Applications will be reviewed by the Development Review Committee. A member of'
the Planning Staff will notify the Applicant as to any additional. information or
modifications needed. Site Plans, which are non-residential, and have no variance
or other possible applications as required, may be administratively approved. Site
Plans requiring a variance or other possible applications will automatically be
scheduled for a Planning Commission Public Hearing when it has been verified
that the application is complete. Items will be scheduled before the City
Council, by the City Manager, upon Planning Commission Recommendation.

Following are the results ofthe plan review for the Prior Lake MiniStorage. Our review
was based on the Minnesota State Building Code (MSBC) which adopted with
amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341 and with requirements of the 1998
Minnesota State Fire Code (MSFC) which adopted with amendments the 1997 Uniform
Fire Code (UFC). The comment is numbered as in the December 14, 1999 plan review
letter.
3.. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5.
The applicant has meet all conditions of the site review. After the above item is received,
the Building Department will be able to sign off on the building permit. The Engineering
Department has signed off on the building permit. The Building Department is awaiting
the Planning Department site review and permit sign off.

THIS AGREEMENT, Made this 4th day of November, 1993, by and
between JOHANNA BANG, a widow not now remarried, and GARY'J. THOMAS
and ANNETTE M. THOMAS, husband and wife as joint tenants, all being
fee owners of parcels of real estate being served by a common private
roadway and right of way, and wishing to enter into a maintenance
agreement for the upkeep of said private roadway and right of way, do

the cost of grading the roadway and for removal of snow.
That Gary J. Thomas and Annette M. Thomas, husband and wife,
their successors, heirs and assigns, shall pay the cost of gravel and
rock as Johanna Bang deems necessary.
That both parti.es bCT.::;tu shall each pay one-half (1/2) of the
cost of salt and/or sand if deemed necessary.
That any improvements or upgrades to the road surface must be
unanimouf=;ly .:>greeci ~~p0r. =~; both parties.
The owners, their ht:lrs and assigns, agree that. t.he maiTIten~!'\ce
set forth above shall constitute an improvement to their property and
payment for same may be enforced as a mechanic's lien in accordance
with Minnesota Statue without the requirement of pre-lien notice,
however, no major improvement beyond gravel and/or rock, to maintain
the surface, and snow removal and applications of salt and/or sand
shall be undertaken without the expressed, written agreement of the
owners of record.
That this agreement and easement shall be appurtenant to and

Dear John,
The following are items to be addressed prior to Site Plan approval and application for a building
permit:
Zoning Issues
I. Need 6' solid wall or fence around outdoor storage area. Need to relocate some of proposed
coniferous plantings to east side for complete screening.
2. Indicate rear yard setback to storage and drive area. 30 feet required.
3. Need lot area and building coverage information.
4. Need impervious surface coverage. This includes all parking areas. Cannot exceed 30% on
the lot being developed. If the existing coverage is over 30%, can keep coverage that is
existing. For purposes of this development, the existing buildings are non-conforming with
respect to impervious surface (over 30%), and are located on a defined portion of the lot,
once a separate lot. Therefore, the existing non-conformity can remain as is unaffected by
the proposed development on the overall site. Section 1104.306 allows for industrial site to
have up to 75% impervious surface with conditions. One of those conditions is that the site
be served by municipal sewer and water. Municipal sewer and water is not available.
Section 1101.505 also requires structures intendedfor human use/occupancy be served by
municipal services. Considering, the proposed development is not intended for human
use/occupancy, connection to municipal utilities is not required. It is our interpretation, as
long as the other conditions as stated in the Shoreland Ordinance (Section 1104.306
Impervious Surface) are met, the impervious surface can exceed 30%for the total site being
altered/expanded, as long as the impervious surface for the proposed development portion of
the lot is under 30%.
5. Parking 1 stall for each 10 storage compartments and 1 stall for each 20,000 square feet of
outdoor storage is required. Need parking plan.
6. Landscape plan does not need to be prepared by registered landscape architect. 1 Tree per
40 feet of site perimeter is required. Credit for existing 2 Yz caliper inch trees may be given.
Species must be on tree list in ordinance. Need perimeter and survey of both lots as
combined. Based on tree inventory submitted, there should be enough existing trees on site
to satisfy the requirement. A letter of credit for 125% ofthe landscaping costs will be
required.

