MOTION BY ERICSON, SECOND BY GUNDLACH TO AMEND SECTION 1106A.400 TO APPLY ONLY TO DISTRICTS R-2, R-3, R-4 and C-3. A friendly amendment was offered to delete the second sentence on page 2 under section 11 06A.400. The motion and second accepted the amendment. MADER: Commented that he has mixed feelings about the amendment because the change would in effect prohibit the Crystal Care development on the property adjacent to the Park Nicollet facility. It would be a very positive project. Would support the motion limiting the overlay, but would ask the Council to consider and expect that a re-zoning application for the Crystal Care project would be forthcoming. GUNDLACH: Advised that the only commercial district that the overlay would only apply in would be Downtown. Suggested the property would need to be re-zoned for the Crystal Care project on that site. Further commented that it wasn't his intention to kill any particular project. ERICSON: Commented that he is suggesting this action with no particular project in mind and believed that is how any zoning ordinance change should be approached. VOTE: Ayes by Mader, Gundlach, Petersen and Ericson, the motion carried. . 15 MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT SEPTEMBER 5, 2000 9D JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF ORDINANCE OO-XX APPROVING A ZONE CHANGE TO THE R-l DISTRICT ON THE PRIOR LAKE BAPTIST CHURCH FOR PROPERTY LOCATED AT 5680 AND 5690 CREDIT RIVER ROAD (Case File #00-053) History: Prior Lake Baptist Church and Judith Anderson have filed an application for a Zone Change for the property located at 5680 and 5690 Credit River Road. The request is to rezone the property from the 1-1 (General Industrial) District to the R-l (Low Density Residential) District. The Planning Commission reviewed this request at a public hearing on August 14,2000. The Commission voted to recommend approval of this rezoning on the basis that the property is currently zoned incorrectly due to the existing use of the site. The Planning Commission also initiated an amendment to the Comprehensive Plan to designate this property for Low to Medium Density Residential uses. This designation would be consistent with the existing use ofthe property and the proposed zoning. A copy of the draft minutes of the Planning Commission meeting of August 14,2000, are attached to this report. Current Circumstances: This property is the site of a single family home and the Prior Lake Baptist Church. Both the house and the church have existed on the site for more than 20 years. Prior to 1999, the property was zoned C-l (Conservation). Churches and single family dwellings were a permitted use in that district. When the current Zoning Ordinance was adopted, the C-l District was eliminated. This property was rezoned to the 1-1 District, in conformance with the Comprehensive Land Use Plan. To the north and west are industrial buildings, zoned 1-1 and planned for Industrial uses. To the south, across CSAH 21, is the City maintenance building and other office/industrial uses, zoned C-5 (Business Office Park) and planned for Business Office Park Uses. This property is currently designated for Planned Industrial uses on the 2020 Comprehensive Plan Land Use Map. The existing use is inconsistent with the Comprehensive Plan Land Use designation. The Planning Commission initiated an amendment to the Comprehensive Plan Land Use Map so the proposed zoning will be consistent with the Land Use Plan designation. The Issues: Section 1108.600 of the Zoning Ordinance identifies the following policies for amendments to the Official Zoning Map: ~ The area, as presently zoned, is inconsistent with the policies and goals of the Comprehensive Plan, or the land was originally zoned erroneously due to a technical or administrative error, or ~ The area for which rezoning is requested has changed or is changing to such a degree that it is in the public interest to rezone so as to encourage redevelopment of the area, or ~ The permitted uses allowed within the proposed Use District will be appropriate on the subject property and compatible with adjacent properties and the neighborhood. It appears this property has been improperly zoned because its actual use is and has been residential in nature. With the proposed rezoning, the existing uses would conform to the provisions of the Zoning Ordinance. The proposal would also allow further investment in this property. Conclusion: The proposed R-l district is consistent with the existing use of this site. In order to ensure the zoning is consistent with the Land Use Plan, the Planning Commission has initiated an amendment to the Comprehensive Plan. Therefore, the Planning Commission and the staff recommend approval of this request. Budf!et Impact: There is no direct budget impact involved in this request.
