Prior Lake, MN 55372 RE: 4034 Roanoke St. SE Grading Permit Status Dear Mr. Kuenzel: The City of Prior Lake has completed a review of the supplemental information submitted to the City by your engineer, Kevin Lienau of EnecoTech on 10/12/04. Based on the information provided we have determined the following: 1) Even though your riprapping of the channel did reduce the cross-sectional area of the channel it did not change the overall hydraulic control points in the channel. Your engineers's calculations show that the channel capacity immediately west of your property is less than your segment by 20 cfs for the lO-year critical duration storm event. We have field verified this and feel that your consultants calculations seem reasonable. Additionally there appear to be segments of channel upstream of your property that may also restrict flows. 2) The hydraulic control point for the channel flood plain elevations continues to be the outlet culvert under Dunkirk A venue. While your activity has resulted in fill in the 100- year flood plain, the City's previous topo maps indicate that the amount appears to be small and should not have a detectable impact on upstream properties. The 2 and 10- year flood plain elevations do not appear to have been impacted by your activities. 3) Velocities appear to have increased slightly. However we have inspected the area and do not see any noticeable erosion issues due to velocities downstream of your property. Based on the above findings and information submitted by your consultant I am authorizing approval of your after-the-fact grading permit. Please understand that we take un-permitted filling activities in wetlands/shoreland district that could potentially impact a major City drainage channel very seriously. You had indicated that you would contact the City attorney regarding the injunction "issue" regarding this project. As I have not seen an e-mail, I'm wondering if this has taken place. I would like to let my clients know that this first step has occurred. Additionally, I'm still interested in whether or not any construction easements were utilized for the project. It know if a "right of entry" was provided by the Kuenzels. that you were going to check with your attorney to see if existed. temporary or would be helpful to You had indicated this information In looking through the information provided by the City to the Kuenzels, I'm having a difficult time determining what the utimate required creek flow would be through the Kuenzels lot based upon the "modeling" completed by the city. Any summary of this information, assumptions, and the anticipated flows through this area would be helpful so that we are both on the same page. Based on this information, I'd like to meet with you and discuss the situation. I've reviewed the information provided to the Kuenzels (primarily the drawings) and the pictures that were taken by the Kuenzels and visually it doesn't look like Mr. Kuenzels work constricted the stream channel much, if at all. Again, I'm going off of before and after pictures and the construction drawings, but it looks like they extended the southern wall upward more so than into the stream bed. Again, I think this would be where a meeting between us would be beneficial before any surveying and/or final calculations are completed. Thanks again for your assistance on this issue. Again, it is my and the Kuenzels intent to work with the City in order to come to a good endpoint for all parties. First of alii spoke to Lani one of the city engineers about doing boulders along the creek on my property because of the erosion that was happening to my property. He told me that the city was proposing to bid out work to correct to creek issue. So the Cates Creek project went out to bid and from the information that I received there were 3 bids, the first was some where over $35,000 the second some where over $30,000 and the last just over $16,000 and who do you think the city council awarded the job to. Lyods Excavating won the bid. \M1en they Lyods excavating started the boulder work on my property my wife called and said that it does not look right, so I left my job and came home and it was terrible. It was as if they backed a dump truck full of random boulders up and dumped it and started pushing them around. At that time I called Lani the city engineer and I belive nathan was who also came out. \M1en the the of us were talking about the construction of the creek the employee of Lyods Excavating said Ive never done bouler work before and I just walked away. Lani knew my frustration and I had suggested that Lyods Excavating would just get the same sized boulders there and do what they had to do to complete the project that I would reconstruct the boulder work along the creek and he agreed that would be fine. I have photos of all of the areas that failed along the creek because of the work that Lyods Excavating performed. So since I have noting better to do I start to correct the poor workmanship of Lyods Excavating and of course some one call the City and we all know who that is. I belive it was nathan that came out and he informed me that I needed a grading permit, so I went down and talked to Sue McDermott, P.E. City Engineer and talked to her about and she was aware of the situation and said that she would not make me take out a grading permit, Nathan was also there at that conversation. So I continued to and fixed the street side of the creek. Then this year I started to fix the house side of the creek and again guess who called? And to my suprise Lani had left but now Sue is gone and now there is Steve Albrecht and he put a stop work order on my project which could have been completed but no. I am self employeed, I have a Construction and Landscaping Business and am very busy thats why I tried to start and complete the creek this spring. I have maybe had 10 days off since June and some of my day run 12 to 18 hours so no I have not had time to deal with this issue as fast as I would like to. I want it done so I can finish and sod my yard. Also I want to bring up the part about adverse impact on the channel 1m correcting a proplem that the city created and I have photos to prove it. How about restitution for my lobor hours and equipment hour and I do have documention and receipts of my hours, bobcat hours and backhoe rental. 