The undersigned hereby assents to the following:
1. I have read the conclusions and conditions of said Resolution, and I am familiar with
their contents and with the content of the exhibits.
2. I fully accept all of the terms and conditions of said Resolution.
3. I understand Section 1108.400 ofthe Prior Lake Ordinance Code provides as follows:
1108.413 Revocation and Cancellation of a Variance. A Variance may be
revoked and canceled if the Zoning Administrator determines that the
holder of an existing Variance has violated any of the conditions or
requirements imposed as a condition to approval of the Variance, or has
violated any other applicable laws, ordinances, or enforceable regulation.
1108.414 After One Year. No Construction Required. All Variances shall be
revoked and canceled if 1 year has elapsed from the date of the adoption
of the resolution granting the Variance and the holder of the Variance
has failed to make substantial use of the premises according to the
provisions contained in the Variance.
1108.415 After One Year. New Construction Required. All Variances shall be
revoked and canceled after 1 year has elapsed from the date of the
adoption of the resolution granting the Variance if a new structure or
alteration or substantial repair of an existing building is required by the
Variance and the holder has failed to complete the work, unless a valid
building permit authorizing such work has been issued and work is
progressing in an orderly way.
1108.416 Upon Occurrence of Certain Events. If the holder of a Variance fails
to make actual use of vacant land, or land and structures which were
existing when the Variance was issued and no new structure, alteration
or substantial repair to existing buildings was required; or if a new
structure was required by the Variance and no building permit has been
obtained, the Variance shall be deemed revoked and canceled upon the
occurrence of any of the following events:
(1) A change in the Use District for such lands is made by amendment to
the Zoning Ordinance by the City Council.

(2) Eminent domain proceedings have been initiated to take all or any
part of the premises described in the Variance.
(3) The use described in the Variance becomes an illegal activity under
the laws of the United States of America or the State of Minnesota.
(4) Title to all or part of land described in such Variance is forfeited to
the State of Minnesota for nonpayment of taxes.
(5) The person to whom the Variance was issued files a written statement
in which that person states that the Variance has been abandoned.
The statement shall describe the land involved or state the resolution
number under which the Variance was granted.
(6) The premises for which the Variance was issued are used by the
person to whom the Variance was issued in a manner inconsistent
with the provisions of such Variance.
4. I understand the granting by the City ofthis Resolution is in reliance on the
representations that I will fully comply with all of the terms and conditions of said
Resolution. I understand and agree upon notice of non-compliance with any term or
condition, I shall immediately cease conducting activities pursuant to the notice or
will take all actions necessary to accomplish full compliance with said notice and
conditions of the Resolution.

We hereby issue. for the account of Church of St. Michael. and in your favor. our
Amended Irrevocable Letter of Credit in the amount of Thirty One Thousand Two Hundred
Ten and 00/100 (31.210.00) Dollars. available to you by your draft drawn on sight on
the undersigned bank.
The draft must:
a) Bear the clause. "Drawn under Amended Letter of Credit No. 1309 dated February 16.
2001. of Prior Lake State Bank";
b) Be signed by the Mayor or City Manager of the City of Prior Lake;
c) Be presented for payment at 16677 Duluth Avenue SE. Prior Lake. Minnesota. on or
before 3:00 P.M. on February 12" 2002.
This Letter of Credit shall automatically renew for successive one year terms unless,
at least forty five (45) days prior to the next annual renewal date (which shall be
February 12 of each year). the Bank delivers written notice to the Prior Lake City
Manager that it intends to modify the terms of. or cancel. this Letter of Credit.
Written notice is effective if sent by certified mail. postage prepaid and deposited in
the U.S. Mail. at least forty five (45) days prior to the next annual renewal date
addressed as follows: Prior Lake City Manager. Prior Lake City Hall, 16200 Eagle Creek
Avenue. Prior Lake, Minnesota 55372-1714, and is actually received by the City Manager
at least forty five (45) days prior to the renewal date.
This Letter of Credit sets forth in full our understanding which shall not in any way
be modified, amended, amplified or limited by reference to any document. instrument or
agreement. whether or not referred to herein.
This Letter of Credit is not assignable. This is not a Notation Letter of Credit.
More than one draw may be made under this Letter of Credit.
This Letter of Credit shall be governed by the most recent revision of the Uniform
Customs and Practice for Documentary Credits. International Chamber of Commerce Publi-
cation No. 400.

