RESOLUTION PROVIDING FOR THE VACATION OF A PORTION
OF THE ROAD EASEMENT LOCATED ON
LOTS 1-4, BLOCK 4, KNOB HILL 2ND ADDITION

WHEREAS, on September 20, 1999, the City Council adopted Resolution 99-94 initiating the
vacation of a portion of the 16.5 roadway easement for Pike Lake Trail located on the
following described property situated in the City of Prior Lake, Scott County,
Minnesota to wit: Lots 1-4, Block 4, Knob Hill 2nd Addition; and
WHEREAS, notice of the hearing on said petition has been duly published and posted in
accordance with the applicable Minnesota Statutes, and
WHEREAS, Public Hearing was held on said petition on Monday, November 1,1999, at 7:30 p.m.
in the Council Chambers at the Prior Lake Fire Station #1 ; and
WHEREAS, the City Council then proceeded to hear all persons interested in said petition and
persons interested afforded the opportunity to present their views and objections to
the granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the vacation of said easement
would be in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that pursuant to
Minnesota Statues 412.851, the following described portion of the roadway easement situated
on the above described property in the City of Prior Lake, Scott County, Minnesota is hereby
vacated:
Legal Description: That portion of the 16.5 foot roadway easement for Pike Lake Trail located
on the west boundary of Lots 1-4, Block 4, Knob Hill 2nd Addition, described as follows: the
easterly 6.5 feet of said easement except the northerly 178.85 feet and the southerly 10 feet
thereof.
Passed and adopted this 1 st day of November, 1999.

RESOLUTION INITIATING THE VACATiON OF A PORTION OF THE ROAD EASEMENT
ADJACENT TO LOTS 1-4, BLOCK 4, KNOB HILL 2ND ADDITION

WHEREAS, the original right-of-way for Pike Lake Trail was dedicated by easement; and
WHEREAS, the final plat of Knob Hill 2nd Addition dedicated new right-of-way for Pike Lake Trail
in a different location, and
WHEREAS, the existing road easement remains on Lots 1-4, Block 4, Knob Hill 2nd Addition; and
WHEREAS, in order to determine whether the vacation of this easement is or is not in the public
interest, the City Council has initiated the vacation process by motion.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that pursuant
to Minnesota Statues 412.851, the process for the vacation of a portion of the roadway

History: The right-of-way for Pike Lake Trail was originally
dedicated as an easement. In 1997, when Knob Hill 2nd Addition was
platted and Pike Lake Trail was improved, the road was realigned to
the east of the original easement. The plat of Knob Hill 2nd Addition
identifies a 16.5' roadway easement along the rear lot line of Lots 1-4,
Block 4. Ten feet of the existing easement is necessary for drainage
and utility purposes; however, 6.5' of the easement is no longer
necessary. On September 20, 1999, the City Council initiated the
vacation of this portion of the easement.
Current Circumstances: The Planning Commission reviewed this
vacation request on October 11, 1999. The Planning Commission
recommended approval of the proposed vacation. The Planning
Commission determined there is not a public need for the easterly 6.5
feet of the road easement.
The Issues: Minnesota Statutes 412.851 allows the Council to vacate
easements or right-of-way by resolution. The statute states that "no
such vacation shall be made unless it appears to be in the public
interest to do so". The intent ofthe Comprehensive Plan was satisfied
by the dedication ofthe right-of-way in Knob Hill 2nd Addition.
Furthermore, the City does not require the entire 16.5' for drainage and
utility purposes. A 10' wide easement is adequate for this need.
Conclusion: The staff recommends approval of this vacation.
The City Council has three alternatives:
1. Adopt Resolution 99-XX approving the vacation.
2. Deny Resolution 99-XX.
3. Defer this item and provide staffwith specific direction.

The City obtained an easement for Pike Lake Trail across the property prior to the
platting of Knob Hill 2nd Addition. In 1997, when Knob Hill 2nd Addition was platted
and Pike Lake Trail was improved, the road was realigned to the east of the original
easement. The 16.5' easement, however, remains along the westerly lot line of Lots 1-4,
Block 4, Knob Hill 2nd Addition.

INTRODUCTION
In 19----, the City obtained an easement for Pike Lake Trail across the property
that is now platted as Knob Hill 2nd Addition. In 1997, when Knob Hill 2nd
Addition was platted and Pike Lake Trail was improved, the road was realigned
to the east of the original easement. The 16.5' easement, however, remains
along the westerly lot line of Lots 1-4, Block 4, Knob Hill 2nd Addition.
As required by State Statute 462.356 Subd.2, the Planning Commission is
required to make a recommendation to the City Council regarding the disposal or
acquisition of public lands as it relates to the compliance with the
Comprehensive Plan.
Upon proper notification, State Statute 412.851 allows the Council to vacate
easement or right-of-way by resolution. The statute also states that "no such
vacation shall be made unless it appears to be in the public interest to do so".
DISCUSSION
The Planning Commission must make two determinations. Does the vacation of
the existing easement comply with the Comprehensive Plan and is there a public
need or anticipated future need for the dedicated property?
Comprehensive Plan Review
The Comprehensive Plan has identified the need for the extension of Pike Lake
Trail. The right-of-way was dedicated for this section of Pike Lake Trail with the
final plat of Knob Hill 2nd Addition, and the road was completed in 1997. It is
unlikely that the road will be relocated to the original easement.
Public Need

