HomeMy WebLinkAbout5E - Police Mutual Aid J MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT AUGUST 4, 2003 5E BILL O'ROURKE, CHIEF OF POLICE CONSIDER APPROVAL OF A RESOLUTION APPROVING A REVISION TO THE MUTUAL AID AGREEMENT FOR POLICE SERVICES WITH SCOTT COUNTY AND OTHER SCOTT COUNTY COMMUNITIES. Historv: Mutual Aid Agreements are made pursuant to Minnesota Statutes 471.59 which authorizes the joint and cooperative exercise of powers common to contracting powers. The intent of such an agreement is to make equipment, personnel and other resources available to political subdivisions from other political subdivisions. Typically, this resource sharing takes place as a result of a major crime, accident or natural disaster. The Mutual Aid Agreement for Police Services with Scott County and other Scott County communities was most recently updated in November 2002. Current Circumstances: Section ill, 2d of the agreement as approved in November 2002 states that, "No charges shall be levied by a Responding Party for assistance rendered to a Requesting Party under the terms of this Agreement." The Scott County Director of Emergency Management has advised us that a change is necessary to meet FEMA guidelines for reimbursement. Once the 48 hour threshold has been reached, a Responding Party shall submit an itemized invoice to the Requesting Party for the actual cost of any assistance provided after the initial 48 hour period. This change will allow the cities and county to be reimbursed by the Federal Emergency Management Agency (FEMA). There are two typographical errors that are corrected in the amendment to the Law enforcement Mutual Aid Pact. (1) Adopt the Resolution approving the original agreement and the first amendment to the Law Enforcement Mutual Aid Agreement. (2) Deny approval d direct further action. L:\ADMIN\AGRPTFM.DOCKirsten Oden RESOLUTION 03-XX ~INNESO~~ SOLUTION APPROVING A MUTUAL AID AGREEMENT FOR POLICE SERVICES WITH SCOTT COUNTY AND OTHER SCOTT COUNTY COMMUNITIES INCLUDING AMENDMENTS THERETO MOTION BY: SECOND BY: WHEREAS, Minnesota Statutes 471.59 authorizes joint and cooperative exercise of powers common to contracting powers, and WHEREAS, Pursuant to Minnesota Statutes 471.55 the Cities of Shakopee, Jordon, Belle Plaine, New Prague, Prior Lake, Elko, Savage and Scott County entered into a joint and cooperative agreement in November 2002 commonly referred to a "Law Enforcement Mutual Aid Pact"; and WHEREAS, The Law Enforcement Mutual Aid Pact requires technical corrections and other revisions in order that member Parties may continue to be eligible to receive Federal Management Agency funding assistance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1) The City Council reaffirms its approval of that certain agreement referred to as the Law Enforcement Mutual Aid Pact originally approved in November 2002. 2) The First Amendment to the Law Enforcement Mutual Aid Pact is hereby approved. 3) The Mayor, City Manager and Police Chief are hereby authorized to execute the First Amendment to the Law Enforcement Mutual Aid Pact.