I am responding to your review of the Site Plan for the addition of St. Michael's School.
Item No.1. The total number of classrooms in the existing building are 21 and the total classrooms
in the new building are 10. The total classrooms therefore are 31 with 2 parking spaces per
classroom equals 62 parking stalls required. We are providing a total of 111 parking stalls.
Item No.2. The new addition incorporates a Cafeteria in lieu of an Auditorium. There is no Stage in
the Cafeteria. The occupancy of the Cafeteria is 147.
Item No.3. St. Michael Parish will be sending you a letter of credit to guarantee the planting.
Item No.4. The remaining review comments will be addressed per Post-Bid Addendum 3.

and October 20, 2000, regarding the site application submittal.
In addition, I want to bring the following items to your attention:

School Building Addition

Project Narrative:
The proposed building addition will occur on the North-West corner at the intersection of
Pleasant and Duluth on the property of the St. Michael Catholic School. Construction is
planned to start in February of 2001 and completion in September of 2001. The purpose ofthe
addition is to meet the needs of the growing school and community.
The proposed school addition will include 25,000 square foot, two story building with a 52 car
parking lot. The building exterior will include brick, concrete block and aluminum windows.
The interior wi II be classrooms, media center, cafeteria, toilets, faculty lounge and storage. All
interior surfaces will be either painted, carpet, vinyl tile or ceramic tile (see floor plans and
exterior elevations). The parking will included new curbs, new light standards and finish surface
will be bituminous paving. The landscaping will be alone Pleasant for buffering ( see plan for
descri pti on).

Attached is a sample letter of credit for your information. This is the format the City of
Prior Lake accepts for all letters of credit. In the case of St. Michael's, the first LOC must
be submitted prior to approval of a building permit. This LOC is to ensure the required
landscaping is installed. Following City approval of the landscaping, the owner can either
submit a new letter of credit, or change the expiration date of the existing LOC to a date
2 years following City approval of the project.
I hope this answers your questions. Just as a reminder, when you submit revised plans,
please be sure to submit at least 4 complete sets of full-scale plans. Once the site plan
has been approved, we will issue a grading permit. We will not issue a building permit

RE: Site Plan for the Addition to St. Michael's School
Dear Mr. Nightingale:
The City has completed its review of the revised site plan documents submitted
for the addition to St. Michael's School. In order to comply with the City Zoning
Ordinance and other City Codes, the site plan requires the following changes:
1. Parking:
a. The Zoning Ordinance requires a minimum of 2 parking spaces per
classroom. What is the total number of classrooms in the building? In
addition, what is the occupancy of the auditorium?
b. Section 1107.204 (10) of the Zoning Ordinance requires all parking lots be
screened from adjacent streets and property. This requires a berm a
minimum of 30" high and landscaping providing 80% opacity. The
proposed plan does not provide adequate screening. A copy of Zoning
Ordinance section is attached for your information. A Bufferyard Type "C"
is required along the west boundary of the parking lot. This bufferyard
requires a minimum of 3 canopy trees, 5 understory trees and 8 shrubs.
The required bufferyard plantings may be included as part of the
screening requirements. The landscaping plan submitted includes only 4
understory trees. In addition, there is no indication of the required 30"
berms.
2. Landscaping:
a. The addition requires perimeter landscaping, with at least 39 trees, in
addition to the required bufferyard landscaping. At least 25% of the 39
trees must be deciduous and 25% must be evergreen trees. In addition,

On November 13, 2000, the City of Prior Lake Development Review Committee (DRC)
received additional information for the Site Plan application for the addition to St. Michael's
School. We have received the majority of materials required fer review of this site plan.
However, this application will not be complete until the following issues have been resolved:
1. The west wall of the addition exceeds the maximum wall length to wall height ratio of
4:1. If you intend to proceed with this design, you must submit a variance application for
review and approval.
2. You must obtain a permit from the Prior Lake-Spring Lake Watershed District for this
development. A copy of the approved permit, along with any plans must be submitted to
the City.
3. A final plat application must be submitted and approved by the City Council.
We will continue to review the plans we have received. In the meantime, you must address
the above issues before we will approve the plans.

Dear Mr. Nightingale:
The City has completed its review of the site plan documents submitted so far for
the addition to St. Michael's School. In order to comply with the City Zoning
Ordinance and other City Codes, the site plan requires the following changes:
1. General Comments:
a. The site plan must include lot dimensions and setback dimensions, based
on the certificate of survey.
b. Will there be an outdoor recreation and play area? If so, where will this
area be located? The Zoning Ordinance requires an outdoor recreation or
play area be located at least 25' from any lot line. A landscape bufferyard
will also be required adjacent to the area.
c. Are any signs proposes for this site? If so, the site plan must identify the
sign location and include a sign detail.
d. A lighting plan is required for the exterior lighting. The plan must include
elevations or plans for the lights, as well as a luminaire plan identifying the
footcandles.
2. Parking:
a. Where is the bus loading and parking area? An off-street loading area
must be provided.

