RESOLUTION PERTAINING TO THE SUBDIVISION OF LANDS, CITY COUNCIL
APPROVAL OF CERTAIN CONVEYANCES, AND RECORDING SUBDIVISION
ORDINANCES

WHEREAS, Minn. Stat. ~ 272.16 provides for County approval of recording documents
transferring less than the whole of a parcel of lands, as charged in the tax lists,
without City approval.

WHEREAS, the process of dividing land into home sites or other uses is one of the most
important factors relating to the growth of the City.
WHEREAS, the interests of unsuspecting parties purchasing portions of tax parcels could be
negatively affected if the deed or other conveyance document is not first
approved by the City.
WHEREAS, the integrity of the Subdivision Ordinance will be bolstered by enacting this
resolution.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council that

1. The City Manager is hereby authorized and directed to record the City's Subdivision
Ordinance to include any and all future amendment thereto, at the office of the Scott County
Recorder.
2. Pursuant to Minn. Stat. ~ 272.162 the Scott County Auditor shall not transfer or divide the
land in the official records of the County and shall not certify the instrument of conveyance
as provided in Minn. Stat. ~ 272.12, if:
a. The land conveyed is less than a whole parcel ofland as charged in the County's tax lists; "

b. The part of land conveyed appears within the area of application of municipal subdivision
regulations adopted and filed under Section 462.36, Subdivision 1; and

Subdivision 12.
Unless such instrument bears a stamped certification thereon duly executed by the City that
states:
a. That the City's subdivision regulations do not apply as set forth in City Ordinance 6-1-3.
b. The subdivision has been approved by the City Council pursuant to the City's
Subdivision Ordinance; or
c. The division of taxes and filing and recording have been waived by resolution of the City
in the particular case because compliance would create an unnecessary hardship and
failure to comply would not interfere with the purpose of the City's Subdivision
Ordinance.
3. Subdivisions of land within the City shall be governed by Minn. Stat. ~ 272.162.

Description of Proposed Project
Correction of a property transfer oversight which occurred in 1989. Combine
the following legal descriptions into one parcel indentification number:
· Lot 8 Seven Acres and that part of Lot 9, Seven Acres, Lying Westerly of
a line drawn perpendicular to the Southerly line of said lot 9, Seven Acres
from a point distant 475.42 feet Westerly of the Southeast comer of said
lot 9, Seven Acres according to the Plat of Seven Acres.
TIns parcel has a Pill number of 251180081.
When this parcel was created it should also have included that part of Lot 10
of Seven Acres commencing at the Northwest comer of Lot 10 and then
running East along the north line of Lot 10 thirty (30) feet, thence South
twenty (20) feet thence West to the dedicated driveway.
The applicant and owner are making tins application so the paperwork can be
completed to make tills all one parcel as it physically has been for the last 10
years.

The Common Council of the City of Prior Lake met in regular
session on Monday, August 21, 1989, at 7:30 p.m. in the City
Council Cha~ers. Present were Mayor Andren, Councilmembers
Fi'tzgerald, Larson, Scott, White, City Manager Unmach't,
Assistant City Manager/Economic Development Director Schmudlach,
and City Attorney Kessel.
Mayor Andren called the meeting to order and asked everyone to
rise for the pledge of allegiance.
The minutes of the August 7, 1989 meeting were reviewed by
Council.

INTRODUCTION:
Mr. Duoos is requesting the Council to amend
their motion of July 20, 1989, requiring the
~pplicant to remove his existing cabin or
1ntegrate it with the new construction. His
current request is to retain a portion of the
existing cabin as storage space and totally
remove a 10X18 detached garage (see attached
propvsal for details).

BACKGROUND:
In 1987, Mr. Duoos and Staff were working
together towards the eventual construction of
a new single family home on his difficult lake
lot. Mr. Duoos and I disagreed on the status
of the existing cabin. He wanted to keep it
and the code required removal. He appealed to
Council which gave him the option to totally
integrate it into the new construction. With
respect to these options, I prepared a letter
of understanding to be attached to the
building permit (see attachment). Due to
circumstances beyond his control, Mr. Duoos
was unable to fulfill his obligations.

