September 22, 1999 Rock Creek Homes, LLC 3904 Kestrel Street SW Prior Lake, MN 55372 SUBJECT: APPLICA nON FOR EXCA V ATING/FILLING PERMIT 4893 RUTLEDGE STREET Dear Sir/Madam: The Engineering and Planning Departments have reviewed the subject permit application for construction of a driveway on the subject lot. The permit is denied for the following reasons: 1. A driveway alone is not a permitted use within the Zoning district. A driveway can only be constructed as part of a pennitted use such as a single family home. 2. There are indications (aerial photography, topography and vegetation) that there is a wetland on the site. A wetland delineation/determination is required. If fill is proposed in the wetland area, mitigation will be required per the Minnesota Wetland Conservation Act (WCA). 3. The proposed contours are to be shown on the plan and sign(,"d by an engineer or surveyor registered in the state of Minnesota. 4. As part of the erosion control measures, a rock construction entrance will be required. 5. Tree removal is within the confines of the Tree Preservation Ordinance. In previous discussion with City staff, there was discussion of the possibility of driveway access being obtained through a private easement with an adjacent property owner. This would eliminate the need to fill in the wetland. If the driveway is eliminated from the plan and the wetland issue is resolved, a permit meeting all requirements could be approved.