b. The Zoning Ordinance requires a minimum of 2 parking spaces per
classroom. What is the total number of classrooms in the building? In
addition, what is the occupancy of the auditorium?
c. Section 1107.204 (10) of the Zoning Ordinance requires all parking lots be
screened from adjacent streets and property. This requires a berm a
minimum of 30" high and landscaping providing 80% opacity. The
proposed plan does not provide adequate screening. A copy of Zoning
Ordinance section is attached for your information.
d. A Bufferyard Type "C" is required along the west boundary of the parking
lot. This bufferyard requires a minimum of 2 canopy trees, 4 understory
trees and 6 shrubs. The required bufferyard plantings may be included as
part of the screening requirements.
e. Lighting is required in each of the parking lots. Parking lot lighting
requires an average horizontal illumination between 0.4 and 1.0
footcandles.
3. Landscaping:
a. The addition requires perimeter landscaping, with at least 40 trees, in
addition to the required bufferyard landscaping. The required perimeter
landscaping may also be included as part of the parking lot screening
requirements.
b. At least 25% of the 40 trees must be deciduous and 25% must be
evergreen trees. In addition, 10% of the deciduous trees must be at least
3 ~ caliper inches in size, and 10% of the evergreen trees must be at
least 8' in height.
c. The landscape plan must be prepared and signed by a registered
landscape architect.
d. If an irrigation plan is not included, the applicant must provide a letter of
credit to guarantee the plantings. This letter of credit must be good for at
least 2 years following City acceptance of the landscaping.
4. Architectural Design:
a. The exterior of the building must consist of at least 60% Class I materials.
b. The wall length to wall height of the building may not exceed a 4:1 ratio.
The west wall of the building exceeds this ratio.
5. Building Department Comments:
a. Sheet C1.1: Indicate location and type of termination for the sewer and
water services for the demolished houses.
b. Sheet C4.1: Indicate the locations of adjacent fire hydrants, Phase III
West building and Siamese connection.

Dear Mr. Nightingale:
I received your letter dated September 1, 2000. I wanted to clarify some of the points made in the
letter with respect to the review and approval process for this project.
First of all, as noted in your letter, the Planning Commission will review the preliminary plat for St.
Michael's Addition at their meeting on September 11, 2000. If the Planning Commission takes
action at that meeting, this preliminary plat will be scheduled for review by the City Council on
October 2, 2000. If the City Council approves the preliminary plat, an application for a final plat is
then submitted. At this time, the final plat must meet all conditions of approval of the preliminary
plat. The final plat is usually considered by the City Council within 30 days of the receipt of a
complete application. This date may vary, depending on meeting schedules and the need for any
changes to the plat documents. Once the final plat has been approved, it must be recorded with
the Scott County Recorder's office. Recording of the final plat will create the new lot for
construction of the school addition.
Second, as noted in your letter, the actual addition to the school does not require review by the
Planning Commission or City Council unless variances are requested. However, this addition
does require site plan review and approval before a building permit will be issued. The staff
completes the site plan review and approval process administratively. In order to begin this
process, you must submit an application for site plan approval and all of the necessary
attachments. Depending on the size of the project and the need for changes, this process can be
completed in 30 to 60 days from the date we receive a complete application.

This letter serves as a follow-up to our meeting on Friday, May 5, 2000. The following
are comments made or issues to be addressed as a part of the review process.
A preliminary and final plat is required to combine the lots. Staff will work with you to
derive a plan in which all of the required improvements are on the existing school lots
(metes and bounds description). However, it appears there may not be adequate off-street
parking on the site, even if parking is provided across the street at the church. Therefore,
variances may be necessary. The timing to process a variance is approximately 45 days.
The variance and site plan can be processed simultaneously with your preliminary and
final plats.
Parking can occur off-site at the church. However, all conditions of the ordinance must
be met. The total required parking spaces for the joint use is based on the combined peak
requirement. We will calculate the parking for the school based on classrooms, office,
and occupancy of the auditorium combined. The parking for the existing church is 1 stall
per 3 seats based on maximum occupancy of the assembly area. It was thought
occupancy was approximately 1100 seats, resulting in 367 stalls required for the church
alone. If there is not adequate parking existing at the church and combined with the
proposed school parking area, then additional parking must be provided for if a joint use
parking lot is proposed.