DISCUSSION:
A number of extensions were granted to Mr.
Duoos for purposes of compliance to Council
requirements. His current proposal is a
hybr~d of his earlier two options. He would
remove a portion of the existing cabin, add
two, 3 foot doors, and use the building for
cold storage of yard equipment, etc. The
building is not connected to either sewer or
water and the furnace has been removed. In
addition, this proposal also calls for the
removal of the single stall garage to the east
of the cabin. A driveway would provide access
to the store '~ building which would be used
for addi'i' '..nal parking and turnaround
maneuvering.

PROPOSAL
Convert approximately 5/8 of the original structure, which would be 360 sq. ft.
into a garage structure for the storage of gas cans, lawn equipment, ski's, boating
equipment and-snowmobile~. This proposal would replace the previous plan of attaching
the cabin structure to the new house.

1) To provide a safer storage for gas cans rather than storing them in a tuck under
garage below bedrooms. -
2) New structurp. does not have a basement, thus we need the storage space.
3) The original plan wa.s to attach the cabin to the new structure and utilize it
as a recreational room. At this point in our project, we now realize that we
need the storage space more than we need a recreational room. Also, we feel
- that attaching an older structure to a new one is not a good concept, nor an
economical one. The cost to attach the cabin would beat least $15,000.00
more, making that project impossiblr: for us to afford at this time.
4) The cabin structure, having been built by my grandfather, is sound and well
constructed.
5) The final size of the structure would be equivalent to a 20' x 18' garage.
6) The garage structure would be approximately 15' from the property line of
lot #7 and 18' from the new house.
7) Converting the c~bin to a garage will provide for the removal of the original
garage which is presently located in the best location for a driveway turn-
around. At present, we have to turn around in th~ driveway at 14684 Cove Avenue.
8) Leaving structure in present location splits the drainage between the lake
and the y'oad, and provi des a buffer for my parents who 1 i ve next door. Thei r
home is land-diked and any alteration in drainage is critical. I have provided
an c:dditional 8" culvert across Cove Avenue, at my own expense, in order to
aneviate any possible back flooding situation from occurring at my parents.
Any landscape alterations have to be handled with extreme caution.
The converted stru,-;ture will be fitted with a garage door, !garage sized windows
and siding to match the new structure. (see attached sketch)
All plumbing and kitchen fixtures have already been removed. (see the attached,
"Procedure for ConverSion" list for other removals),
Once converted to a garage, the structure will not be any more 'hij1abitable
than any other garage in Prior Lake.

In Mr. Mueller's January 6th letter he has put the City on notice that Cove
Avenue must be raised to elevation 907 (Section 7.0 of the Flood Plain
Ordinance). It is my opinion that this section does not apply in this case. My
reasons are that it is an existing subdivision and no additional building
PE"rinits Were granted as the result of the division. The division of Lot 9
merely allowed Mr. Duoos to add additional land to a buildable lot. Mr. Mueller
reluctantly agrees but has requested we develop an evacuation plan in the event
of flooding. I have agreed to do such a plen.
In slJ'l\l1lation, staff has no objection to the new proposal. To approve the
following action is required:
1.) Grant a lakeshore variance of 46 feet.
..
2.) Grant a variance fran Section 4.lP to allow a structure to be moved
within the City.
3.) Grant a variance to permit fill to extend less than 15 feet beyond the
limits of any structure below elevation 909.
4.) PBguire the applicant to rnovethe lire hydrant and manhole at his own
expense.
5.) Grant a 22 foot front yard variance.

The Planning Commissioners discussed the P.U.D. Amendnent with regard to higher
density, additional heat slips, the tree planting plan, and traffic at the
intersection of County Road 21 and Lord's Street.
At this time, Chairman Roseth read a message that was telep,oned in to the
Planning Department on January 19. 1988, by Harold Dellwo, 4287 Grainwood

. ..of Cove AvenUE:, and move the cat-in into the proposed addition, thus needing a
<46' lakeshore variance and a 22' front yard variance. Mr. Duoos stated that he