Dear Review Committee and Jenni,
The following information is provided for your review of the previously
submitted Prior Lake Mini-Storage project data and drawings. This
information should be included with the previously submitted Site Plan
Application and documents. The original data prepared by Sunde
Engineering and Valley Surveying is to be retained for historical data. The
new information prepared by Rehder and Associates will be the basis for your
final review and permit application. The final boundary survey is in process
by Rehder and Associates, and will be made available for the final permit
application. At this time we are working with their field notes for the grading
plan, tree data and property line location. Prior to construction the west
property line will be staked for reference during construction.
The Architectural drawings have been updated to reflect the final building
locations, sizes, fire extinguisher locations, no parking signs and screening
materials related to the outside storage. The lighting will remain as originally
proposed.
I have included a copy of the previously submitted information sheets along
with copies of the easement and maintenance agreements between Mr.
Thomas and his neighbor. I have also included a copy of your review letter,
dated December 23, 1999, to help follow along with the response information.

The following information is provided as a supplement to the original data
supplied on December 1, 1999.
1. The building area of the new buildings will consist of one - 5,000 sf. bldg.,
one - 6,000 sf. bldg., and two - 7,000 sf. bldgs.
2. Group "1" and Group "2" buildings will be 19,000 sf. each group, well
under the allowable 24,000 sf. building area.
Response to the letter dated, December 23, 1999.
Zoning issues:
1. The fence proposed and shown on K.K. Design's drawing will include
installation of Colorado Blue Spruce trees in a staggered pattern to
created a solid non visual screen or barrier to the outdoor storage area.
2. Rear yard set back at the storage areas exceed the minimum thirty (30)
foot setback.
3. & 4. The building lot area is 479,825 square feet and the lot area coverage
including buildings and bituminous is 142,800 square feet or 29.76 % lot
coverage of impervious surface.
5. The parking stall requirement does appear to be justified for this type of
application. The tenant or leaseholder of the storage area does not come
on site, park their vehicle and proceed to spend time working on site or
parking and leaving the site for another purpose. The leaseholder
typically drives on to the site, to his or her storage space, parks adjacent
or in front of the storage space, completes a short task of dropping off or
picking up an object from their space, and leaves the site. Cars to do not
come on-site park and remain on site hours. A logical location for any
parking would be along side the fence; this would conflict with the building
and fire departments request to maintain a no parking zone along the curb
and fence line. If the operation changes then parking could be stripped at
the rear outside storage area.
6. At this time I have included the landscape items on our plan, which
includes the new Colorado Blue Spruce trees at the South portion of the
South West corner of the property and the living fence at the west side of
the outside storage area. The tree count as shown on Rehder and
Associates drawings, adequately meet the requirements of one (1) tree
per 40 feet of perimeter distance. The existing plantings will remain.
7. The tree inventory has been taken primarily to satisfy the tree count
requirement. At this time no trees will be removed, therefore replacement
will not be required.

Following are the results of the preliminary plan review for the Prior Lake MiniStorage. Our
review was based on the Minnesota State Building Code (MSBC) which adopted with
amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341 and with requirements of the 1998 Minnesota State
Fire Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC).
1. Submit signed architectural and site plans.
2. Submit a soils report.
3.. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. See enclosed.
4. Indicate correct proposed building locations on Certificate of Survey to coincide with
Site Plan. Also dimension locations of existing and proposed building on Surveyor
Site Plan.
5. Provide a Code analysis on the buildings and site.
6. Provide fire lanes for fire apparatus response. Signage to read :" No Parking Fire Lane
by order of Fire Department". Locate on ends of all new and existing buildings. This
would also include buildings on the front parcel where fire apparatus must travel
through. UFC 1001.7.1.
7. Provide fire extinguishers minimum 2AI0BC rated, within 75 feet travel distance of all
areas. UFC 1002.
8. Provide proof of maintenance for maintaining and plowing access road to the site.
9. Provide address numbers to or near buildings. Shall be plainly visible from the street
fronting the property. UFC 901.
This is a preliminary review only. Other code items will be addressed when the final
plans are submitted. The building plans must be reviewed by the Cites Developmental
Review Committee (DRC) which consists of representatives of Planning, Engineering,
Parks, Finance, and Building Departments. The DRC must approve the plans before a
building permits can be issued.

