Prior Lake Baptist Church is hereby requesting a rezoning of their current property and
the property adjacent to them from Industrial (1-1) to Residential (R-l). They would like
to have the opportunity to purchase the adjacent homeowner's property at some future
time and add onto their current church building. It is their understanding that a change in
zoning would allow them to do that.

AN ORDINANCE AMENDING SEcrION 1101.700 OF PRIOR LAKE CITY CODE AND
THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE
The City Council of the City of Prior Lake does hereby ordain:
1. The Prior: Lake Zoning Map, referred to in Prior Lake City Code Section 1101.700, is hereby
amended to change the zoning classification of the following legally described property from
1-1 (General Industrial) to R-l (Low Density Residential) .
LEGAL DESCRIPTION:

MOTION BY GUNDLACH, SECOND BY PETERSEN, TO APPROVE ORDINANCE 00-20 AMENDING
THE ZONING ORDINANCE TO CREATE AN OVERLAY DISTRICT FOR THE DEVELOPMENT OF
SENIOR CARE FACILITIES.
MOTION BY ERICSON, SECOND BY GUNDLACH TO AMEND SECTION 1106A.400 TO APPLY
ONLY TO DISTRICTS R-2, R-3, R-4 and C-3.
A friendly amendment was offered to delete the second sentence on page 2 under section 11 06A.400.
The motion and second accepted the amendment.
MADER: Commented that he has mixed feelings about the amendment because the change would in
effect prohibit the Crystal Care development on the property adjacent to the Park Nicollet facility. It
would be a very positive project. Would support the motion limiting the overlay, but would ask the
Council to consider and expect that a re-zoning application for the Crystal Care project would be
forthcoming.
GUNDLACH: Advised that the only commercial district that the overlay would only apply in would be
Downtown. Suggested the property would need to be re-zoned for the Crystal Care project on that site.
Further commented that it wasn't his intention to kill any particular project.
ERICSON: Commented that he is suggesting this action with no particular project in mind and believed
that is how any zoning ordinance change should be approached. It is necessary to have commercial
areas available for commercial measures.
VOTE ON AMENDMENT: Ayes by Mader, Gundlach, Petersen and Ericson, the motion carried.
VOTE ON PRIMARY MOTION AS AMENDED: Ayes by Mader, Gundlach, Petersen and Ericson, the
motion carried.

MOTION BY PETERSEN, SECOND BY GUNDLACH TO APPROVE ORDINANCE 00-21 APPROVING
A ZONE CHANGE TO THE R-1 DISTRICT OF THE PRIOR LAKE BAPTIST CHURCH FOR

MADER: Asked if a proposed change to the Comprehensive Plan would follow and if there was a
procedure for changing one before the other.
RYE: Confirmed that a Comprehensive Plan amendment request would follow, but that there is no
preference or procedure for making the zoning change or Comprehensive Plan change in any
particular order.

CONSIDER APPROVAL OF ORDINANCE OO-XX APPROVING
A ZONE CHANGE TO THE R-l DISTRICT ON THE PRIOR
LAKE BAPTIST CHURCH FOR PROPERTY LOCATED AT
5680 AND 5690 CREDIT RIVER ROAD (Case File #00-053)
History: Prior Lake Baptist Church and Judith Anderson have filed an
application for a Zone Change for the property located at 5680 and
5690 Credit River Road. The request is to rezone the property from
the 1-1 (General Industrial) District to the R-l (Low Density
Residential) District.
The Planning Commission reviewed this request at a public hearing on
August 14,2000. The Commission voted to recommend approval of
this rezoning on the basis that the property is currently zoned
incorrectly due to the existing use of the site. The Planning
Commission also initiated an amendment to the Comprehensive Plan
to designate this property for Low to Medium Density Residential
uses. This designation would be consistent with the existing use ofthe
property and the proposed zoning. A copy of the draft minutes of the
Planning Commission meeting of August 14,2000, are attached to this
report.
Current Circumstances: This property is the site of a single family
home and the Prior Lake Baptist Church. Both the house and the
church have existed on the site for more than 20 years. Prior to 1999,
the property was zoned C-l (Conservation). Churches and single
family dwellings were a permitted use in that district. When the
current Zoning Ordinance was adopted, the C-l District was
eliminated. This property was rezoned to the 1-1 District, in
conformance with the Comprehensive Land Use Plan. At that time,
the existing use of the property became nonconforming.

FISCAL IMPACT:
ALTERNATIVES:
Adjacent to this site on the east is vacant land, zoned R-l and planned
for Low to Medium Density Residential Uses. To the north and west
are industrial buildings, zoned 1-1 and planned for Industrial uses. To
the south, across CSAH 21, is the City maintenance building and other
office/industrial uses, zoned C-5 (Business Office Park) and planned
for Business Office Park Uses.
This property is currently designated for Planned Industrial uses on the
2020 Comprehensive Plan Land Use Map. The existing use is
inconsistent with the Comprehensive Plan Land Use designation. The
Planning Commission initiated an amendment to the Comprehensive
Plan Land Use Map so the proposed zoning will be consistent with the
Land Use Plan designation.
The Issues: Section 1108.600 of the Zoning Ordinance identifies the
following policies for amendments to the Official Zoning Map:
~ The area, as presently zoned, is inconsistent with the policies and
goals of the Comprehensive Plan, or the land was originally zoned
erroneously due to a technical or administrative error, or
~ The area for which rezoning is requested has changed or is
changing to such a degree that it is in the public interest to rezone
so as to encourage redevelopment of the area, or
~ The permitted uses allowed within the proposed Use District will
be appropriate on the subject property and compatible with
adjacent properties and the neighborhood.
It appears this property has been improperly zoned because its actual
use is and has been residential in nature. With the proposed rezoning,
the existing uses would conform to the provisions of the Zoning
Ordinance. The proposal would also allow further investment in this
property.
Conclusion: The proposed R-l district is consistent with the existing
use of this site. In order to ensure the zoning is consistent with the
Land Use Plan, the Planning Commission has initiated an amendment
to the Comprehensive Plan. Therefore, the Planning Commission and
the staff recommend approval of this request.
Budf!et Impact: There is no direct budget impact involved in this
request.
The City Council has three alternatives:

