for both wetland and stormwater rules the Project Management Team (PMT) has requested that Shakopee, Prior Lake and the PLSLWD work together to streamline the review and approval process. Since a minority of the project area is within the City of Prior Lake, the PMT asked the City to transfer its WCA LGU authority for permitting to the City of Shakopee and its stormwater permitting authority to the PLSLWD for this project. Attached is a request letter from the County. ISSUES: City staff is involved with the PMT for this planning and design effort and agree that a streamlined permitting and review process will be a more efficient approach. RECOMMENDED Alternative #1 MOTION: ReVi~ :;), Frank Boyles, Ci Motion By: Second By: WHEREAS, The County Road 21 extension project spans multiple jurisdictions for Wetland and Stormwater Permitting; and, WHEREAS, The City of Prior Lake is a partner with the City of Shakopee and the Prior Lake Spring Lake Watershed District in the Project Management Team for the extension; and, WHEREAS, In an effort to streamline design review and permitting requirements associated with the project Scott County has requested the City delegate its Local Government Unit authority' for the CR 21 expansion project to the City of Shakopee and the Prior Lake Spring Lake Watershed District, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City of Prior Lake delegates its LGU authority for wetland delineation, replacement and restoration to the City of Shakopee for the County Road 21 Extension. 3. The City of Prior Lake delegates its LGU authority for stormwater permitting under the Memorandum of Agreement for Local Water Planning and Regulation to the Prior Lake Spring Lake Watershed District for the County Road 21 Extension. Haugen Erickson Hedber9 LeMair Millar Frank Boyles, City Manager , J~~citypfpB\9rlake.com Phone 952.447.9800 / Fax 952.447.4245 June 23, 2008 Mr. Ross Bintner City of Prior Lake 4646 Dakota St. SE Prior Lake, MN 55372-1714 RE: Request for the City of Prior Lake to Delegate Stormwater and Wetland Review and Permitting to the PLSWD for Scott CSAH 21 Highway Design WSB Project No. 1783-00 Dear Mr. Bintner As a follow-up to our previous discussions and April 23 meeting at City Hall, on behalf of the Scott County Highway Department, we formally request the City of Prior Lake to delegate review and permitting authority for the Storm Water Management Plan (SWMP) and Wetland Conservation Act- Local Government Authority (WCA- LGU) to the Prior Lake Spring Lake Watershed District (PLSLWD) for the Scott County CSAH 21 Final Design. This request is made to streamline the review and permit processes between the cities and the PLSL WD. The following design issues have been discussed with you and the PLSL WD for the design of CSAH 21: Storm Water Manaf!ement Plan . Infiltration. Volume control will be accomplished through infiltration. The current design is based on a.6"/hour infiltration rate, but will be updated when borings and percolation tests on site are completed. Once these tasks are complete, WSB will formally submit this design to the PLSLWD for permitting approval. . Drainace Alterations and Landlocked Basin Connections. The project currently proposes to alter existing drainage patterns by more than 25 acres. This will require approval from the PLSLWD. . Rate Control. The rate control for CSAH 21 is designed to meet the PLSLWD rate control requirements. Wetland Conservation Act- Local Government Unit Permittinf! The County also requests the City of Prior Lake to delegate its LGD authority to the City of Shakopee for simplification of WCA permitting of the entire project. The CSAH 21 project is anticipated to impact approximately 7.25 acres of wetland, of which 0.23 acres are located within the City of Prior Lake and 7.02 acres in the City of Shako pee. Pursuant to the MN Rules 8420.0200 (Subp. 1.C), the Scott County Highway Department requests the City of Prior Lake delegate its LGD permitting authority to the City of Shakopee. Any special conditions or stipulations required by the City of Prior Lake and/or PLSL WD, shall be considered and documented by the City of Shakopee during the public noticing period and justified in the Notice of Decision.