8/10/04 Message Page 2 of2 f am still getting the necessary paper work together for this situation. I have met with City Engineer, Steve Albrecht, regarding the fact that you have moved or disturbed more than 10 cubic yards of material in the shoreland district without first obtaining an excavation and fill permit from the City. I understand that you submitted a permit to the City on May 3, 2004, which was denied because it did not contain all the information that is necessary for the City Engineer to determine whether a permit should be granted. On May 24, 2004, Mr. Albrecht wrote to you requesting that within 21 days "you remove the wall from the floodplain or provide the City with hydraulic calculations, signed by a registered professional engineer, that show that you have not negatively impacted the flow capacity of the channel or upstream properties with construction of the wall. I have reviewed the entire City file on your excavation and construction of a wall and what appears to be the construction of a stream on your property. The City has tried to work with you to obtain the information necessary to evaluate the required permit application. Despite the City's best efforts, you have failed to provide the information requested from you and it appears you may also be ignoring the Stop Work Order. You are in violation of Prior Lake City Code Section 1104 as noted in Mr. Albrecht's letter to you dated May 17, 2004. You have ignored Mr, Albrecht's letter to you dated May 24, 2004, wherein you were given 21 days to provide information to process an excavation and grading permit. You continue to work on your project which may be negatively impacting the channel and upstream property owners. Since the City's attempts to work cooperatively with you have been ignored this matter has been referred to me. I have two options. The first option is to direct the City to issue you a misdemeanor violation. The second option I have is to seek authority from the City Council to bring a civil action against you, seeking an injunction, restitution and City costs and attorneys fees. It might be helpful for you to know that I only seek authority to seek an injunction when all efforts to work with the property owner have failed and the situation is egregious. What happens next is totally within your control. Please comply in all respects to Mr. Albrecht's letter of May 24, 2004, by Thursday, August 12, 2004. This order has been rescinded as the activities completed on your property impacted less than 400 square feet of Type 3-4 wetland. Additionally the Prior Lake Spring Lake Watershed District has indicated verbally to me that they will not require a permit for the activities. The permit you submitted to the City on May 3rd has been denied due to insufficient information and the "Stop Work Order" issued to your property on April 30, 2004 will remain in effect. At this time the City is requesting that within 21 days you remove the wall from the floodplain or provide the City with hydraulic calculations signed by a registered professional engineer that show that you have not negatively impacted the flow capacity of the channel or upstream properties with construction of the wall. The following is a discussion of the project along with fmdings based on my reVlew. BacklIToundJDescriotion: On April 30, 2004 the City received a complaint indicating that grading was occurring in the un- named channel south of Green Heights Trail. City Staff investigated the site and noted that you were constructing a retaining wall in.or along the edge of the channel and had place fill in the watercourse. We notified you that you needed to stop work~because sediment was flowing from your site directly into Prior Lake as a result of the disturbance. Additionally we notified you that a City Excavating/Filling Permit for the work was required and that a DNR or Wetland Conservation Act (WCA) permit may also be required. A "Stop Work Order" was issued on April 30, 2004 and a WCA "Cease and Desist Order" was issued on May 3, 2004 for the above described activities. Findings: 1) More than 10 c.y. of material was moved or disturbed in the shore land district thus requiring an excavation and fill permit from the City under section 1104 of the City Code. 2) DNR has reviewed the case and determined that the channel flowing through your property is not under their jurisdiction and therefore does not require a DNR Protected Waters Permit. Jurisdiction of this activity falls under the WCA. 3) This activity may be covered under the De minimis Exemption to the WCA. This eX':'wpt~on allows for filling of up to 400 square feet of Type 3, 4 or 5 wetlands in a shoreland zone. This alteration, which has decreased the cross-sectional flow area for the channel, may require a Watershed Permit. As previously noted you submitted an after-the-fact permit application to the City on 5/03/04. The application ~ubmitted to the City did not provide any sketches or information showing the amount of fill, area of fill or changes to the channel. Pictures taken during the activity by our department indicate that the channel cross-sectional area has changed. The City of Prior Lake "Stop Work" and WCA "Cease and Desist" orders will remain in effect until we have determined that no mitigative measures are required and a permit has been issued. I anticipate being able to issue an approval or denial of the permit on May 20, 2004 after meeting with the SWCD and BWSR to determine the exemption status. Please maintain erosion control on the site. I apologize for the delay, but because this activity was completed without a permit and involves several agencies the review process has been extended.