Considering the preliminary and final plat can be processed in a minimum of
approximately 60 days, depending on complete application and action of Council, it may
be in your best interest to apply for preliminary and final plat to combine the lots while
preparing a site plan which incorporates all of the lots. The extent of variances would be
minimized or eliminated with the larger parcel. Should you choose to proceed in this
manner, there is the risk of variances being necessary depending on area available to
provide the required setbacks, parking, and off-street loading.
The preliminary plat requires a recommendation from the Planning Commission prior to
going to the City Council for final action (minimum of60 days to process). The final plat
requires only City Council approval. Staff is also willing to review your site plan while
the platting proceeds through the necessary approvals.
Please be advised there are several issues yet to be reviewed by staff and there is the
potential for additional items to be discovered during the review process. Submittal of

Following are the results of the preliminary plan review for the St. Michael's 2000 School
Addition. Our review was based on the Minnesota State Building Code (MSBC) which adopted
with amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341. Also requirements of the 1998 Minnesota State Fire
Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC).
I. Complete a Building Code analysis on existing building, addition and future phase
construction. UBC Chapter 5. Include the following:
a. Occupancy Classification.
b. Type of Construction
c. Location on Property
d. Allowable Floor Area
e. Height and number of stories
f. Exiting calculations
g. Plumbing fixture tabulation
2. Submit a Certificate of Survey and a Site Utility plan.
3. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. Retaining walls
over 4' -0" in height need to be structurally engineered.
4. Submit a soils report.
5. Submit Energy Envelope Calculations. MN Energy Code 7670.0100
6. Provide the Illumination Budget Calculation Summary, MN Energy Code Part
7670.080.
7. Provide a room finish, door, door hardware, and window schedule.
8. Submit signed HV AC, plumbing, fire alarm, and sprinkler plans. May be submitted at
a later date.
9. A S.A.C. determination must be completed by the Metropolitan Waste Control
Commission. Contact Jody Edwards at 651.602.1113.
10.. Provide detail of penetration firestopping .
11. Provide a recycling space. MSBC 1300.4700.
12. Provide emergency lighting and exit signs. UBC 1003.2.8
13. Sprinkler system shall be monitored by a remote station. MSFC 1003.3.1
14. Provide a Post Indicator Valve (plY) on sprinkler supply line into building. Locate a
minimum distance away the height of the building.
15. Provide fire lanes for fire apparatus response. Signage to read :" No Parking Fire Lane
by order of Fire Department". Indicate on a Site plan. Locate by Fire Hydrant(s) and
by Fire Department connection. UFC 1001.7.1.
16. Provide fire extinguishers minimum 2AlOBC rated, within 75 feet travel distance of
all areas. UFC 1002.
17. Provide a Fire Hydrant within 150 feet ofthe Fire Department connection and all
areas of the building shall be within 300 feet of a Fire Hydrant.
18. Enunciator panel(s) must be located a front Vestibule.
19. Ventilation for the building must meet UBC chapter 12. Provide 15 CFM of
ventilation per occupant.
Items discussed at April 21, 2000 meeting with Architect and church representatives:
a. The existing building is over allowable area, type of construction and number of
stories. Uniform Building Code 3403.2 states in part" Any building plus new additions
shall not exceed the height, number of stories and area specified for new buildings. " As
such, the existing building must be brought up to current code for the items mentioned.
Also the city has adapted Section 1306 of the Minnesota State Building Code which
states that buildings increased in floor area shall be equipped with a fire suppression
system.
b. Architect inquired as to the possibility of deferring MSBC Minnesota Accessibility
Code 1341.0405, Item E which states a passenger elevator serve the second story of
the addition. Architect requested that it be deferred to the next phase of the building,
stated cost as single factor for request. I have checked with State Building Code
Division for history and guidance. Division indicated no precedence for this course of
action. Handicap access to the second floor is required.
This is a preliminary review on concept plans only. Other code items will be addressed
when the preliminary plans are submitted. The building plans must be reviewed by the
Cites Developmental Review Committee (DRC) which consists of representatives of
Planning, Engineering, Parks, Finance, and Building Departments. The DRC must
approve the plans before a building permits can be issued.

following are comments made or issues to be addressed as a part of the review process.
I. The use is considered Educational (Academic) and is permitted with conditions as
listed in the Zoning Ordinance. One condition is that off-street passenger loading be
provided. As we discussed this is an important issue to address.
2. A preliminary and final plat will be required to combine all of the lots. We cannot
issue a building permit over a lot line and all required improvements, such as
landscaping and parking, are required to be on the same lot as the principal lot.
3. The process for the building addition is site plan approval. Submittal of necessary
plans and fee is required, including submittal of a survey.
4. The yards are as we discussed. The lot consists of three fronts and one rear yard. The
setbacks are accordingly- Front Yard 25', rear yard 25 feet. There are no interior side
yards. Therefore, the increased setback for sidewalls over 40' in length will not
apply.
5. Parking can occur off-site at the church. However, all conditions of the ordinance
must be met. The total required parking spaces for the joint use is based on the

