Applications will be reviewed by the Development Review Committee. A member of'
the Planning Staff will notify the Applicant as to any additional information or

or other possible applications as required, may be administratively approved. Site
Plans requiring a variance or other possible applications will automatically be
scheduled for a Planning Commission Public Hearing when it has been verified
that the application is complete. Items will be scheduled before the City
Council, by the City Manager, upon Planning Commission Recommendation.

Ladies and Gentlemen:
We hereby establish our Irrevocable Letter of Credit, numbered as indicated above, and effective
immediately for Lot 1, Block 2, Fountain Hills Addition, in favor of the CITY OF PRIOR LAKE
(the "Beneficiary") at the request and for the ,account of WENSCO, INC. a Minnesota
corporation (the "Developer") in the amount not to exceed FIFTY THREE THOUSAND EIGHT
HUNDRED NINETY ONE AND 00/100 DOLLARS ($53,891.00 U.S.), as such amount is
decreased as provided below, available to you by your sight draft(s) upon us to guarantee the
completion of the Landscape Improvements in connection with that certain Development
Agreement between the Beneficiary and the Developer dated , 2000
for Lot 1, Block 2, Fountain Hills Addition. !
Each draft under this Letter of Credit must be accompanied by:
A. The Original of this Letter of Credit;
B. A notarized statement executed by the Beneficiary stating the Developer has failed to
complete the Landscape Improvements as required under the Developer Agreement
referenced above, the Beneficiary is entitled to draw upon the Letter of Credit, and
certifying the funds obtained herefrom shall be expended towards completion of the
Landscape Improvements.

Each draft under this Letter of Credit must:
1. Be signed on behalf of the Beneficiary by its City Administrator;
2. Bear on its face the clause "DRAWN UNDER LETTER OF CREDIT NO. 5656-600-
LS DATED: June 13,2000.
3. Be presented for payment during regular business hours at our Collection Department,
646 East River Road Suite #1, Anoka, MN 55303 no later than 2PM on June 13,
2001, at which time this Letter of Credit shall expire.
The amount of the Letter of Credit shall reduce by the amount of each drawing the
amount available under this Letter of Credit.
We hereby agree that drafts drawn under and presented in conformity with the terms of
this Letter of Credit will be du1y honored upon presentation.
Facsimile documents on Beneficiary letterhead requesting arnendment( s) to this
Irrevocable Letter of Credit will be accepted as original documentation by BUILDERS
MORTGAGE COMPANY LLC.
Except as otherwise expressly stated, this Letter of Credit is subject to the Uniform
Customs and Practice for Documentary Credits (1983 Revision). This Letter of Credit shall be
deemed to be a contract made under the laws of the State of Minnesota, and as to matters not
governed by Uniform Customs, shall be governed by and construed in accordance with the laws
of the State of Minnesota, including the Uniform Commercial Code as in effect in the State of
Minnesota.
This Letter of Credit is not transferable or assignable and is not issued for the benefit of
any third party claimant.
We shall not be called upon to resolve issues of law or fact between the Beneficiary and
the Developer.

Dear Kelly:
The City of Prior Lake Development Review Committee has completed its review of the
revised plans for the Showroom/Office Building on the property described as Lot 1,
Block 2, Fountain Hills Addition. The following comments and/or changes must be
addressed prior to approval of this site plan:
1. Parking/Loading:
a) The floor area of each use in the building requires a total of 64 parking spaces;
only 63 spaces are shown on the plan.
b) The width of the loading area driveway cannot exceed 36' at the right-of-way
line.
2. Landscaping:
a) A 30" berm is required for screening in front of the parking lot. The berm shown
is approximately 24" in height.
b) A Bufferyard Type "B" is required along the parking lot. While your landscaping
plan identifies the proper number of plantings, these plantings are not arranged
to provide screening. The plan must be revised to provide the screening for the
parking area.
c) Your letter notes the air conditioning units will be located on the side of the
building and screened by landscaping. The location and screening must be
identified on the landscaping plan.
d) An irrigation plan must be submitted.
3. Building Materials:
a) To qualify as a Class I material, stucco must be textured cement st~cco. This
should be noted on the plans.

