CONSIDER APPROVAL OF RESOLUTIONS APPROVING THE
COOPERATIVE AGREEMENT WITH THE MINNESOTA DEPARTMENT
OF TRANSPORTATION AND SCOTT COUNTY REGARDING THE
OPERATION MAINTENANCE OF A TRAFFIC CONTROL SIGNAL
SYSTEM AND INTEGRAL STREET LIGHT AT THE TRUNK HIGHWAY
13/CSAH 21/FIVE HAWKS AVENUE INTERSECTION
HISTORY: The proposed Ring Road project includes the construction of
a new "backage road" between Franklin Trail and CSAH 23 as shown on
the attached drawing. The road was to be constructed in three segments.
Franklin trail to Toronto was completed in 2002 together with the Park
NicolletlCrystal Care project. Segment 2 is identified as City Project No.
01-01 which is the central segment of the proposed Ring Road between
Toronto and Duluth Avenues and includes a regional storm water pond.
The third segment is identified as City Project No. 02-06 and includes the
realignment of CSAH 23 (Panama Avenue) at the intersection with TH
13. Phases 2 and 3 will be bid together as one project
The City Council adopted Resolution 02-22 on February 19th, 2002
approving plans and specifications for the second phase of the Ring
Road (City Project No. 01-01) and Resolution 03-84 on May 19th, 2003,
approving plans and specifications for the third phase of the Ring Road
(City Project No. 02-06) which includes the CSAH 23/Five Hawks/TH 13
intersection. The City Council also adopted Resolutions 03-15 and 03-16
entering into cooperative agreements with both Scott County and MnDOT
for the construction of the third phase of the Ring Road (City Project No.
02-06). The City will received $368,500 from MnDOT through their
cooperative agreement program.
CURRENT CIRCUMSTANCES:
The City must also enter into a cooperative agreement for the traffic
control signal that is proposed at the TH 13/CSAH 23/Five Hawks Avenue
intersection for this project to proceed. The agreement is for the
operation and maintenance of the traffic signal and streetlight at the
intersection. The total estimated cost for the signal is $180,000. The City
will also be responsible for providing the electrical power for the traffic
control system and streetlight as well as maintaining the light portion of
the streetlight and all pedestrian crosswalks. The cost for the signal will

be funded through the City's cooperative agreements with Scott County
and MnDOT. Because the signal is located at an intersection of state,
county and city streets, Scott County will also be a party to the
agreement.
The total estimated construction cost of the TH 13/CSAH 23/Five Hawks
Avenue/Ring Road Phase 3 improvements including utilities and traffic
signal is $2,414,600. The estimated cost of the traffic signal is $180,000.
The bid opening for this project is scheduled for August ih. The costs in
the cooperative agreements are based on engineer's estimates and are
not included in the Resolutions for approval as the cooperative
agreements will be adjusted based on actual bids. A final appropriation
resolution will be brought back to the Council for approval upon bid
opening.
Funding sources for the traffic signal are 50% MnDOT, 25% Scott County
and 25% City funds.
The City's final cost allocation will be determined by actual construction
quantities subsequent to project completion.
The alternatives are as follows:
1. Approval of the attached Resolution as required to authorize the
Mayor and City Manager to enter into a traffic signal agreement with
MnDOT and Scott County.
2. Table this item for a specific reason.
3. Deny this agenda item for a specific reason.
RECOMMENDATION: Approve Alternative No.1.

RESOLUTION APPROVING THE COOPERATIVE AGREEMENT WITH SCOTT COUNTY
FOR MAINTENANCE AND OPERATION OF A TRAFFIC CONTROL SYSTEM AT THE
INTERSECTION OF TH 13, CSAH 23 AND FIVE HAWKS AVENUE

WHEREAS,
The Minnesota Department of Transportation, City of Prior Lake and Scott
County desire to complete install a full traffic actuated traffic control signal
system with mast arms and integral street lights at the intersection of TH
13, CSAH 23 and Five Hawks Avenue within the City of Prior Lake; and
WHEREAS,
The City has expressed interest in installation of an Emergency Vehicle
Pre-emption system to be installed in conjunction with the signal
contruction; and
WHEREAS,
The Minnesota Department of Transportation, Scott County and the City of
Prior Lake have prepared a Traffic Control Signal Agreement acceptable to
both parties.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The recitals set forth above are incorporated herein.
2. The Agreement for Participation in the Construction and Operation of Traffic Control
Signal System and Integral Street Light between the State of Minnesota, City of Prior
Lake and Scott County is hereby approved and the Mayor and City Manager are
authorized to execute said agreements.
