Dear Applicants:
Upon reviewing your vacation request, the issue of ownership of the property to be vacated has
arisen. The property you are requesting to vacate is shown on the original plat as a county road.
Neither the city nor the county has any record of the county turning the road back to the city.
This was verified verbally by Assistant County Engineer, Greg Ilkka, on January 3, 2000.
Therefore, we are closing your file, as the city has no right to vacate the right-of-way. We are in
the process of issuing you a refund of the application fees paid. These will be mailed after City
Council approval on January 18,2000. If you would like to continue with the vacation, you must
contact Scott County.

RE: City of Prior Lake Review for Application Completeness for Vacation Application
Dear Applicants:
On November 23, 1999, the City of Prior Lake Planning Department received a vacation
application from you. On November 29, 1999, additional informaiton was submitted as
requested. The Planning Department has determined that this application is complete and will
begin formal review. We will notify you of any pertinent issues, which may arise as a result of
your internal review and preparation of our staff report.
We have scheduled your request to be heard by the Planning Commission on January 10, 1999.
The meeting begins at 6:30 p.m. and is located at the Fire Station on County Road 21 and Fish
Point Road. You or you representative is expected to be in attendance. If you cannot make the
meeting, please let me know. You will be receiving a copy of the public notice and a copy of the
staff report with recommendation prior to the meeting. We have also tentatively scheduled the
City Council to hear this request on February 7, 1999.
The City approval process can be substantially less than 120 days, and we intend to move this
matter through the process in a timely manner which provides a complete, professional review.
Occasionally, however, due to meeting schedules, it is sometimes necessary to extend the 60 day
review period. This letter also serves as your official notice that the City is extending the 60 day
deadline for an additional 60 days from January 27, 2000 to March 29,2000.

LIST OF REASONS FOR VACATION OF DISCRIBED PROBERTY
1. There is no reasonable public use of the property to be vacated.
2. The remaining portion of the plated main street that will be sufficient for any existing
or future utilities.
3. We have worked with the City of Prior Lake's Engineering Department to ensure that
the public's present and future interests will be retained.
4. Each front yard set back would come into compliance with current zoning standards.
5. The area subject to vacation has been maintained by the current applicants.
6. The portion of the plated main street to be vacated does not extend to the west.

RE: Street Vacation of Main Street
Dear Ms. Tovar:
With reference to the proposed street vacation mentioned above, Reliant Energy
Minnegasco does have an existing natural gas main in that portion of Main
Street proposed to be vacated.
Since this gas main is an important part of our distribution system for this area
we must object to this proposed vacation unless suitable easement rights are
reserved to Reliant Energy Minnegasco, pursuant to MSA 160.29.
Please reserve an easement to Reliant Energy Minnegasco, created by and
within the document establishing the street vacation and filed with the
Scott County Recorders office, over the following area of the proposed
street vacation:
All of the north 30 feet of Main Street lying southerly of and adjacent to
Lots 2, 3, & 4, Borgerding Addition, according to the plat thereof on file
and of record in the Office of the Register of Deeds in and for said Scott
County.
We may consider removing our objection should the petitioner wish to reimburse
Reliant Energy Minnegasco the cost of relocating the existing gas main. To
discuss this and any other options that may be available please have the
petitioner contact Rick Pilon, Senior Administration Engineer, at 612-321-5426.

on this proposal.
