CONSIDER APPROVAL OF A RESOLUTION
AUTHORIZING THE PURCHASE OF APPURTENANT
EQUIPMENT FOR THE TACTICAL TEAM VEHICLE FROM
THE FOREFEITURE ACCOUNT.
DISCUSSION:
Introduction
The Police Department is asking for Council approval to purchase
appurtenant equipment for the Sprinter van using funds from an
account created through the sale of forfeited vehicles.
Historv
Minnesota Statutes authorize the administrative forfeiture of motor
vehicles and other property used or related to the commission of
designated offenses; for example, driving while under the
influence (DWI), as well as prostitution and drug offenses. Such
property may be kept by the law enforcement agency and used in
the performance of official duties or the property may be sold and
the proceeds from the sale distributed to the appropriate law
enforcement agency, the county attorney or other prosecuting
agency that handled the forfeiture, and to the state. Proceeds from
forfeiture sales forwarded to the law enforcement agency must be
used to supplement the agency's operating fund for use in law
enforcement and/or DWI-re1ated enforcement, training, and
education. (Minnesota Statutes 99169A.63, subd. 10; and,
609.5315, subd. 5).
The Police Department is a member of the Tri-City Tactical Team
(TCTT) through a Joint Powers Agreement among Scott County
and the Cities of Prior Lake, Savage, and Shakopee. Under the
Joint Powers Agreement, each agency supplies its own truck
and/or trailer to convey personnel and equipment to trainings and
high-risk incidents involving the TeTT. On November 19, 2007,
the City Council adopted Resolution 07 -196, authorizing an
expenditure of $41,994.00 from the forfeiture account for the
purchase of a 2008 Dodge Sprinter van for use by the Prior Lake
Police Department as a member of the TCTT. The Police
Department took delivery of this vehicle in July 2008.

Current Circumstances
It is necessary to modify and equip the van to meet the needs of the
TCTT. We are estimating that an expenditure of approximately
$6,000.00 will be necessary to purchase the equipment required to
meet the functional needs of the Team. The required equipment
includes emergency lights and a siren, a step bumper, and storage
compartments, all of which will be acquired in accordance with the
City's purchasing policy.
FINANCIAL
IMP ACT:
It is recommended that the funds allocated for this equipment
purchase come from the forfeiture account and not from tax
dollars. Currently, there are sufficient funds in the City's forfeiture
account to cover this expense.
ALTERNATIVES: 1. Approve Resolution 08-XX authorizing an expenditure of up to
$6,000.00 from the forfeiture account to equip the van.
2. Deny the approval and provide direction to staff.

RESOLUTION OS-XX
A RESOLUTION APPROVING THE PURCHASE OF APPURTENANT
EQUIPMENT FOR THE POLICE DEPARTMENT'S SPRINTER VAN FROM
THE FORFEITURE ACCOUNT

WHEREAS, to meet the needs of the Police Department members on the Tri-City
Tactical Team the Council approved the purchase of a Dodge Sprinter
van; and
WHEREAS, the van purchased by the Police Department needs to be equipped and
modified to meet the needs of the Tri-City Tactical Team; and
WHEREAS, proceeds from the sale of forfeited vehicles, as authorized by state statute,
has been designated for such purposes.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
PRIOR LAKE, MINNESOTA as follows:
1) The recitals set forth above are incorporated herein.
2) The Police Department is authorized to spend up to $6,000.00 for the
appurtenant equipment necessary for the van to meet the needs of the
Tri-City Tactical Team, following purchasing policy guidelines.
3) Funding for this equipment is to be drawn from the forfeiture account
as authorized by state statute for such purposes.