SUBJECT :
The applicant is proposing to raise the existing structure on Lot 8 of Seven
Acres to elevation 909, move it approximately 14 feet to the northeast, and
build an addition. To accanplish this the following variances are n~ssary:
1.) A-55 foot.lakeshore variance (4.lJ Zoning Ordinance).
2.} A variance to permit a structure to be moved within the City (4.1P
Zoning ordinance).
3.) A variance to permit fill to extend less than the 15 feet beyond the
limits of any structure below elevation 909 (5.13 Flood Plain
Ordinance) .
STAFF ANALYSIS:
The applicant's proposal is an ambitious project and involves a number of
goverrmentalagencies and variances fran local codes. Mr. Duoos had originally
applied in March of 1987 for apprOlTal. However, his plan met resistance fran
the D.N.R. and it was decided that the Planning Canmission review be postponed
until the D.N.R. issue was resolved.
Mr. Duoos is cur rmtly the owner of Lot 8 and the westerly 100 feet of Lot 9
Seven Acres. The Se\Ten Acre Plat dates back to 1948 and consists of 11
lakeshore lots. ~rith the exception of Lots 5-8 which ;.tre shallow and narrow
lots, the rest of th~ plat canes close totodays size stcmdards. Unfortunately,
the milj 0 rity of the plat is below 910 elevation and therefore in the flood plain
of the Prior Lake and subject to the Flood Plain Ordinanc.~ (see attached topo
map) .
The existing cabin on Lot 8 has a current low slab elevation of 905.8 which
along with new construction needs to be 909. The cabin has a 904 setback
distance of approximately 15 feet. The proposal would move the cabin an
additional 14 feet fran the 904 contour. Section 4.lJ of the Zoning Code does
not permit structures to be moved into or within the City. Mr. Duoos has strong
sentimental ties to the cabin and plans to architecturally integrate it with the

addition. On July 20th, at the request of Mr. Duoos the City Council endorsed
the concept of saving the cabin am integrating it architecturally with the new
construction. Me. Duoos developed a nllllber of options all of which preserved
the cabin. Mike Mueller of the D.N.R. and City Staff reviewed the options and
are convinced that the only way to save the cabin and still add on would be
IOOVe the cabin and raise it to the 909 elevation.
First and foremost, the applicant needed to obtain D.N.R. sup{~rt for his
proposal to fill the lake bed. According to the D.N.R. mos~ .)f Lot 9 is lake
bed. Mr. Muelle I, howeve r, would only ElUJ?[X>rt a l:'lan that el iminated the
flooding situation of the cabin, minimized the aIOOW'lt of filHng, and require
the greatest lakeshore setback possible. Once the developnent parameters were
agreed by Me. Duoos, a plan was soon developed that is supported by both the
D.N.R. and the Watershed District which will issue the necessary permits to
i.nplement this plan.
Prior Lake's Flood Plain Ordinance requires fill to be placed at a distance of
15 feet beyond the structure at an elevation no less than 909. This regulation
is intended to prevent damage to structures especially thei r footings. In this
sftua.t:V~n the applicant cannot canply since the distance between the cabin 's new
locaf:ion end the adjacent hane is only 15 feet. The proposal calls for the
sout~J v;t:ll ,),': the cabin to be at 908 with a gradual backslope to 906. '!be wall
_.wEF'Oe ).~~P.fo::~ with concrete and iron. The finished fill elevation 15 feet
fran;he ~.iditic'n will be between 908 and 909. This is less than the 909
requirel.,;:::L ':rho;.; ordinance should be anendf'd to reflect fill lower than the
lowest living elevation. '!bis is canroon sense since drainage (!Nay fran the
structure is required.
The 904 contour line will be established by filling and will be in close
proximity to the 906 contour line as prq;>osed. A rip rap retaining wall with
top elevation of about 906 will be construct.ed to keep the fill fran eroding.

grMF REXD~TION:
Perhaps the best way to look at this proposal is to consider developnent options
_ and,then .det~rmine what variances are necessary to inplement it. Staff viewed
-this 'aPPlication in such a way, keeping in mind that the objective was to
mitigate the affect on the envirorment am require the least alOOunt of deviation
"fran City .ordinances. Staff recamnends that this plan and necessary variances
be approved.

