Dear Jane,
Please find enclosed my application for a building permit to allow me to build a replacement
deck, and my request for a waiver of survey requirements. Also find enclosed a site plan that
shows the deck location relative to existing structures and lot lines, and a detailed plan for the
deck.
Your visit to the site on February 20, the availability of a recent survey of the pWP"';Y to the east
(Sid Rhinehart), and the several days of surveying by City technicians for the purpose of future
sewer reconstruction have provided reliable evidence ofthe location of the property boundaries.
On this basis, another survey would be redundant. Therefore, I am requesting waiver of the
survey requirements. Enclosed is my check for $50 for Staff review.
Since the replacement deck will be constructed within the footprint of the existing retaining wall
which is part of the current deck structure, no variance request should be required. As you're
aware, this replacement deck will permit bringing the deck construction into compliance with
code.
If you have any questions, please give me a call. Thanks for taking the time to visit our location
and for reviewing our plans with me.

A request to waive the survey requirements will be accepted only for the construction of
decks. Prior to the review of this request, the property owner must provide
reasonably reliable evidence in the field of what he/she believes are the property
boundaries. This request must also be accompanied by the following information:
I. The deck must be drawn on a site plan to scale. The site plan must identify
dimensions of both existing and new structures, and the distance from any lot lines.
2. The property owner must sign an agreement, prepared by the City, holding the City
harmless from any damages incurred if the deck is placed inaccurately on the site, or
of it irifringes on any setback requirements or easements.
3. The property owner shall pay a $50.00 fee for the staffreview according to the
adopted fee schedule.
Once a request is reviewed, the staff will schedule a field inspection and review all
available information. The Planning Director and Building Official will then make a
determination of whether the requirements may be waived.
