I have read the conclusions and conditions of said Resolution, and I am familiar with their contents and with the content of the exhibits. 2. I fully accept all of the terms and conditions of said Resolution. 3. I understand Section 1108.400 ofthe Prior Lake Ordinance Code provides as follows: 1108.413 Revocation and Cancellation of a Variance. A Variance may be revoked and canceled if the Zoning Administrator determines that the holder of an existing Variance has violated any of the conditions or requirements imposed as a condition to approval of the Variance, or has violated any other applicable laws, ordinances, or enforceable regulation. 1108.414 After One Year. No Construction Required. All Variances shall be revoked and canceled if 1 year has elapsed from the date of the adoption of the resolution granting the Variance and the holder of the Variance has failed to make substantial use of the premises according to the provisions contained in the Variance. 1108.415 After One Year. New Construction Required. All Variances shall be revoked and canceled after 1 year has elapsed from the date of the adoption of the resolution granting the Variance if a new structure or alteration or substantial repair of an existing building is required by the Variance and the holder has failed to complete the work, unless a valid building permit authorizing such work has been issued and work is progressing in an orderly way. 1108.416 Upon Occurrence of Certain Events. If the holder of a Variance fails to make actual use of vacant land, or land and structures which were existing when the Variance was issued and no new structure, alteration or substantial repair to existing buildings was required; or if a new structure was required by the Variance and no building permit has been obtained, the Variance shall be deemed revoked and canceled upon the occurrence of any of the following events: (1) A change in the Use District for such lands is made by amendment to the Zoning Ordinance by the City Council. In order to comply with the City Zoning Ordinance and other City Codes, the site plan requires the following changes: 1. Parking: a. The Zoning Ordinance requires a minimum of 2 parking spaces per classroom. What is the total number of classrooms in the building? In addition, what is the occupancy of the auditorium? b. Section 1107.204 (10) of the Zoning Ordinance requires all parking lots be screened from adjacent streets and property. This requires a berm a minimum of 30" high and landscaping providing 80% opacity. The proposed plan does not provide adequate screening. A copy of Zoning Ordinance section is attached for your information. A Bufferyard Type "C" is required along the west boundary of the parking lot. This bufferyard requires a minimum of 3 canopy trees, 5 understory trees and 8 shrubs. The required bufferyard plantings may be included as part of the screening requirements. The landscaping plan submitted includes only 4 understory trees. In addition, there is no indication of the required 30" berms. 2. Landscaping: a. The addition requires perimeter landscaping, with at least 39 trees, in addition to the required bufferyard landscaping. At least 25% of the 39 trees must be deciduous and 25% must be evergreen trees. This bufferyard requires a minimum of 2 canopy trees, 4 understory trees and 6 shrubs. The required bufferyard plantings may be included as part of the screening requirements. e. Lighting is required in each of the parking lots. Parking lot lighting requires an average horizontal illumination between 0.4 and 1.0 footcandles. 3. Landscaping: a. The addition requires perimeter landscaping, with at least 40 trees, in addition to the required bufferyard landscaping. The required perimeter landscaping may also be included as part of the parking lot screening requirements. b. At least 25% of the 40 trees must be deciduous and 25% must be evergreen trees. In addition, 10% of the deciduous trees must be at least 3 ~ caliper inches in size, and 10% of the evergreen trees must be at least 8' in height. c. The landscape plan must be prepared and signed by a registered landscape architect. d. If an irrigation plan is not included, the applicant must provide a letter of credit to guarantee the plantings. This letter of credit must be good for at least 2 years following City acceptance of the landscaping. 