To Whom It May Concern:
The purpose of this memo is to define the programs that will be transferred from
Ponds Edge to the strip mall at 15875 Franklin Trail.
As the memo to City Manager Frank Boyles dated January 24, 2000 states:
Permitted uses for the C-1 district with conditions are group day care/nursery schools.
Our intended use is to have two programs both for preschool children.
1. ECFE (Early Childhood Family Education)
2. ECSE (Early Childhood Special Education)
While these programs may involve some parents of the children who attend, these are
clearly non K-12 programs.

RE: Play Area Access from Northgate Shopping Center to Westwood School
Dear Mr. Borchardt:
The City of Prior Lake has reviewed the drawing you submitted for the access
from Northgate Shopping Center to Westwood School. As you know, the City
has agreed to allow the School District to use this property to meet the required
play area for the proposed nursery school/day care center in Northgate Center.
This play area, however, must be accessible.
The drawing you submitted does not provide enough information to determine
whether the access meets minimum requirements. First of all, the drawing is not
based on existing conditions. Secondly, the highlighted elevation points are not
located within the path on the drawing. Finally, based on the information
submitted, the access will not meet the ADA standard requiring a 1 :20 slope.
Attached for your information is a copy of the grading plan for the Northgate
Center. This is not an as-built drawing, but it may provide some basis for
determining as-built conditions. The next drawing you submit must include the
following details:
. As-built grades of both properties
. Details of the location and design of the proposed path including its width,
location, and slopes.
. The location of the play area to be utilized by the nursery school. This play
area must include a minimum of 40 square feet per pupil.

The school district has apparently inquired about the use of space in the shopping
center located at 15875 Franklin Trail. This property is zoned C-l (Neighborhood
Commercial). The answer to the question about whether or not the school district
will be allowed to use this space primarily depends on what use is proposed.
Permitted uses in the C-l district include libraries, museums and offices. A use
permitted with conditions includes group day care/nursery schools. The
conditions for group day care/nursery schools are: 1) a minimum of at least 40
square feet of outside play space per pupil shall be provided and such space shall
be enclosed by a bufferyard Type C as defined in subsection 1107.2005; 2) an off-
street passenger loading area shall be provided in order to maintain vehicular and
pedestrian safety; and 3) the play area shall be located a minimum of200 feet
from any roadway defined on the Comprehensive Plan as a principal arterial.
Educational/academic uses are not permitted in the C-l district.
If the school district is planning to use this space for administrative offices or
preschool programs, the use is permitted as long as the applicable conditions are
met. If, however, they are proposing to use the space for classrooms for grades K-
12, the use is not permitted.
Another consideration in this matter is the use of the existing Ponds Early
Learning Center on Tower Street. This property is presently zoned R-4. The
early learning center is a permitted use in this district. If the use is discontinued,
the site cannot be used for administrative offices only.
