RESOLUTION PROVIDING FOR THE VACATION OF A PORTION OF THE RIGHT-OF-WAY FOR WILD HORSE
PASS AND THE DRAINAGE AND UTILITY EASEMENTS LOCATED ON LOT 21, BLOCK 4, LOTS 14-15, BLOCK
5, AND OUTLOTS A AND B, THE WILDS SOUTH AND ON OUTLOTS A AND B, THE WILDS fire ADDITION

WHEREAS, A petition for the vacation of a portion of the right-of-way for Wild Horse Pass and the
drainage and utility easements located on Lot 21, Block 4, Lots 14-15, Block 5, and Outlots A
and B, The Wilds South and on Outlots A and B, The Wilds 5th Addition, has been duly
presented to the City of Prior Lake, signed by the owners of the property abutting the following
described easement situated in the City of Prior Lake, Scott County, Minnesota to wit:
Legal Description (Right-of-Way):
All that part of Wild Horse Pass as delineated and dedicated on THE WILDS SOUTH,
according to the recorded plat thereof, Scott County, Minnesota, lying northerly and easterly
of the following described line:
Commencing at the northwest corner of Lot 21, Block 4, said THE WILDS SOUTH; thence on
an assumed bearing of South 00 degrees 13 minutes 37 seconds East, along the westerly line
of said Lot 21, a distance of 179.37 feet to the northerly right-of-way line of said Wild Horse
Pass and the point of beginning of the line to be described; thence South 00 degrees 13
minutes 37 seconds East, a distance of 14.78 feet; thence South 81 degrees 29 minutes 56
seconds East, a distance of 10.92 feet; thence easterly a distance of 75.88 feet, along a
tangential curve concave to the north, having a central angle of 07 degrees 54 minutes 18
seconds and a radius of 550.00 feet to the east right-of-way line of said Wild Horse Pass and
there terminating.
AND
Legal Description (Drainage and Utility Easements):
All drainage and utility easements as delineated and dedicated on THE WILDS SOUTH,
according to the recorded plat thereof, Scott County, Minnesota, lying over, under and across
the following described property:
Lot 21, Block 4, Lots 14 and 15, Block 5 and Outlets A and B, THE WILDS SOUTH, according
to the recorded plat thereof, Scott County, Minnesota.

Outlots A and B, THE WILDS 5TM ADDITION, according to the recorded plat thereof, Scott
County, Minnesota.
WHEREAS, Notice of the hearing has been duly published and posted in accordance with the applicable
Minnesota Statutes, and
WHEREAS, A Public Hearing was held on said petition on Monday, July 7, 2003, at 7:00 p.m. in the
Council Chambers at the Prior Lake Fire Station #1; and
WHEREAS, The City Council then proceeded to hear all persons interested in said petition and persons
interested afforded the opportunity to present their views and objections to the granting of said
petition; and
WHEREAS, New right-of-way and drainage and utility easements will be dedicated as part of the final plat
for The Wilds 6th Addition, so the existing right-of-way and drainage and utility easements are
not necessary for the maintenance of public utilities; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The City Council of Prior Lake has determined that the vacation of said right-of-way and easements would be in
the public interest.
3. Pursuant to Minnesota Statues 412.851, the following described drainage and utility easements are hereby
vacated:
Legal Description (Right-of-Way):
All that part of Wild Horse Pass as delineated and dedicated on THE WILDS SOUTH, according to the recorded
plat thereof, Scott County, Minnesota, lying northerly and easterly of the following described line:
Commencing at the northwest corner of Lot 21, Block 4, said THE WILDS SOUTH; thence on an assumed
bearing of South 00 degrees 13 minutes 37 seconds East, along the westerly line of said Lot 21, a distance of
179.37 feet to the northerly right-of-way line of said Wild Horse Pass and the point of beginning of the line to be
described; thence South 00 degrees 13 minutes 37 seconds East, a distance of 14.78 feet; thence South 81
degrees 29 minutes 56 seconds East, a distance of 10.92 feet; thence easterly a distance of 75.88 feet, along a
tangential curve concave to the north, having a central angle of 07 degrees 54 minutes 18 seconds and a radius
of 550.00 feet to the east right-of-way line of said Wild Horse Pass and there terminating.
AND
Legal Description (Drainage and Utility Easements):
All drainage and utility easements as delineated and dedicated on THE WILDS SOUTH, according to the
recorded plat thereof, Scott County, Minnesota, lying over, under and across the following described property:

plat thereof, Scott County, Minnesota.
And
Outlots A and B, THE WILDS 5TM ADDITION, according to the recorded plat thereof, Scott County, Minnesota.
4. The vacation of said right-of-way and drainage and utility easements is in the public interest.
5. This vacation is subject to the following condition:
a) The resolution vacating said right-of-way and easements will be recorded with the final plat.