b) The rear of the building identifies a concrete foundation (14%). Concrete blocks
or panels are a Class III material and cannot make up more than 10% of the
building elevation. If this is decorative concrete, it is allowed.
Items to be included at the building permit stage include plans signed by a registered
engineer and an estimate and letter of credit for the landscaping.
The above items are-relatively simple to correct. Once we have received revised-ptans
addressing these issues, we will approve the site plan. You may then proceed with the
building permit for this site.

Following are the results of the preliminary plan review for the Wensco, Inc.
Office/Showroom. Our review was based on the Minnesota State Building Code (MSBC)
which adopted with amendments the 1997 Uniform Building Code (UBC) with handicap
regulations of the Minnesota Accessibility Code Chapter 1341 and with requirements of
the 1998 Minnesota State Fire Code (MSFC) which adopted with amendments the 1997
Uniform Fire Code (UFC). The comments are numbered as in the December 19, 1999
plan review letter.
1. Submit signed architectural, structural, site, and utility plans.
2. Submit mechanical, plumbing, fire alarm, and sprinkler plans. May be submitted at a
later date.
3. Submit a soils report.
4. Provide the Illumination Budget Calculation Summary, MN Energy Code Part
7670.080.
5. The proposed warehouses have no occupancy separation provisions to store or drive
motorized vehicles into any area. Provide a letter stating that "Motorized vehicles
other than electronically driven, will not be driven or stored in the building."
6. Submit Energy Envelope Calculations.
7. A S.A.C. determination must be completed by the Metropolitan Waste Control
Commission. Contact Jody Edwards at 651.602.1113.
8. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. See
enclosed.
9. Separate tenant finish permits required for each tenant space.
11. At least one ofthe HDCP parking stalls must be a van HDCP parking stall. MSBC
1341.0403 Subpart E subitem 2.
12. Ventilation for the building must meet UBC Chapter 12. Provide 15 CFM of
ventilation air per occupant.
13. Provide fire lanes for fire apparatus response. Signage to read :" No Parking Fire Lane
by order of Fire Department". Locate by Fire Hydrants and by Siamese connection.
UFC 1001.7.1.
14. In-rack sprinklers, early suppression fast response sprinklers or an other approved
system that meets the National Fire Protection Association (NFPA) section 231c is
required for all storage areas where the top ofthe pile storage is over 12 feet above the
floor or grade.
15. Provide fire extinguishers minimum 2A1OBC rated, within 75 feet travel distance of
all areas. UFC 1002.
16. Provide exit signs at exit doors. UBC 1003.2.8.2.
17. Provide a racking and equipment layout.
18. Provide emergency lighting. At the time of rack installation, a final determination will
be made as to the visibility of exit pathways.
20. Provide a recycling space. MSBC 1300.4700.
21. Automatic garage doors to comply with State of Minnesota Statutes. MSBC
1300.5900
23. Lighting Store: The second floor does not meet definition of a mezzanine. UBC 507.
24. Lighting Store: Two exits from second floor office. UBC 1004.2.3.2. One of the exits
must exit into a corridor that provides direct access to an exit. UBC 1004.2.2
Exception 4.
The following are an additional comment:
31. Provide drinking fountains in each tenant unit. UBC Appendix Table 29-A
This is a preliminary review only. Other code items will be addressed when the final
plans are submitted. The building plans must be reviewed by the Cites Developmental
Review Committee (DRC) which consists of representatives of Planning, Engineering,
Parks, Finance, and Building Departments. The DRC must approve the plans before a
building permits can be issued.

