HomeMy WebLinkAbout8A - Public Hearing Brooksville Hills Phase II MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: DECEMBER 15, 2008 SA LARRY POPPLER, ASSISTANT CITY ENGINEER PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDERING THE 2009 IMPROVEMENT PROJECT AND PREPARATION OF PLANS AND SPECIFICATIONS (BROOKSVILLE HILLS PHASE II) Introduction The purpose of this agenda item is to hold the Public Hearing to consider approval of a resolution ordering the 2009 Improvement Project and the preparation of plans and specifications. A super majority (4/5) is needed to approve the resolution. Historv On July 7,2008, Council adopted Resolution 08-099 ordering the preparation of a Feasibility Report for those projects in the 2008 Capital Improvement Program (CIP) required to follow the Minnesota Statutes Chapter 429 process. The Minnesota Statutes Chapter 429 process is required because the City Council intends to specially assess a portion of the project. The roadways studied in the report include Mandan Avenue, Franklin Circle, Summer Street, Franklin Trail, Robinson Circle, and Itasca Avenue. The 2009 Improvement Project is Phase two of the improvements in this region. The recommendation of the Feasibility Report was to proceed with this project. On November 17, 2008, Council adopted Resolution 08-149 accepting the Feasibility Report and calling for a Public Hearing on December 15, 2008 for the 2009 Improvement Project. Current Circumstances The Public Hearing will cover the reconstruction of Mandan Avenue, Franklin Circle, Summer Street, Franklin Trail, Robinson Circle, and Itasca Avenue, including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, storm water pond, and appurtenant work. The properties deemed to specially benefit from the improvements, in most cases the properties abutting the streets located in the project area, are subject to assessment. Each of the affected property owners have been notified in accordance with the statute regarding tonight's Public Hearing. A Public Information Meeting was held on December 10, 2008 to provide the property owners an opportunity to discuss the project in an informal setting prior to the Public Hearing. Staff presented the proposed improvements, project costs, estimated assessments and answered general questions regarding the project. Comments received from the Public Informational Meeting will be presented at the Public Hearing. www.cityofpriorlake.com Phone 952.447.9800 1 Fax 952.447.4245 The Public Information Meeting also afforded staff an opportunity to provide additional information regarding the voluntary rain garden program, tree program, and driveway reconstruction program. Comments and interest shown for the program will be presented at the Public Hearing. Conclusion City Staff is prepared to discuss each of the concerns presented at the Public Hearing. If, in the Council's judgment, the issues should be addressed in the plans and specifications, direction could be given to staff. The purpose of this Public Hearing is to determine whether the project should move forward to the next step, which is preparation of plans and specifications which will provide greater information about expected project cost and, therefore, the assessments associated with the improvements. Once the plans and specifications are completed, they will be submitted to the City Council for approval and authority to advertise for bids. The Council could decide not to continue with the project upon receipt of bids. A separate Assessment Hearing will be conducted following review of the proposed assessments by the City Council's Assessment Review Committee. In summary, the project is feasible from an engineering and economic standpoint. If the preparation of plans and specifications is approved, the work will be completed by City staff. ISSUES: Street and Storm Sewer Reconstruction Pursuant to the Assessment Policy, the street and storm sewer reconstruction should be assessed at up to 40% of the total project cost against the benefiting properties. The remaining amounts should be recovered through the general ad valorem property tax. Assessment MaD The Assessment Review Committee recommends assessing the properties as shown on the assessment map. Assessment Method The unit method of assessment is proposed for the 2009 Improvement Project due to the fact that the lots in the project area are of similar size and/or value. The estimated assessment rate is proposed at $6,928/unit. Street Widths Reduced As a way to decrease upfront costs, maint6llance costs and reduce the amount of impervious surface, Staff is recommending a reduction of the street widths in the project area. Franklin Trail Inclusion The intersection of Franklin Trail and Summer Street will be reconstructed as a part of the project because of key utility connections. City Staff and the Assessment Review Committee recommend that Franklin Trail from Brooks Circle to Summer Street be reconstructed as a part of this project. This portion of Franklin Trail is nearly 40 years old and has been overlaid twice. Grainwood Elementarv School Bio-retention Area As part of the reconstruction project, a bio-retention area is proposed to be constructed at the Grainwood Elementary School. Construction of the bio- retention area is a positive step toward retaining water upstream of the City's wellhead protection area and a good opportunity to partner with the School District on a mutually beneficial project. Funds for construction of this stormwater component would be taken out of the Water Quality Fund. Orivewav Reconstruction. Rain Garden. and Urban Reforestation ProGrams The driveway reconstruction program and voluntary rain garden program are proposed with this project. An urban reforestation program is also proposed with this project. The tree program would provide an additional benefit to the residents on this project by providing neighborhood beautification as well as reduce storm water drainage. FINANCIAL IMPACT: The bonding considered for this project will replace expiring bonds from previous projects. This transfer of bond obligations therefore does not have a significant impact on the public tax burden. Details of the project and proposed financing will be presented to the public at the hearing. Conduct the Public Hearing and approve a resolution that orders the 2009 Improvements and authorizes City staff to prepare plans and specifications. 2. Table the Resolution for a specific reason. 3. Deny the Resolution. RECOMMENDED jAlternative NO.1 MOTION: ReVi-r:::J ~ Frank BOYleS,V' ]'"ge' WHEREAS, WHEREAS, WHEREAS, WHEREAS, Motion By: Second By: the Prior Lake City Council on its own initiative has determined that it desires to complete the 2009 Public Improvement Project; and on November 17,2008, the City Council adopted Resolution 08-149 accepting the Feasibility Report and calling for a Public Hearing to be held on the 2009 Improvement Project which includes the reconstruction of Mandan Avenue, Franklin Circle, Summer Street, Franklin Trail, Robinson Circle, and Itasca Avenue including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, storm water pond, and appurtenant work; and ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 15th day of December, 2008, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and since the project is initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota Statutes 429.031 Subdivision 1 (t). NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 08-149 adopted November 17,2008 and by the required statutory 4/5ths vote does hereby order the project. 3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer shall prepare plans and specifications for the making of such improvements. 4. The City Engineer is hereby authorized to develop a rain garden program and tree program within the 2009 Improvement Project funded wholly or in part by the Water Quality Fund.