Gary Turpening, architectural representative, commented that they had not
received the r~port from the D.N.R. until the meeting and would like to wait
until City Plann~r Graser gave his report.
City Planner Graser commented per rnemo dated January 7, 1988.
Gary Turpenii1g commented that the request is for a 55' variance from the
lake shore due to design of the house, also to maintain a large oak tree, and
~ince they are unable to obtain more land, obstruction of their view was a
conce rn.
The Planning Commissioners discussed the variance request and had concerns ov~r
setting a precedent, lack of hardship, coverage ratio of 30%, and the D.N.R.'s
comments.
At this time the Breckners requested a conference and that their item be moved
to .the end of the Agenda.
ITEM V -' VAIU:ANCE RIDUEST BY MN oocm_
Dan Duoos canmented that he has met and talked several times in the past to City
Planner,Graser, Mike Mueller of the D.N.R., and the Prior Lake City Council
about the cabin, and building an addition on the property in Seven Acres due to
the flood plain of the area. Mr. Duoos stated that he has purchased the land
north of the cabin which is in the flood plain. He would raise the cabin, build
an addition, move the cabin into the addition, complete a land dike to improve
the area and p~Jt in a drainage pipe to direct t.he water to help eliminate the
,flooding. . The . owner to the south 15 Mr. Duoos' parents and they have no
,'<objections. Mr. i)uoos felt the letter from the D.N.R. was a total surprise
since the last. time he spoke to Mike Mueller of the D.N.R., who picked out a
plan and said he would recommend it to Mr . Graser. Also Don Benson of the
Watershed District and his hydrologist met with Hike Mueller and recommended a
structure be built to help eliminate water problems. Therefore, after mrmy
meetings ~,d delays Dan felt thr plans were now proceeding but to find out
tonight that this is not the case.
City Planner Graser commented per memo dated January 7, 1988.
Mr. Lawrence Miller, 1095 Polk Place, Minneapolis stated that the property north
of Mr'. Duoos' cabin is owned by his parents. He felt Mr. Duoos is solving 2
problems with his plan: the cabin and the land which is unsuitable and needs a
lot of work and expense and would benefit the City.
The Planning Commissioners discussed the variance request and had concerns over
the lake shore variance, flooding, moving the fire hydrant, the concerns of the
D.N.R., and setting of a precedent.

The Prior Lake Planning Department has received an application from Dunrith (Bud Waund)
on behalf of Daniel Duos to consider an Administrative Land Division for the property
described as:
Lot 8, SEVEN ACRES, Scott County, Minnesota and that part of Lot 9, SEVEN ACRES,
Scott County, Minnesota, lying Westerly of a line drawn perpendicular to the Southerly line
of said Lot 9, SEVEN ACRES form a point distant 475.42 feet Westerly of the Southeast
corner of said Lot 9, SEVEN ACRES, according to the recorded plat of SEVEN ACRES on
file and of record in the office of the Registrar of Deeds in and for Scott County, Minnesota.
The proposal is combine the previously described property with property described as:
That part of Lot Ten (10) of SEVEN ACRES, described as follows: commencing at the
Northwest Corner of said Lot 10 and then running East along the North line of said Lot 10
thirty (30) feet; thence South 20 feet; thence West to the dedicated driveway; thence
Northwesterly to the place of beginning, according to the plat of SEVEN ACRES on file and
of record in the office of the County Recorder in and for Scott County, Minnesota.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the City Manager or
representative to authorize subdivision approval without a public hearing under the following
circumstances:
1. The division of the parcel will not result in more than three parcels.
2. The property to be subdivided is a lot of record in the office of the County Recorder of
Scott County.
3. The resulting parcels generally conform to the shape and area of existing or anticipated
land subdivisions in the surrounding areas.
4. The division will not cause any structure to be in violation of setbacks.
5. Any easements which may be required by the City must be granted.
6. The owners of the land contiguous to the parcel must be notified in writing, and no
written obiection received within ten davs followin1! notification.
7. Any written objection shall constitute an appeal. Such an objection shall be forwarded
to the City Council who shall hear the objection and decide the matter.

Dear Bud and Dan:
This letter is a follow-up to an inspection of the site on November 1, 1999. The
following are conditions which must b~ met prior to City approval of the deeds:
1. Impervious surface information mli1st be. submitted. Maximum permitted is 30%. If
the existing property at 14670 is over 30%, then the combined larger lot, as proposed,
cannot exceed what is existing. This would result in removal of pavement to be in
compliance.
2. The shed must be relocated as not to encroach the lot line. The shed can be relocated
to a location meeting all setbacks as long as imperious surface is not increased.
Otherwise, the shed must be remoted.
3. All conditions relating to the previpus administrative subdivision must be complied
with. The proposal from Mr. Duoos, which was approved by the City Council on
8/21/89, is attached. This includes alterations to be made to the old cabin to convert it
into a garage/shed for storage. Based on our inspection- the following items need to
be completed:
1. Remove bath fixtures.
3 . Verify disconnection of gas.
5. Run electric from main house.
7. Install overhead garage door.
9. Remove chimney and roof vents.
The necessary building/grading pe!rmits must be obtained prior to commencing work.
2. Remove kitchen sinks and cabinets.
4. Verify cut and capped sewer line.
6. Remove bedroom end of structure.
8. Install garage windows.
4. The driveway must be paved per qity ordinance.