Application Checklist signed by the Owners, Gary and Annette Thomas and the

1. Site plan noting proposed grades, buildings, landscape, fencing,
building and yard lighting prepared by K.K. Design.
2. Current survey by Valley Surveying Co., which has included some
preliminary building information from a previous concept idea. Please
disregard the building information at this time, the current layout
proposed is noted on the K.K. Design plans.
3. Memo from John Krausert, at Rehder and Associates, Inc., who was
requested to review the original site data, hydrologic calculations,
previously proposed and prepared by Sunde Engineering, Inc.
4. Original and previously approved site plan for project including

Prior Lake Mini Storage, 16000 Credit River Road, Prior Lake, MN
The following information is provided to help understand some of the history of
the project and current data for the proposed building addition and expansion of
the outside storage area.
1. Three (3) buildings located in the southeast corner of the property
previously construct by others, sometime around 1985. Existing two
(2) buildings located south and east of the proposed buildings built in
1993 - 1994.
2. Proposed buildings included four (4) structures which will be
considered as a group of buildings, which is permitted under the UBC
as long the buildings meet the criteria of size and type of construction
related to it's occupancy group.
3. Occupancy Group 81, Construction Type IIN, allowable area may be
increased based on separation on three (3) sides. Note assumed
property line or separation line noted on K.K. Design plan. All other
distances are greater than sixty feet (60), therefore allowing 100 %
allowable area increase, or building area total per group of 24,000 sf.
4. Fire protection not required under UBC - water not available therefore,
not required under City of Prior Lake requirements.
5. Exits requirements are not applicable since the buildings are not
occupied, only used for storage.
6. The buildings will be constructed of metal wall and roof panels and
metal overhead doors matching the two (2) existing buildings adjacent.
7. The site will be enclosed with cyclone fencing similar the existing. It
will include concrete curb and gutter and bituminous drive areas also
similar to existing.
8. Our recommendation is that evergreens (Black Hills Spruce) be utilized
as the landscape materials and screening in place of the solid
screening noted for outside storage areas. Security of a storage
facility such as this is an issue and if a totally opaque fencing system
was installed it would give no chance for anyone to observe unwanted
visitors on the site. Therefore we recommend the use of the plantings
and cyclone fencing.
9. The drainage patterns originally proposed will be utilized during this
construction phase, with only minor modifications at the west property
line. Concrete spillways will be provided including riprap at the
discharge to help reduce erosion. Erosion control fabric and staking
will be in-place throughout the construction period. John Krausert,
Civil Engineer with Rehder and Associates, has reviewed the original
ponding calculations and the original calculations include the area of
our proposed construction.

Dear John,
As a follow-up to our meeting on September 7, 1999 regarding the construction of
additional mini-storage structures, we have reviewed our Zoning Ordinance with respect
to architectural materials and multiple structures on a lot. We have determined because
of the nature of the use, the grouping of structures constitutes a principle building in and
of itself as "principal building" is defmed in the Zoning Ordinance. Also, upon
consulting the City Attorney, under the new and current Zoning Ordinance, it is prudent
to allow the same architectural materials as is on the exiting structures to be used on the
new structures.
Therefore, the process for City Approval is Site Plan Review. We have contacted the
county regarding zoning in the township on the adjacent property. The property adjacent
to the west, located in Credit River Township is zoned A-2. Enclosed is an application.
This is an internal review which must be completed prior to building permit approval.

Council of American Building Officials American National Standard (CABO/ANSI).
1. Submit signed architectural, structural, site, and a Certificate of Survey.
2. Submit a soils report.
3. Submit the Structural Engineer's requirements for Special Inspections. UBC 1701.5.
4. It appears that the two additional proposed buildings may be over the allowable area
for an S-l occupancy type storage building. The buildings may require fire walls to
place them in compliance. UBC Table 5-B
5. Provide HDCP onsite parking. UBC Appendix Table A-11-A 6.
This is a preliminary review only. The plans where obtained at a meeting with Dave Ryan
of Valley Surveying on March 30, 1998. The plans submitted where not detailed. A
complete set of plans is required to perform a code analysis. Items such as Type of
construction, Area, and Location on property of the existing and proposed buildings will
need to be provided. Other code items will be addressed when the final plans are