6. Attached is a memorandum from Robert Hutchins, Building Official, regarding
building code related items discussed including sprinkler systems and elevators.
A survey was to be submitted on April 21, 2000, such that additional comments could be
provided to you. The City has yet to receive the survey. Please be advised there- are
several issues yet to be reviewed by staff and there is the potential for additional items to
be discovered during the review process. Submittal of the necessary information and
applications will reveal and address any such issues.
At this point, your next step is to submit for preliminary plat. Weare willing to process
the final plat with the preliminary plat. The preliminary plat requires a recommendation
from the Planning Commission prior to going to the City Council for final action
(minimum of 60 days to process). The final plat requires only City Council approval.
Staff is also willing to review your site plan while the platting proceeds through the
necessary approvals. As we have discussed, staff is not in the position to approve your
site plan or issue any permits (grading or building) prior to preliminary and final plat
approval.
Once you have submitted the necessary applications, we will begin formal review of your
plat and site development project. If you have any questions about ordinance

Following are the results ofthe preliminary plan review for the St. Michael's 2000 School
Addition. Our review was based on the Minnesota State Building Code (MSBC) which adopted
with amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341. Also requirements of the 1998 Minnesota State Fire
Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC).
I. Complete a Building Code analysis on existing building, addition and future phase
construction. UBC Chapter 5. Include the following:
a. Occupancy Classification.
b. Type of Construction
c. Location on Property
d. Allowable Floor Area
e. Height and number of stories
f. Exiting calculations
g. Plumbing fixture tabulation
2. Submit a Certificate of Survey and a Site Utility plan.
3. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. Retaining walls
over 4' -0" in height need to be structurally engineered.
4. Submit a soils report.
5. Submit Energy Envelope Calculations. MN Energy Code 7670.0100
6. Provide the Illumination Budget Calculation Summary, MN Energy Code Part
7670.080.
7. Provide a room finish, door, door hardware, and window schedule.
8. Submit signed HV AC, plumbing, fire alarm, and sprinkler plans. May be submitted at
a later date.
9. A S.A.C. determination must be completed by the Metropolitan Waste Control
Commission. Contact Jody Edwards at 651.602.1113.
10.. Provide detail of penetration firestopping .
11. Provide a recycling space. MSBC 1300.4700.
12. Provide emergency lighting and exit signs. UBC 1003.2.8
13. Sprinkler system shall be monitored by a remote station. MSFC 1003.3.1
14. Provide a Post Indicator Valve (plY) on sprinkler supply line into building. Locate a
minimum distance away the height of the building.
15. Provide fire lanes for fire apparatus response. Signage to read :" No Parking Fire Lane
by order ofPire Department". Indicate on a Site plan. Locate by Fire Hydrant(s) and
by Fire Department connection. UFC 1001.7.1.
16. Provide fire extinguishers minimum 2AlOBC rated, within 75 feet travel distance of
all areas. UFC 1002.
17. Provide a Fire Hydrant within 150 feet ofthe Fire Department connection and all
areas of the building shall be within 300 feet of a Fire Hydrant.
18. Enunciator panel(s) must be located a front Vestibule.
19. Ventilation for the building must meet UBC chapter 12. Provide 15 CFM of
ventilation per occupant.
Items discussed at April 21, 2000 meeting with Architect and church representatives:
a. The existing building is over allowable area, type of construction and number of
stories. Uniform Building Code 3403.2 states in part " Any building plus new additions
shall not exceed the height, number of stories and area specified for new buildings. " As
such, the existing building must be brought up to current code for the items mentioned.
Also the city has adapted Section 1306 ofthe Minnesota State Building Code which
states that buildings increased in floor area shall be equipped with a fire suppression
system.
b. Architect inquired as to the possibility of deferring MSBC Minnesota Accessibility
Code 1341.0405, Item E which states a passenger elevator serve the second story of
the addition. Architect requested that it be deferred to the next phase of the building,
stated cost as single factor for request. I have checked with State Building Code
Division for history and guidance. Division indicated no precedence for this course of
action. Handicap access to the second floor is required.
This is a preliminary review on concept plans only. Other code items will be addressed
when the preliminary plans are submitted. The building plans must be reviewed by the
Cites Developmental Review Committee (DRC) which consists of representatives of
Planning, Engineering, Parks, Finance, and Building Departments. The DRC must
approve the plans before a building permits can be issued.
