Dear Mr. Hayes:
The City has reviewed your revised driveway permit application, submitted on April 19, 2006.
The City will not approve the permit as submitted.
First, you have not obtained a grading permit for the proposed disturbance and filling, as required
by the City Shoreland Ordinance. This is required based on your most recent driveway plan
submittal.
Second, the driveway proposed in your permit application would block access to the residences
south of yours. Your neighbors to the south may have a prescriptive easement, or implied
easement, for access across your property. The proposed driveway plan blocks such access. The
City will deny your permit pursuant to Minnesota Rule 6120.3300 subp. 4 (B)(10) and Ordinance
Section 1104.402 (4)(j), because the proposed driveway would alter the topography in a manner
that adversely affects adjacent or nearby properties, by affecting their access. The City will also
deny your permit pursuant to Ordinance Section 701.711 because denial is necessary to protect
the health, safety, and welfare. If the proposed driveway were constructed, it would impede
access to your neighbors to the south, so that emergency vehicles (e.g., fire, police, or ambulance)
would be forced to park further away in situations where they need emergency access to those
residences. The elimination of easy access for emergency vehicles would be detrimental to the
health, safety, and welfare. Further, it is not feasible or lawful for your neighbors to build their
own separate driveway to access Sunset Trail directly, because an unsafe slope, greater than 17%
grade, would be necessary for such a driveway.

After reviewing the resubmitted survey, the driveway grades appear to meet City requirements.
However with meeting City's requirements two additional permit are needed. The two additional
permits are; Private use of Public Property, and a grading permit. The Private use of Public
Property will require City Council approval, and the earliest council meeting would be May 15,
2006. The grading permit will be issued with the Driveway Permit and Private use of public
Property once all fees have been paid. Because both the Driveway Permit and Grading permit are
contingent on approval of the Private use of Public Property permit no action can be taken until
after the council meeting. Additionally the permit will be forwarded to Planning for review of
impervious surface.

After reviewing the survey delivered on Monday, April 10, 2006, City staff noticed an
area with a slope at 20% in the proposed driveway. The maximum driveway slope is
10% per City Ordinance 1107.205. Therefore, the City is denying the application for a
driveway permit under the terms of:
-Unsafe slopes
-Greater than 10% driveway slope

REQUIREMENTS
1. No work under this application is to be started until application is approved and the permit is issued.
2. Where work on traveled roadway is necessary, traffic must be protected and flags, signs, safety cones and proper
barricades must be placed in accordance with safety procedures.
3. No foreign material such as dirt, gravel, or bituminous material shall be left or deposited on the road during the
construction of driveway.
4. Road must be swept clean after work is completed.
5. Prior to placement of concrete or bituminous surfacing, the applicant shall notify the Engineering Department that the
work has been completed and is ready for final inspection.
6. No changes or alterations in entrances may be made at any time without written permission from the Engineering
Department or inspector.
IMPORTANT: Before startinq work. . .
The Applicant shall call Gopher State One Call (1-800-252-1166) 48 hours prior to starting work. Applicant must call the
Engineering Department (952) 447-9830 for inspection 24 hours prior to time of inspection.
When widening or constructing new driveway approaches a $10.00 fee is required at the time of application and a sketch of the
property depicting present and proposed driveways in relation to the property line.