with findings of fact.
The staff recommends Alternative # 1.
A motion and second to adopt Ordinance OO-XX rezoning this
property to the R -1 (Low Density Residential) district is required.
This action requires approval by 4/5 vote of the City Council.

from the current General Industrial (1-1) District to the Low Density
Residential (R-l) District for the property located at 5680 and 5690 Credit
River Road.
Planning Coordinator Jane Kansier presented the Planning Report dated August 14,2000,
on file in the office ofthe City Planning Department.
Prior Lake Baptist Church and Judith Anderson have filed an application for a Zone
Change for the property located at 5680 and 5690 Credit River Road. The request is to
rezone the property from the I-I (General Industrial) District to the R-l (Low Density
Residential) District.
This property is the site of a single family home and the Prior Lake Baptist Church. Both
the house and the church have existed on the site for more than 20 years. Prior to 1999,
the property was zoned C-l (Conservation). Churches and single family dwellings were a
permitted use in that district. When the current Zoning Ordinance was adopted, the C-l

with the Comprehensive Land Use Plan. At that time, the existing use of the property

Staff recommended approval of the zoning change as requested. It appears this property
has been improperly zoned because of its actual use is and has been residential in nature.
With the proposed rezoning, the existing uses would conform to the provisions of the
Zoning Ordinance.
Comments from the public:
Scott Crosby, the architect for the Prior Lake Baptist Church, explained they would like
to have the zoning changed to make possible future additions by the church.

Prior Lake Baptist Church and Judith Anderson have filed an application for a Zone
Change for the property located at 5680 and 5690 Credit River Road. The request is to
rezone the property from the 1-1 (General Industrial) District to the R-1 (Low Density
Residential) District.
SITE CHARACTERISTICS:
Existin2 Use: This property is the site of a single family home and the Prior Lake
Baptist Church. Both the house and the church have existed on the site for more than 20
years. Prior to 1999, the property was zoned C-1 (Conservation). Churches and single
family dwellings were a permitted use in that district. When the current Zoning
Ordinance was adopted, the C-1 District was eliminated. This property was rezoned to
the 1-1 District, in conformance with the Comprehensive Land Use Plan. At that time,
the existing use ofthe property became nonconforming.
Adjacent Land Use, Zonin2 and Comprehensive Plan Desb~nation: The property to
the east is vacant land, zoned R-1 and planned for Low to Medium Density Residential
Uses. To the north and west are industrial buildings, zoned 1-1 and planned for Industrial
uses. To the south, across CSAH 21, is the City maintenance building and other
office/industrial uses, zoned C-5 (Business Office Park) and planned for Business Office
Park Uses.
Comprehensive Plan Desi2nation: This property is designated for Planned Industrial
uses on the 2020 Comprehensive Plan Land Use Map. The existing use is inconsistent
with the Comprehensive Plan Land Use designation.

ANALYSIS:
Section 1108.600 of the Zoning Ordinance identifies the following policies for
amendments to the Official Zoning Map:
. The area, as presently zoned, is inconsistent with the policies and goals of the
Comprehensive Plan, or the land was originally zoned erroneously due to a technical
or administrative error, or
. The area for which rezoning is requested has changed or is changing to such a
degree that it is in the public interest to rezone so as to encourage redevelopment of
the area, or
. The permitted uses allowed within the proposed Use District will be appropriate on
the subject property and compatible with adjacent properties and the neighborhood.
It appears this property has been improperly zoned because its actual use is and has been
residential in nature. With the proposed rezoning, the existing uses would conform to the
provisions of the Zoning Ordinance. The proposal would also allow further investment in
this property.
The Comprehensive Land Use Plan designation is also in conflict with the existing use.
If the Planning Commission feels the rezoning should be approved, a motion and second
initiating an amendment to the Land Use Plan would also be appropriate.
ALTERNATIVES:
1. Recommend approval of the Zone Change as requested.
2. Recommend denial of the request.
3. Other specific action as directed by the Planning Commission
RECOMMENDATION:
The Planning staff recommends Alternative #1.
ACTION REQUIRED:
The following motions are appropriate for this action:
1. A motion and second to recommend approval of the Zone Change from the 1-1
(General Industrial) district to the R-l (Low Density Residential) district is required.
2. A motion and second to initiate an amendment to the Comprehensive Land Use Plan
Map from the I-PI (Planned Industrial) to the R-L/MD (Low to Medium Density

The DRC will now begin formal review of these requests. At this time, you are tentatively
scheduled for the August 14, 2000, Planning Commission meeting. I will notify you of any
changes to that date.
The City review process can be substantially less than 120 days, and we intend to move this
matter through the process in a timely manner which provides a complete, professional review.
Occasionally, however, due to meeting schedules, it is sometimes necessary to extend the 60 day
review period. This letter also serves as your official notice that the City is extending the 60 day
deadline for an additional 60 days from September 14, 2000 to November 14, 2000.
