FAMILY DWELLING, A 6.6 FOOT VARIANCE FROM THE REQUIRED 20 FOOT
FRONT YARD SETBACK, AND A 7.1 FOOT VARIANCE FROM THE REQUIRED 15

BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. David Huberty is requesting a variance from the Zoning Ordinance for the
construction of a single-family home on property zoned R-1 (Low Density
Residential) and SD (Shoreland Overlay District) at the following location, to wit;
3051 Spring Lake Road SW
Lot 31, and the West 6 feet of Lot 30 of SUNSET SHORE, Scott County,
Minnesota.
2. The Board of Adjustment has reviewed the application for the variance as contained
in Case #05-191 and held a hearing thereon on September 12, 2005.
3. The Board of Adjustment has considered the effect of the proposed variance upon
the health, safety, and welfare of the community, the existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, the effect on
property values in the surrounding area and the effect of the proposed variance on
the Comprehensive Plan.
4. The granting of the variance will not impair an adequate supply of light or air to
adjacent properties, or negatively impact public safety.
5. The granting of the variance is necessary for the preservation and enjoyment of a
reasonable use of the property.
6. The granting of the variances is not merely to serve as a convenience for the
applicant, but is necessary to alleviate a demonstrable undue hardship or difficulty.
Due to the size and constraints of the lot there are no legal alternatives for the
construction of a dwelling without variances.
7. Relief from the provisions of the Zoning Ordinance will not unreasonably impact the
character and development of the Sunset Shore neighborhood.

8. The variance is consistent with the intent of the Zoning Ordinance and the
Comprehensive Guide Plan.
9. The contents of Planning Case #05-191 are hereby entered into and made a part of
the public record and the record of decision for this case.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby approves the
following variances to allow for the construction of a single family home, as shown on
Exhibit A- Certificate of Survey:
1. A 6.6 foot variance from the required 20 foot front yard setback (Section
1102.405(4)).
2. An 11.9% percent variance from the 30 percent maximum impervious surface
coverage (Section 1104.306).
3. A 33 foot variance from the required 50 foot ordinary high water elevation
setback (Section 1104.302(4)).
4. A 7.1 foot variance from the required 15 foot side yard setback (Section
1101.502(8)).
The variance is subject to the following conditions:
1. The resolution must be recorded at Scott County within 60 days of
adoption. Proof of recording, along with the acknowledged City Assent
Form, shall be submitted to the Planning Department prior to the
issuance of a building permit.
2. The building permit is subject to all other applicable city, county, and
state agency regulations.

Dear Mr. Huberty,
In the fall of 2007 a grading issue had come to the Cities attention, the grading problem is located on the
West edge of your property. Building permit # 05-1065 was issued on October 21, 2005 to Dahle Bros.
Construction to erect your Single Family House. City Staff met with Bob Kissell in October of 2007 at
the site to discuss the grading issue.
As you are aware there is street drainage water that drains from the street in front of your house onto
your driveway and the water travels westward around the West side of your house. Presently the
drainage water travels to the property to the West and then flows into the lake. The approved survey for
the building permit indicated that a drainage swa1e be graded onto the West side of your property to
remove move the water from your driveway to the lake. This swale was not installed before the sod was
established on the side of the house. The swale needs to be installed to provide proper drainage to the
lake. Dahle Bros. has attempted to contact you regarding the re-grading on your property to no avail. In
an effort to expedite the grading on the side of your house, the City is planning to stake the West side of
your property on Tuesday May 20th or Wednesday May 21S\ 2008. This will ensure proper re-grading
work that Dalhe Bros. will physically complete. Dahle Bros. will be moving dirt the area on Wednesday
May 21st, 2008 or on Thursday May 22nd, 2008. The disturbed ground area will be re-sodded in a short
time after that by Dahle Bros. The re-sodding will replace that turf that was there and it also prevents silt
erosion into the lake.
Once the Scott County Road 12 street project slated to be complete in 2010, the amount of water that
drains into your lot will be substantially decreased. Dahle Bros. will rework the grading on the West side
of your property to match the approved survey that was approved with the building permit. They plan on
proceeding with the re-grading next week. Hopefully it will not rain next week so the work can proceed.
If there is a rain event, Dahle Bros. will have to reschedule at a later date. If there are any questions,