Enclosed is a complete set of revised plans for the proposed Showroom/ Warehouse Building located in
Fountain Hills Business Park. We have received comments from staff and feel that all items have been
addressed on the revised plans.
Flooring Center
The proposed building is designed to provide offices and showroom facilities for a flooring center which
provides selections of wood, ceramic, carpeting, vinyl, and a variety of selections for builder clients. The
showroom does not have a retail client base, it is a builder base customer. Hours of operation are Monday
through Friday 8:00 a.m. - 5:00 p.m., Saturdays and evenings by appointment only. The warehouse will
be used to store flooring materials that are scheduled to be installed, with some inventory. Shipments are
received daily and must be off-loaded by fork-lift, No more that four deliveries will be made in one day.
Currently, the company has five full-time employees, and is planning to expand to eight shortly after the
move.
Lighting Center
The proposed building is designed to provide offices and showroom facilities for a lighting design center
for both builder based and retail based customers. Hours of operation are proposed to be 8:00 a,m. _
8:00 p.m. Month - Thursday, Friday and Saturday 9:00 - 5:00 p.m. This will be a start-up company
that will have at least 8 employees initially. The warehouse will be used to store stock light fixtures, bulbs
and accessory items related to the operation. It will also be used to temporarily store selected fixtures that
have been ordered until installation can be scheduled.
Additional Showroom Space
This bay was designed for another showroom/ warehouse type use. We are currently working with a client
that is interested in an appliance showroom however, terms have not been agreed upon. This would again
be primarily builder based, with some retail customers. Hours of operation would be more consistent with
the flooring centers hours. Distribution of the appliances would not be out of this facility. It would only be
an overstock area. The client also has some specialty plumbing related fixtures and custom home wiring.
Design Features
The building meets or exceeds all material requirements on four sides. All access to warehouse for
delivery is off the cul-de-sac, eliminating additional traffic on Fountain Hills Drive for the future. All
mechanical systems will be located within the structure, eliminating roof heating systems that would
require screening. All trash will be enclosed within the warehouse. Each unit will have separate water
services, with one service on the east bay for irrigation of the grounds. Air Conditioning units will be
located alon the side of the building, with landsca in rovided to screen the view. Precise location has
not been determine yet.

The Planning and Building Inspections staff have reviewed the proposed material
samples for the proposed office/showroom building in Fountain Hills. We have
concluded, based on the City of Prior Lake Zoning Ordinance, these materials are
considered Class II materials.
The Zoning Ordinance requires a minimum of 60% of each building face visible from off-
site must be constructed with Class I materials, which include brick, marble, granite or
other natural stone, textured cement stucco, copper, porcelain and glass. I have

your information.

development in the City to meet certain minimum architectural design standards.
Through a comprehensive review of both functional and aesthetic aspects of new
or intensified developments, the City needs to accomplish all of the following
objectives:

Preserve the character of residential neighborhoods and the City's
commercial and industrial areas;
Maintain and improve the City tax base;
Reduce the impacts of dissimilar land uses;
Promote orderly and safe flow of vehicular and pedestrian traffic;
Discourage the development of identical and similar building facades
which detract from the character and appearance of the neighborhood;
Preserve the natural and built environment; and
Minimize adverse impacts on adjacent properties from buildings which
are or may become unsightly.

1107.2202 Standards. The provisions in subsection 1107.2202 apply to commercial,
industrial, multi-family residential (projects of 3 or more dwelling units per
building), public and institutional uses.
(1) The visual impact of rooftop equipment shall be minimized using one of the
following methods:
~ A parapet wall.
~ A fence or screen, the height of which extends at least 1 foot above the
top of the rooftop equipment and incorporates the architectural features
of the building.
~ The rooftop equipment shall be painted to match the roof facing material
of building.
(2) The development must locate the noise-producing portions of the development,
such as loading docks, outside storage and outside activity away from adjacent
residential areas.