Dear Tom,
Last week we sent you a copy ofthe entire Planning file related to Prior Lake Mini-Storage.
There are a few additional items, which may be of interest to you. First, Gary Thomas, owner of
Prior Lake Mini-storage, has never applied for a building permit. I only met with him to discuss
the process and what was needed. He obviously disagrees and never appealed our interpretation
to the City Council.
The City adopted a new Zoning Ordinance effective May 1, 1999. Obviously previous
discussions did not take the future ordinance into effect. Under the new Zoning Ordinance, the
site is I-I (General Industrial). Warehouse/Storage is a permitted use. Outdoor storage is
permitted with conditions. The dimensional standards may be non-compliant with the current
Zoning Ordinance, however we do not have a current survey with lot area, setbacks, lot coverage,
etc. A Conditional Use Permit is required for multiple principal structures on one lot. The new
ordinance would require a variance for all metal buildings. Upon application for a Conditional
Use Permit and Variance, if needed, all requirements of the current code would be reviewed for
compliance. I would suspect there to be items to be brought up to current City Code.
Considering the complexity of the project and past action, the situation is one in which we sought
legal input from the beginning. It started with a general interpretation of previous action on the
1993 variance request and then has continued with the threat of legal action. Please call me if

Dear Mr. Thomas,
In response to your inquiry to construct two additional buildings, the City of Prior Lake
cannot approve a building permit application for two additional metal storage buildings
and expanded outdoor storage area for Prior Lake Mini Storage. Upon reviewing the
Variance File #93-013 and consulting with the City Attorney on this matter, the following
conclusions were made:
1. Minutes of October 21, 1993, to approve variance to allow metal buildings was
approved with seven specific conditions (attached). Condition #5 states any future
development of the property will require subdividing the property and that this is the
one permit available for the property without subdividing. Condition #6 stated there
is to be no outdoor storage.
2. Section 5-6-8 of the City Code is a sunset provision for variances granted prior to
November 5, 1995. Any variances granted prior to November 5, 1995 for which the
necessary permits have not been issued became null and void on November 6, 1996.
Therefore, we cannot issue a permit in violation of the conditions of the variance
granted in 1993 or in violation of the City Code. In order to proceed with your project
the following must be completed:
1. The property must be subdivided. This was a condition of approval of the variances
granted in 1993. The city has a subdivision ordinance, of which, all requirements
must be complied with upon subdividing property. We have a subdivision packet we
can mail to you upon request. The City Council approves subdivisions.

The October 21, 1993, Planning Commission Meeting was called to order by Chainnan Arnold
at 7 :30 P.M. Those present were Commissioners Roseth, Arnold, Loftus, Vonhof, Director of
Planning Horst Graser, Associate Planner Gina Mitchell, and Secretary Rita Schewe.
Commissioner Greenfield was absent

A correction to the minutes was made by Corrurussioner Arnold, on page two, paragraph seven,
the town .of LakevWe should be changed to Prior Lake, in reference to the residence of
Commissioner Vonhof.

ITEM I - PRIOR LAKE MINT-STORAGE VA 'QIANCE
Norb .Traxler, Attorney of New Prague, represented the applicant, Gary Thomas of 6701 Fariey
Lane, Prior Lake. Mr. Traxler stated his client has appeared before the Commission at P'l earlier
date on a request to waive all Subdivision Ordinance requirements in order to construct
additional mini-storage buildings. TILis request was withdrawn and a revised application is now
being submitted. The variances being requested are from Section 4-7-2 of the Building Code and
5-5-10 of the Zoning Code.
The applicant is asking that the requirement for exterior materials be modified to allow metal
buildings and for a variance from the strict application of the landscape ordinance. There are
several metal buildings in the area which has established a precedent for continuing with metal
exterior finishes. Regarding the landscape, there is significant existing vegetation on the site.
The application is an expansion of an existing development that has unusual aspects which when
applied to the ordinance does impose a hardship on his client Prior building action in the
neighborhood was presented as examples. The appl~.cant feels that the plan he is submitting
would meet the intent of the ordinance.
Horst Graser, Director of Planning, presented the information as per memo of October 21, 1993.
Two variances are requested for the subject site which are; (1) to waive Section 6.10 Screening
Landscape requirements of the Zoning Ordinance and (2) Section 4-7-2 Usable Materials of the
City Code in order to construct a metal building. A brief summary was given of the history of the
area. Mr. Graser stated, that while no one wishes to turn away business but there is a point of
where community benefits stop and liability begins. For the most, codes have been waived but
when it comes to utilities we do nc~ wa.ive, we postpOne. 'This property can not become an island
unto icself with standards accumulated from variance applications. The applicant should be able

