(on the north side of the }JJ.vjX>J.~j), a 24' 1akeshore variance from the 75' lakeshore setback reqk.:.J..L.Lfnt, a
5' front yard variance huJ.lJ. the 25' front yard setback requirement, and a .4% impervious swface variance
L.UJ.lJ. the 30% impervious surface maximum.
Associate City Planner, Gina Mitchell, presented the infonnation as per planning report dated June 2, 1994.
1be subject site was part of an adJ:ninbL.aL.ve land division which was appJ.vied with a lot area variance in
Decemrer of 1991. The amended variance requests are consistent with previous actions of the Planning
CvuJL,u;ssion for lakeshore lots in the subdivision of Breezy Point, observe the character of the area, and if
all required setbacks were applied, the lot would be unbuildable.
Cy Schweich, 15305 Breezy Point Road NE, Lot 16, expressed concem about loss of trees and would have
lik~ to have seen the location of the trees indicated on the sUlVey.
Doug Thielbar, 15329 Breezy Point Road, Lots 12 & 13, t:.Al-IJ.c.ssed concem that construction equipment

line. MI: Thielbar questioned whether there is any guarantee that his trees will not be damaged. Planner
Grnser stated that this is a civil JThJ.l.:,J. and not one for the Planning Depcu.L.l.Ient to become involved with.
CU1Uu..issioner Raseth cvu-'!llimented the develvp:... and neighbors for meeting together to settle their
differences before this meeting and requested that hardwood trees of significant size be replaced. MI:
Halek stated that he planned to replace any significant removed trees with pine trees and will be sensitive to
the tree issue within the confines of the building envelope.

Marty Hanson, 3068 170th Street SW, addressed the Commission regarding his request for a 14' x 24' deck,
and discussed what he believed to be a discrepancy in the distance of the .1J~v.l:'vSed deck addition to the
c.:.u;.;...Iine of County Road 12 that was ~':'.1J~..sented on the StUVey.
~ City Planner, Gina Mitchell, presented the information as per planning report dated June 2, 1994.
The request is for a 40.5' County Road 12 setback variance L.vm the 85' County Road setback requirement
The subject site is a substandard lot and was platted under the jurisdiction of Spring Lake Township. The
majority of the construction that has 0CCUIIed in this area was done before the 85' county road setback
reqk.:..u.JClt was incorporated into the Zoning Ordinance in 1989, resulting in many structtlres encroaching
that setback requ.;,.,.:.u~t Ms. Mitchell stated that staff recvu.w..a:.uds a reduction in the variance request
llVUol 40.5' to 36', which would result in a 10' x 24' deck. The property would maintain a 25' front yard,
consistent with other .1J~V~~es in the R-1, Subutban Residential Zone. Cvuau:,uL.") from Brad Larson, Scott