4. Architectural Design: a. The exterior of the building must consist of at least 60% Class I materials. b. The wall length to wall height of the building may not exceed a 4:1 ratio. I wanted to clarify some of the points made in the letter with respect to the review and approval process for this project. First of all, as noted in your letter, the Planning Commission will review the preliminary plat for St. Michael's Addition at their meeting on September 11, 2000. If the Planning Commission takes action at that meeting, this preliminary plat will be scheduled for review by the City Council on October 2, 2000. If the City Council approves the preliminary plat, an application for a final plat is then submitted. At this time, the final plat must meet all conditions of approval of the preliminary plat. The final plat is usually considered by the City Council within 30 days of the receipt of a complete application. This date may vary, depending on meeting schedules and the need for any changes to the plat documents. Once the final plat has been approved, it must be recorded with the Scott County Recorder's office. Recording of the final plat will create the new lot for construction of the school addition. Second, as noted in your letter, the actual addition to the school does not require review by the Planning Commission or City Council unless variances are requested. However, this addition does require site plan review and approval before a building permit will be issued. The staff completes the site plan review and approval process administratively. In order to begin this process, you must submit an application for site plan approval and all of the necessary attachments. Depending on the size of the project and the need for changes, this process can be completed in 30 to 60 days from the date we receive a complete application. Our review was based on the Minnesota State Building Code (MSBC) which adopted with amendments the 1997 Uniform Building Code (UBC) with handicap regulations of the Minnesota Accessibility Code Chapter 1341. Also requirements of the 1998 Minnesota State Fire Code (MSFC) which adopted with amendments the 1997 Uniform Fire Code (UFC). I. Complete a Building Code analysis on existing building, addition and future phase construction. UBC Chapter 5. Include the following: a. Occupancy Classification. b. Type of Construction c. Location on Property d. Allowable Floor Area e. Height and number of stories f. Exiting calculations g. Plumbing fixture tabulation 2. Submit a Certificate of Survey and a Site Utility plan. 3. Submit the Structural Engineers requirements for Special Inspections UBC 1701.5. Retaining walls over 4' -0" in height need to be structurally engineered. 4. Submit a soils report. 5. Submit Energy Envelope Calculations. MN Energy Code 7670.0100 6. Provide the Illumination Budget Calculation Summary, MN Energy Code Part 7670.080. 7. Provide a room finish, door, door hardware, and window schedule. 8. Submit signed HV AC, plumbing, fire alarm, and sprinkler plans. May be submitted at a later date. 9. A S.A.C. determination must be completed by the Metropolitan Waste Control Commission. Contact Jody Edwards at 651.602.1113. 10.. Provide detail of penetration firestopping . 11. Provide a recycling space. MSBC 1300.4700. 12. Provide emergency lighting and exit signs. UBC 1003.2.8 13. Sprinkler system shall be monitored by a remote station. MSFC 1003.3.1 14. Provide a Post Indicator Valve (plY) on sprinkler supply line into building. Locate a minimum distance away the height of the building. 15. Provide fire lanes for fire apparatus response. Signage to read :" No Parking Fire Lane by order ofPire Department". Indicate on a Site plan. Locate by Fire Hydrant(s) and by Fire Department connection. UFC 1001.7.1. 16. Provide fire extinguishers minimum 2AlOBC rated, within 75 feet travel distance of all areas. UFC 1002. 17. Provide a Fire Hydrant within 150 feet ofthe Fire Department connection and all areas of the building shall be within 300 feet of a Fire Hydrant. 18. Enunciator panel(s) must be located a front Vestibule. 19. Ventilation for the building must meet UBC chapter 12. Provide 15 CFM of ventilation per occupant. Items discussed at April 21, 2000 meeting with Architect and church representatives: a. The existing building is over allowable area, type of construction and number of stories. Uniform Building Code 3403.2 states in part " Any building plus new additions shall not exceed the height, number of stories and area specified for new buildings. " As such, the existing building must be brought up to current code for the items mentioned. Also the city has adapted Section 1306 ofthe Minnesota State Building Code which states that buildings increased in floor area shall be equipped with a fire suppression system. b. Architect inquired as to the possibility of deferring MSBC Minnesota Accessibility Code 1341.0405, Item E which states a passenger elevator serve the second story of the addition. Architect requested that it be deferred to the next phase of the building, stated cost as single factor for request. I have checked with State Building Code Division for history and guidance. Division indicated no precedence for this course of action. Handicap access to the second floor is required. This is a preliminary review on concept plans only. Other code items will be addressed when the preliminary plans are submitted. The building plans must be reviewed by the Cites Developmental Review Committee (DRC) which consists of representatives of Planning, Engineering, Parks, Finance, and Building Departments.