to build a metal building and a variance could be granted for this request. The landscape
ordinance has just become law and a precedence would be set if the code is waived. The
ordinance does allow different versions of plantings and screenings that can be used. The code
was not waived for the occupant in the Waterfront Business Parle which is just across the street or
the Holy Cross Church that was built on a site with the same characteristics as the subject site.
The rights of the applicant have been established as have the rights and obligations of the City.
Comments from the Commissioners were on; existing metal building appearances, Landscape
Ordinance defined, security, use of a landscape consultant, number of units and design of the
pro!,,~sed building and the present structure, parking lot requiremen~ defInition of outside
stomge, removal of existing vegetation, future street improvemen~ building materials, lighting,
break-in potential, and applicant working with Staff to implement a landscape plan that would be
fair to all parties. A suggestion was made that this should be brought back to the Commission
when the future expansion of the outdoor storage is planned as there is specific requirements for
this use, such as fencing and blacktop surfaces.
Norb Traxler stated that the plan was done by a landscape architect and whatever lan&:caping
requiremer.ts that does apply for the site will be implemented.
Gary Thomas 6701 Farlcy Lane, stated he has three t.uildings and wishes to construct the
additional units as needed. Outside storage is also part of his business and pointed out an area
that woulti be fenced for boats, trailers, etc. A new gate system that is planned to be installed was
shown. The NURP ponds are planned to to be built to the capacity necessary if the parcel were
fully developed.
Mr. Graser stated that a stonn water management plan was received today by Larry Ander"...o~
the City Engineer, with the revision date of October 21, 1993. A definition of the landscape
planting was given as requested by the Commissioners.

Comments were made on what direction to follow in the future on the subject area in question.
Possibly a special workshop or planning session could be scheduled.
A work program was suggested for sometime in December for th: Commissioners to set goals
for the upcoming year and to formulate the agenda for the annual workshop.

Following are the results of the preliminary plan review for the Prior Lake MiniStorage. Our
review was based on the Minnesota State Building Code (MSBC) which adopted with
amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341 and with requirements of the 1998 Minnesota State
Fire Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC). The
comments are numbered as in the December 14, 1999 plan review letter.
1. Submit signed architectural and site plans.
3.. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. See enclosed.
4. Indicate correct proposed building locations on Certificate of Survey to coincide with

CAUTION: When connected to
electrical service, these lumin-
aires carry dangerous voltages.
When replacing lamps or
otherwise servicing luminaires,
observe all precautions usually
taken in handling high voltage
equipment.
This Luminaire is designed for out-
door lighting and should not be
used in areas with limited ventila-
tiJn or within enclosures with high
ambient temperatures.
NOTE: These units are for 120 volt
60 Hz input only!
Recessed Box Mounting
1. Remove Mounting Kit and install
over recessed box<D in wall. Be sure
to use gasket to insure proper
seal@.
2. Unhinge refractor@ and remove
reflector<D.
3. Pull feed lines thru %" back hole in
fixture and slip unit over mounting
plate nipple@ sandwiching O-Ring
gasket@ between fixture and
mounting plate@.
4. Attach locknut and tighten@ se-
curely to firmly compress O-Ring
gasket@.
5. Adjust fixture alignment and
tighten set screw@. @
8. Make wire splices Inside fixture
using wire nuts. Replace reflector,
install lamp and attach reflector.

Security, accent, convenience and perimeter
lighting. Lighting over entrance ways and
garage doors, indoor parking garages,
tunnels, overpasses and alleys.
Ii CONSTRUCTION
Precision die-cast aluminum housing
finished in Duraplex II™ bronze pOlyester
powder. Deluxe glazed porcelain lamp
socket. Field-adjustable for "fine tuning" of
vertical light distribution. Continuous rubber
gasket between housing and refractor
provides a tight "weather-resistant" seal.
Impact resistant UV stabilized polycarbonate
refractor retards yellowing. One-piece "wrap
arOund" reflector for maximum light
utilization and optimum distribution.
Catadioptic refractor redirects light and
minimizes glare. Hinged and secured by two
captive screws.
OPTICS
Highly specular anodized aluminum reflector
for smooth "down-and-out" distribution.
Asymmetric design redirects available light
into useful 0-60" zone. Refer to Section 12
for photometric data.
BALLAST
Normal power factor reactor ballasts for
120V input (277V available, consult factory).
Refer to Section 12 for electrical data.
INSTALLATION
Precision die-cast aluminum mounting plate
with cast-in knockouts for alignment with all
standard recessed boxes. Allows quick
retrofitting over existing recessed boxes.
One-tapped hole on each side and top for
conduit or photocontrol (1/2" NPS
standard). Complete with closure plugs.
