CONSIDER APPROVAL OF A RESOLUTION DIRECTING STAFF WITH
REGARD TO PROPERTY RESTORATION AT 16318 AND 16328 MAIN
AVENUE
Introduction
The purpose of this agenda is for the City Council to provide direction to City
Staff on how to proceed with restoration at the Minnesota Nails/Joe's Pizza
site.
Historv
The City of Prior Lake owns the Minnesota Nails (16318 Main)/Joe's Pizza
(16328 Main) property adjacent to the VFW. As part of tonight's City Council
meeting the demolition and removal of the existing buildings was considered
as part of Agenda Item 10A.
Current Circumstances
Until redevelopment of this property occurs the City needs to determine what
the property should be used for and what improvements need to be made.
After removal of the buildings the site will be leveled and the portions of the
site that are not paved will have a temporary gravel surface installed. Attached
for reference is a copy of the property survey. There are several questions
related to the interim use of the property that require direction by the City
Council:
1) What is the best interim use ofthe 7,600 s.f. for the property prior
to redevelopment? Staff does not believe leaving the property vacant
is a good use. Undoubtedly without fencing or blockades on the
property it will be used for parking. With that in mind City Staff believes
the best interim use at this time with no pending development
proposals is parking. Staff estimates this site would add up to 19
additional parking stalls. City Ordinances require different levels of
restoration if the property is to be left vacant or used for parking.
2) What issues exist related to use of this property for parking?
Currently the VFW has a trash enclosure located on the property. City
Staff has met with VFW representatives on several occasions to
discuss the enclosure. The location of the enclosure is important to the
VFW due to the kitchen location. Staff agrees that the location is of
benefit to the VFW but has identified the following issues with it
remaining:

The enclosure is located on public property
The existing enclosure is dilapidated and needs to be
reconstructed it will be highly visible once the buildings are
removed.
ISSUES:
As the City Council is aware the VFW is a valuable partner and business in the
City's downtown. The issues related to this property have allowed City Staff
and the VFW to develop a strong line of communication that we believe will
allow the enhanced future partnerships and opportunities.
The following issues have been identified in relation to the existing trash
enclosure:
1) In the interim the enclosure would be located on Public Property.
The City could permit the enclosure to remain via use of a "Private Use
of Public Property Permit". This is an acceptable use to be considered
as part of the permit. Because the property will ultimately be
redeveloped the permit for the enclosure location would need to have
expiration triggers. Allowing the enclosure to remain would remove 2-3
parking stalls from the proposed parking lot depending on the final
parking lot design. The VFW has agreed to provide the City with 2-3
stalls in their parking lot adjacent to the lot for public use to offset the
loss. Staff believes this is a good compromise.
2) The existing enclosure needs to be reconstructed.
The estimated cost of this is $3,000. The VFW would like the City to
pay these costs. The VFW sees this contribution by the City as part of
a larger potential agreement with the City related to public use of the
existing VFW parking lot. They have indicated that if the City is willing
to reconstruct the enclosure the VFW would in good faith work with the
City on an agreement for public access to the existing private lot.
Currently that lot is used by the Public and the VFW believes they have
been a good partner to the public in not enforcing "no parking"
restrictions, but would like to discuss an interim agreement to address
this.
There is no public purpose for the City to pay for enclosure
replacement. The Staff could approach the VFW suggesting that the
City could pay up to % ($1,500) for the replacement of the enclosure if
the VFW provided and additional three parking stalls (total of 5 or 6) for
us by the general public in return for the enclosure area and
construction contribution.
Staff also believes that a larger parking agreement with the VFW in the
future may provide benefit to other downtown businesses and the
public and is therefore worthy of pursuit. Any agreement would be the
first step in of a long term partnership between the City and VFW
which will needed to address future downtown redevelopment.

Staff recommends the following:
1) Direct Staff to prepare a cost/feasibility study for expansion of
downtown parking on the MN Nails/Joe's Pizza Property. This report
should include potential alternatives including expanded parking on
Pleasant Street.
2) Provide staff with direction on the following items related to the VFW
trash enclosure.
a) Is a Private Use of Public Property Permit appropriate for the
trash enclosure appropriate?
b) Is the signing of 5-6 VFW parking stalls for public use
acceptable compensation for location and cost participation in
reconstruction of the enclosure on City Property?
c) Should the City pursue a cooperative agreement related to
future public use of the entire VFW lot?
At this time the only financial impact is staff time related to the feasibility study.
1. Direct Staff to prepare feasibility study for parking on MN Nails/Joe's
Pizza Property.
2. Direct staff to work with the VFW to prepare a Private Use of Public
Property Permit for the trash enclosure and a parking agreement for
the parking stalls to be provided to the City as compensation for the
enclosure location and City participation reconstruction of the
enclosure.
3. Deny this agenda item for a specific reason and provide staff with
direction.
4. Table this item to a certain date in the future
Staff recommends alternatives number 1 and 2.

A RESOLUTION AUTHORIZING COMPLETION OF MN NAILS/JOE'S PIZZA PARKING
LOT FEASIBLlTY STUDY

WHEREAS, On October 6, 2008 the City Council Approved Demolition of the MN Nails (16318
Main Avenue)/Joe's Pizza (16328 Main Avenue) buildings; and
WHEREAS, The best use for the property prior to redevelopment is parking; and
WHEREAS, The City of Prior Lake is committed to providing sufficient parking for the downtown
area; and
WHEREAS, City Staff should complete a feasibility study to identify the potential cost and benefit
of utilizing the property for parking.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. In addition to the Mn Nails/Joe's Pizza property staff shall evaluate options for expanded parking
on Pleasant Avenue.
3. City Staff shall work with the VFW to draft a Private Use of Public Property Permit for the existing
VFW trash enclosure.
4. City Staff shall work with the VFW on a public parking agreement for the VFW parking lot.