All outside storage areas shall be screened to minimize off-site views using a
bufferyard type "C" or greater, as defined by Section 1107.2005.
(4)
Utility service structures such as utility meters, utility lines, transformers, above
ground tanks, refuse handling, loading docks, maintenance structures, and other
ancillary equipment must be inside a building or be entirely screened from off-
site views.
(5)
All utility services shall be under ground except as provided elsewhere in this
Ordinance.
(6)
Exterior surface materials of buildings shall be subject to the following
regulations:
a. Classes of Materials: For the purpose of this subsection, materials shall
be divided into Class I, Class II and Class III categories as follows:
Class I: Brick, marble, granite or other natural stone, textured cement stucco,
copper, porcelain, and glass are Class I exterior building materials on buildings
other than those used as dwellings which contain 4 or fewer dwelling units.
Wood or vinyl siding and prefinished metal are Class I materials on residential
buildings containing four or fewer dwelling units in addition to the other Class I
materials listed in this subsection.
Class II: Exposed aggregate concrete panels, burnished concrete block, integral
colored split face (rock face) and exposed aggregate concrete block, cast-in-
place concrete, artificial stucco (such as EIPS), artificial stone, prefinished metal.
Class III: Unpainted or surface painted concrete block (scored or unscored),
unpainted or surface painted plain or ribbed concrete panels, and unfinished or
surface painted metal.
b. Minimum Use of Class I Materials Required. At least 60% of each
building face visible from off-site must be constructed with Class I materials
except as permitted by subsection 1107.2202(6,c) below. Not more than 10% of
each building face visible from off-site may be of Class III materials. Portions of
buildings not visible from off the site may be constructed of greater percentages
of Class II or Class III materials if the structure otherwise conforms to all City
Ordinances. The mixture of building materials must be compatibly integrated.
c. Buildings in the General Industrial Use District: Class I materials may
be reduced to a minimum of 25% for buildings in the 1-1 Use District which are
not located on a principal arterial, minor arterial, major collector, or adjacent to or
across from any "R" Use District, provided that the remaining materials are
functionally and durably equal to a Class I material as certified by the developer's
architect or the manufacturer.

~ The number of required plants shall be increased by 20% or the size of
20% of the overstory trees installed shall be increased to 3 1/2 caliper
inches.
~ A minimum of 10% of the building facade'must be windows or glass
spandrels.
(7) In addition to the minimum criteria, the following additional architectural design
elements may be considered in determining whether to permit the reduced use
of Class I materials: building bulk, general massing, roof treatment, proportion of
openings, facade design elements and variation, fenestration, compatibility of
materials, color, and texture. Site plan design elements which will be considered
in determining whether to reduce the Class I building material requirement
include quantity, quality, variation, compatibility, and size of plant materials,
landscape berms and screening walls. Also considered will be the overall
harmony and unity of the various elements of the architectural design and site
plan within the site and also within the larger context of the area or corridor.
Generally, buildings of lower height, lesser bulk, pitched or gabled roofs,
variations in facade, and numerous fenestrations and openings will be
considered eligible for a reduction in the use of Class I materials. Generally, site
plans with increased amount, variation and size of landscape materials and
higher landscape berms and screening walls will be considered eligible for Class
I material reduction.

(8) Building design shall be consistent with the following requirements:
a. The height, bulk, general massing, roof treatment, materials, colors,
textures, major divisions, and proportions of a new or remodeled building shall
be compatible in design style and character with that of other buildings on the
site and on adjacent sites.
b. No unbroken building wall may exceed a 4:1 ratio of wall length to wall
height, and each building wall deviation at the 4: 1 ratio shall be a minimum depth
of 4 feet; where a maximum 3:1 wall length to wall height ratio is used, the
minimum depth of each building wall deviation may be reduced to 3 feet; where a
maximum 2:1 wall length to wall height ratio is used, the minimum depth of each
building wall deviation may be reduced to 2 feet.
c. No building may display more than 5% of any elevation surface in bright,
pure accent colors.
d. Design review shall be done by the Planning Department.
e. The site lighting shall provide adequate light for the safety and welfare of
persons using the site but shall not present a nuisance or hazard and shall
otherwise comply with Section 1107.1800.