County Auditor's Office. Scott County requires all deeds creating new parcels be
approved by the City of Prior Lake before they will be accepted for recording. At some
point, the original deeds must be submitted to this office and we will issue the necessary
approvals. Copies of the recorded documents must then be submitted to the City as
evidence that the administrative land division has been filed.

Dear Mr. Waund:
The information you submitted on June 29, 1999, indicates you are proposing to combine a
portion of Lot 10, Seven Acres, with Lot 8, Seven Acres. This is the same proposal Mr. Dan
Duoos discussed with the Planning staff about a year ago. At that time, we informed Mr.
Duoos that this constitutes a lot combination, and, according to the City Subdivision
Ordinance, requires an Administrative Lot Subdivision. The Subdivision Ordinance has not
changed, and an Administrative Lot Subdivision is still required.
Attached for your use is an application form for an Administrative Lot Subdivision. This
application must be submitted to the Planning Department along with the following
information:
1. A certificate of survey of the new combined parcel, including the new legal description.
2. A list and labels of the names and addresses of the owners of property contiguous to the
parcels in question. This information may be obtained from the Scott County Auditor or
a certified abstract company.
3. A filing fee of $175.00.
An Administrative Lot Subdivision of this sort is generally approved by staff, as long as no
variances are required. Following submission of a complete application, we will send
notices to the adjacent property owners of the pending combination. The Subdivision
Ordinance allows these property owners 10 days to appeal any decision. If no appeals are
filed, staff will approve the combination.

The property at 14684 Cove Avenue, Lot 7 of Seven Acres has been listed
and is due to close July 1, 1999. As we prepare to do the title work, there is a
tag-along piece of property on the tax records, which needs to be dealt with
to clean up the title.
This tag-along should have followed Lot 8 when it was sold within the
family, but evidentially was overlooked.
Enclosed is a synopsis of the properties history from the abstracts and a copy
of the plat showing the location of the properties.
We propose to either leave the tag piece in Matthew Duoos name or do a
quit claim deed from Matthew Duoos to Dan Duoos, owner of lot 8 (and part
of 9) of Seven Acres.
Enclosed for you to approve and certify is the legal description that we will
use in our file for the Title Company.

The Duoos family has owned since 1949 three parcels of land all acquired
separately via a warranty deed for each.
The Parcels are:
1. Part of Lot 10 of Seven Acres - September 7, 1949
Commencing at the Northwest comer of said Lot 10 and thence running
East along the North line of said lot 10, thirty (30) feet; thence South
twenty (20) feet; thence West to the dedicated driveway; thence
northwesterly to the place of beginning, according to the plat of Seven
Acres on file and of record in the office of the Register of Deeds in and
for Scott County, Minnesota
2. Lot 8 of Seven Acres - May 20, 1949
3. Lot 7 of Seven Acres - April 13, 1949
Einar and Ardys Duoos maintained title to all three parcels until Daniel
Duoos (son) purchased part of Lot 9 of Seven Acres and Lot 8 from Einar
and built a new home.
The parcel (part of Lot 10) which should have followed along with lot 8 was
not addressed at that time even though it joins up with Lot 8.
Einar passed away a couple of years ago and the family is selling Lot 7 with
Einar and Ardy's house on it. Before when it was all in the family the little
tag piece (part of Lot 10 next to Lot 8) title was of no concern nor an
ownership issue.
Now that Lot 7 is to be sold outside of the family, there is a desire on the
part of the Duoos family and the new buyer of Lot 7 to clear the legal
description and tax records so that the tag piece which abuts Lot 8 is either
carried with Lot 8 or by itself.
To accomplish this, a quit claim deed transferring title from Matthew Duoos
(grandson who inherited) to Daniel Duoos, (owner and resident of Lot 8 and
part of Lot 9 of Seven Acres) will be drawn up or the tag piece can remain
in Matthew Duoos' name.
