Prior Lake State Bank hereby establishes an Irrevocable Letter of
credit in the amount of Twelve Thousand Eight Hundred Fifteen and
00/100 ($l2,B15.00) U.S. Dollars in your favor for the period
beginning May 9, 2000, and expiring May 9, 2002, for the account of
H & S Investments, LLC.
This credit shall be available against your draft at sight on us
accompanied by the original Letter of Credit.
This Letter of Credit sets forth in full terms of our undertaking.
Such undertaking shall not in any way be modified, amended or
amplified by reference to any document, instrument or agreement
referred to herein or in which the Letter of Credit is referred to
or to which this Letter of Credit relates. Any such reference
shall not be amended to incorporate herein by reference any
document, instrument or agreement.
Your draft so drawn must bear this clause: "Drawn under Prior Lake

Dear Mr. Horkey:
This letter serves as the official notice of approval of the site plan for the addition to the
Keyland Homes Building at 17021 Fish Point Road. Attached is an approved set of
plans for your files.
You may now proceed with your building permit application. Before we will issue a
building permit, you must submit a letter of credit (LOC) for the required landscaping on
the site. This LOC must equal 125% of the estimated construction cost of the
landscaping, including plants, mulching and edging. Since you will not be using an
irrigation system. the LOC must be good for at least two years following the acceptance
of the landscaping.

RE: Recording of Approved Variance and Assent Form Acknowledgment
Dear Mr. Horkey:
The purpose of this letter is to advise you that Resolution 00-016 approving a
variance on the property located at 17021 Fish Point Road SE must be reoorded
at Scott County. A building permit wll not be issued until proof of recording has
been submitted to the Planning Department. The variance will be null and void
per Section 1106 of the City Code within one year If the project Is not completed
or if constructlon has not commenced (Assent Fonn).
Enclosed is a certified copy of the original Resolution to be reoordec:l at the Scott
County Recorders office. The other copy Is to be stamped 88 recorded by the
recorders office and returned to the Planning Department as proof of recording.
Also included Is a copy for your records.
Additionally, the enclosed Assent Form must be signed by ell property owners
and retumed to the Planning Oepartment prior to the issuance of any necessary
pemlits.
The site plan you submitted also requires some modification before we can issue
final approval. These modifications are as follows:
1. The par1<lng lot along the east (rear) lot line must be. at least 10' from the lot
line.
2. The trash enclosure must be located at least 3D' from the east (rear) property
line.

3. Landscaptng Requirements:
. A bufferyard type "E" is required on the south side of the building.
. The number of plantlngs are based on a 20' wide bufferyard for the length
of the new portion of the building to the east lot line. However. these
plantings may be located along the entire south properly line.
. The butreryard must indude at least 10 canopy trees, 20 understory trees
and 30 shrubs.
. Acceptable species are shown on the attached list. The species and size
of the new plantlngs must be shown on the landscaping plan.
. The landscaping plan must be signed by a registered landscape architect.
4. The comments outlined In the attached memorandum from Sue McDermott.
Assistant City engineer. must also be addressed. Please work with the
Engineer1ng Department on this matter.
Please submit the reoo~ resolution. the signed assent form and revised plans
to the Planning Department. Once all of the revisions have been made. we will
approve the site plan. You may then proceed with your building pennit
application. Please WOt1< wfth Bob Hutchins, BUilding Official. to ensure all
Building Code requirements have been met

Dear Mr. Horkey:
The City of Prior Lake has reviewed the plans submitted for the addition to the
existing building at 17021 Fish Point Road. Attached to this letter is a
memorandum from Sue McDermott, Assistant City Engineer, detailing additional
information that must be submitted before we can complete this review. Also
attached is a memorandum from Bob Hutchins, Building Official, detailing issues
pertaining to the Building Code.
The Planning staff has also identified the following additions or changes to the
plans:
. Section 1102.1406 of the Zoning Ordinance requires a 75' setback for all
structures abutting a "R" Residential Use district. This requires a 75' setback
from the south property boundary.
. Section 1107.2003 requires a Bufferyard Type "E" along the south property
boundary. A landscaping plan, prepared and signed by a registered
landscape architect, identifying the required landscaping on this site must be
submitted.
. Will there be roof-top mechanical equipment? If so, a plan identifying how
this equipment will be screened is required.
. Prior to the issuance of a building permit, a survey of the entire site showing
existing and proposed structures and prepared by a registered land surveyor
is required.
For your information, I am attaching a variance application to this letter. This
application also includes information on the necessary submittals and the
process for a variance.

Following are the results of the preliminary plan review for the Keyland Homes 2000 Addition.
Our review was based on the Minnesota State Building Code (MSBC) which adopted with
amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341 and with requirements of the 1998 Minnesota State
Fire Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC).
1, Submit mechanical, plumbing and sprinkler plans. May be submitted at a later date.
2. A structural engineer must provide engineered drawings of the above grade structure.
3, Submit a soils report.
4. Provide the Illumination Budget Calculation Summary, MN Energy Code Part
7670.080.
5. Sheet A-I: Recalculate allowable area. With addition ofthe offices to the mezzanine,
the building changed from a single story into a two story building.
6. Submit Energy Envelope Calculations.
7. A S,A.C, determination must be completed by the Metropolitan Waste Control
Commission. Contact Jody Edwards at 651.602.1113.
8. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. See
enclosed.
9. Detai12/A2: Provide cutsheet of water closet to maintain front clearance. MSBC
1341.0448 subpart 2.
10. Provide 3 HDCP onsite parking stalls, MSBC 1341.0403 Item E.
11. DetaiI2/A2: 18" required on latch side of door 100. MSBC 1341.0442 subpart 6.
12. Provide an engineered dust collection system for the shop area. UBC 306.8
13. Ventilation for the building must meet UBC Chapter 12. Provide 15 CFM of
ventilation air per occupant.
14. In-rack sprinklers, early suppression fast response sprinklers or an other approved
system that meets the National Fire Protection Association (NFP A) section 231c is
required for all storage areas where the top of the pile storage is over 12 feet above the
floor or grade.
15. Provide fire extinguishers minimum 2AIOBC rated, within 75 feet travel distance of
all areas. UFC 1002.
16. Provide exit signs at exit doors. UBC 1003.2.8.2.
17. Provide a racking and equipment layout.
18. Provide emergency lighting in the addition. At the time of rack installation, a final
determination will be made as to the visibility of exit pathways.
19. Provide fire lanes for fire apparatus response. Signage to read :" No Parking Fire Lane
by order of Fire Department". Locate by Fire Hydrant and by Siamese connection.
UFC 1001.7.1.
20. The proposed addition and existing building have no occupancy separation provisions
to store or drive motorized vehicles into any area. Provide a letter stating that
"Motorized vehicles other than electronically driven, will not be driven or stored in
the building"
This is a preliminary review only. Other code items will be addressed when the final
plans are submitted. The building plans must be reviewed by the Cites Developmental
Review Committee (DRC) which consists of representatives of Planning, Engineering,
Parks, Finance, and Building Departments. The DRC must approve the plans before a
building permits can be issued.