f. For projects within all Use Districts where the lot area exceeds 50,000
square feet, at least 1 % of the lot area shall be devoted to pedestrian use such
as plazas or walks.
g. New additions, alterations, or accessory buildings: The exterior wall
surface materials, roof treatment, colors, textures, major divisions, proportion,
rhythm of openings, and general architectural character, including horizontal or
vertical emphasis, scale, stylistic features of additions, exterior alterations, and
new accessory buildings shall conform to the original architectural design and
general appearance of the principal building(s) on the site and shall comply with
the requirements of this subsection.
h. The relationship of the building to the site and adjacent property,
including site access and pedestrian movement shall be complementary.
i. In any instance where the Zoning Administrator denies a permit or a
request for preliminary approval of building materials or building design, the
applicant may submit an appeal of the interpretation, based upon the plans and
other papers on file in the office of the Zoning Administrator, to the Board of
Adjustment without payment of additional filing fees of any kind. Appeals shall
be considered according to the procedure outlined in Section 1109.300.
1107.2203 Architectural Standards Applying to One and Two Family Residential Uses.
Individuals, builders or groups of builders shall not construct a house design
which has identical front elevations to any house or proposed house where a
building permit has been issued with the following exceptions:
a. Identical front elevations may be allowed on no more than 25% of platted
lots within a block. However, identical front elevations shall not be allowed on
adjacent lots or in cul-de-sac turnarounds.
b. The provisions of this subsection apply to Planned Unit Developments
and Conditional Use Permits, but may be modified with the consent of the City
Council.
c. To determine compliance with this subsection, the Zoning Administrator
may require the permit applicant to submit exterior elevations of the proposed
structure, and photographs of the front exterior of neighboring houses, in
addition to all required materials for a building permit application listed in
subsection 1109.501. A list of exterior finish materials and colors may also be
required.
1107.2300: NON-CONFORMITIES. Nothing in this subsection shall be construed to permit a
violation of any section of the Prior Lake Code or the continuation of any unsafe
or unsanitary condition.

1. Extend road, trail, storm sewer, and utilities to end of plat (west property line).
Address drainage issues. The NURP pond proposed in the future phase may have to
be constructed.
2. Concrete driveway aprons are required on commercial driveways, per City's standard
plate no. 508. The maximum driveway width at the right-of-way line is 36 feet per
zoning ordinance 1107.205(7).
3. Can trucks make the turn into the loading dock area. Reconfigure the loading dock
area to provide a turn around or drive through area to eliminate trucks backing into
Fountain Hills Court.
4. Move the sewer and water services to the north in the parking lot area and away from
the building.
5. Either provide 4 services/4 meters to each unit in the building or one service/one
meter to the entire building.
6. Tap into the water main in Fountain Hills Court at the driveway location instead of at
the existing hydrant.

Following are the results of the preliminary plan review for the Wensco, Inc. Office/Showroom.
Our review was based on the Minnesota State Building Code (MSBC) which adopted with
amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341 and with requirements of the 1998 Minnesota State
Fire Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC).
1. Submit signed architectural, structural, site, and utility plans.
2. Submit mechanical, plumbing, fire alarm, and sprinkler plans. May be submitted at a
later date.
3. Submit a soils report.
4. Provide the Illumination Budget Calculation Summary, MN Energy Code Part
7670.080.
5. The proposed warehouses have no occupancy separation provisions to store or drive
motorized vehicles into any area. Provide a letter stating that "Motorized vehicles
other than electronically driven, will not be driven or stored in the building."
6. Submit Energy Envelope Calculations.
7. A S.A.C. determination must be completed by the Metropolitan Waste Control
Commission. Contact Jody Edwards at 651.602.1113.

(DRC) received an application for a conditional use permit for the property

application, we determined a conditional use permit is not required for this use.

I am returning your application for a conditional use permit. The site plan
application fee is $300.00. Unfortunately, we have already deposited the
