Dear Jeff,
This letter is a follow-up to our meeting on April 22, 1999 with Paul Baumgartner, Plans Examiner, you
and myself. We discussed your current permit application for a deck. A variance to the bluff setback will
be necessary to construct your deck in a manner to utilize the patio door recently added. We discussed the
variance procedures and hardship criteria.
We also discussed the process to remedy the lot line encroachment. Based on your survey, part of your
house is over the side lot line. You stated your title company is working to correct the problem. This will
require an Administrative Subdivision with variances to get City approval. I believe lot area, setback, and
impervious surface variances will be needed, A survey of both lots with existing and proposed conditions
including setbacks, lot area, lot width, and impervious surface will be necessary to make a variance
determinations and must be submitted as part of the application. The current fee for this application is
$175 and $150 for variances. Considering your title company is proceeding to correct the lot line situation,
you may want to request a variance for the proposed deck with the variances that will be needed as part of
the Administrative Subdivision to adjust the lot line. This will save you the $150 variance filing fee.
In regards to the permit submitted, we can approve the permit for the roof of your porch with deck above,
as long as the proposed roof deck does not extend past the existing wall of the porch below, The porch
does not meet the bluff setback and is therefore non-conforming. On a non-conforming structure one can
build up, but not outward increasing the non-conformity. Please let Paul Baumgartner know how you
intend to proceed with the permit submitted. He can make such minor amendments to your building plans
for fmal City review,
We also discussed the once required Bluff Indemnification, On April 19, 1999 the City Council passed a
resolution nullifying such agreements previously recorded on specific properties, Your property was
inadvertently left out. Therefore, we are proceeding to bring the matter to the City Council.