RECOMMENDATION

ALTERNATIVES:
1. Recommend the City Council approve the proposed vacation of the
easement as presented or with changes recommended by the
Commission.
2. Continue the discussion to a date and time certain to allow the staff to
provide additional information specifically requested by the Planning
Commission.
3. Based upon expressed findings of fact, recommend the City Council deny
part or all of the applications based upon inconsistency of the proposal
with specific regulations of the Zoning and Subdivision Ordinances and/or
specific policies of the Comprehensive Plan.
RECOMMENDATION:
Alternative #1 .

Public Hearing to Consider Approval of Resolution 99-XX Ordering the 2000 Improvement Projects
and Preparation of Plans and Specifications Therefore.
PACE: Noted that the public hearing was scheduled for 7:45p.m. and since it was not yet that time,
it would be appropriate to defer the hearing until 7:45 p.m.
The item was deferred until 7:45p.m. (following Item 88).
BOYLES: Gave an overview of the project approval process for the 2000 improvement projects.
Further noted the process in place to this point, and the proposed reconstruction projects for Area
1 (Oakridge Circle-Flandrau Circle-Indian Ridge Circle-Fulbright Circle-Euclid Avenue-Maves Trail-
Forsythe Road); Area 2 (Shannon Trail-Shannon Circle-Prior Circle); Area 3 (Fairlawn Shores Trail
from 150th to Fish Point Road); Area 4 (Fish Point Road from Glory Circle to Cty. Road 44); and
Area 5 (a petitioned improvement project for Linden Circle).
McDERMOTT: Provided additional details for the proposed projects for Areas 1 through 4, including
costs and proposed assessments.
WUELLNER: Asked if Shannon Trail currently had concrete curb and gutter, and if the road had
exceeded its useful life.
McDERMOTT: The Shannon Trail project area does not currently have concrete curb and gutter but
rather a bituminous roll curb, and it is not unusual that the 17 -year old road has exceeded its
useful life and needs replacement. Likewise with Area 1, except that we would attempt to use the
existing storm sewer system although there are some drainage problems.
SCHENCK: Why are the costs so much lower? And when would construction begin for the Fish
Point Road project?

History: The right-of-way for Pike Lake Trail was originally
dedicated as an easement. In 1997, when Knob Hill 2nd Addition was
platted and Pike Lake Trail was improved, the road was realigned to
the east of the original easement. Four lots in Knob Hill 2nd Addition
were platted between the new right-of-way and the easement.
Current Circumstances: The plat of Knob Hill 2nd Addition
identifies a 16.5' roadway easement along the rear lot line of Lots 1-4,
Block 4. Ten feet of the existing easement is necessary for drainage
and utility purposes; however, 6.5' of the easement is no longer
necessary. We recently received a building permit application for a
garage on one ofthese lots. Ordinarily, a garage may be located 10'
from a rear lot line. In this case, the existing easement requires the
garage be set back 16.5' from the rear lot line.
The Issues: Minnesota Statutes 412.851 allows the Council to initiate
by motion the vacation of any easements or right-of-way. A motion to
initiate the vacation will refer this matter to the Planning Commission
and allow the staffto schedule a public hearing at the City Council. In
addition, this action will eliminate the need for the property owners to
file a petition and pay the application fee.
Conclusion: The staff recommends the City Council initiate the
vacation of this easement. Any issues or need for the easement will be
identified during the review process.
The City Council has three alternatives:
1. Adopt Resolution 99- XX initiating the vacation of a portion of the
road easement adjacent to Lots 1-4, Block 4, Knob Hill 2nd
Addition.

EASEMENT ADJACENT TO LOTS 1-4, BLOCK 4, KNOB IllLL 2ND ADDITION

WHEREAS, the original right-of-way for Pike Lake Trail was dedicated by easement; and
WHEREAS, the final plat of Knob Hill 2nd Addition dedicated new right-of-way for Pike
Lake Trail in a different location, and
WHEREAS, the existing road easement remains on Lots 1-4, Block 4, Knob Hill 2nd
Addition; and
WHEREAS, in order to determine whether the vacation of this easement is or is not in the
public interest, the City Council has initiated the vacation process by motion.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
that pursuant to Minnesota Statues 412.851, the process for the vacation of a portion of the
roadway easement adjacent to Lots 1-4, Block 4, Knob Hill 2nd Addition, is hereby
initiated.
