331)'9.8 Regular Grading Requirements. Each application for
a g:r~ding permit shall be accompanied by Ii plan in sufficient clar-
ity to indicate the nature and extent of the work. The plans shall
give the location of the work, the name of the owner and the name
of the person who prepared the plan. The plan shall include the fol-

1.. General vicinity of the proposed site.
2:. Limiting dimensions and depth of cut and fill.
:3. Location of anybuildin'~s or structures where work is to be .",
performed, and the location of any buildings or structures within
15 feet (4572 mm) of the proposed grading.
33()_'.9 Issuance. The provisions of Section 106.4 are applicable
to g:r;ading permits. The building official may require that grading
opeGltions and project designs be modified if delays occur which
incllLweather-generated problems not considered at the time the
perJJll.it was issued.
TIl e building official may require professional inspection and
testiag by the soils engineer. When the building official has cause
to believe that geologic factors may be involved, the grading will
be re<<{lIired to conform to engineered grading.

SECTION 3310 - GRADING FEES
3310.1 General. Fees shall be assessed in accordance with the
provisions of this section or shall be as set forth in the fee schedule
adopted by the jurisdiction.
3310.2 Plan Review Fees. When a plan or other data are re-
quired to be submitted, a plan review fee shall be paid at the time of
submitting plans and specifications for review. Said plan review
fee shall be as set forth in Table A-33-A. Separate plan review fees
shall apply to retaining walls or major drainage structures as re-
quired elsewhere in this code. For excavation and fill on the same
site, the fee shall be based on the volume of excavation or fill,
whichever is greater.
3310.3 Grading Permit Fees. A fee for each grading permit
shall be paid to the building official as set forth in Table A-33-B.
Separate permits and fees shall apply to retaining walls or major
drainage structures as required elsewhere in this code. There shall
be no separate charge for standard terrace drains and similar facili-
ties.

Project Description
Place fill QJ1 property located at 15156 Fish Point Road and adjoining property 15170
Fish Point Road to fill in low point created by previous owner. Previous owner
excavated many years ago to create a lagoon. He has since repaired at the lake and has
put sod on property but there is still a noticeable dip in the backyard. I would like to fill
in the dip and have a level yard. I am proposing to bring the 904 back to the shore and
then re-grade with the neighbors current 906,908 and 910.

Dear Mr. Eisma:
The St. Paul District, U.S. Army Corps of Engineers has received information from the
Minnesota Department of Natural Resources about your landscaping project that would involve
the placement of fill material over and area about 7,500 square feet in your backyard. The project
location is adjacent to Lower Prior Lake in the NE1/4 of the NW1/4 of Section 36, Township
115 North, Range 25 West, Scott County.
The work proposed at the location stated is not within the regulatory jurisdiction of the
Corps of Engineers. No work will be done in a navigable water of the United States, and no
dredged or fill material, including that associated with mechanical land clearing, will be
discharged in any water of the United States, including wetlands. Therefore, a Department of the
Army permit is not required to do this work.
This letter is valid only for the project referenced above. If any change in design,
location, or purpose is contemplated, contact this office to avoid doing work that may be in
violation of Federal law. PLEASE NOTE THAT THIS CONFIRMATION LETTER DOES
NOT ELIMINATE THE NEED FOR STATE, LOCAL, OR OTHER AUTHORIZATIONS,

City staff has reviewed the proposed permit for fill at the above site. Technically, most
of the fill will take place below the OHW. However, since this fill will impact the lot and
future drainage, we will also ask the applicant to obtain a grad.ing permit from the City
before any work is done on the site. As part of this permit, we will need the following
information:
1. A survey showing the existing contours, trees and other features.
2. A plan identifying the proposed contours and drainage patterns.

8. In all cases where the permittee by performing the work authorized by this permit shall involve the taking, using, or
damaging of any property rights or interests of any other person or persons, or of any publicly owned lands or
improvements thereon or interests therein, the permittee, before proceeding, shall obtain the written consent of all
persons, agencies, or authorities concerned, and shall acquire all property, rights, and interests needed for the work.
9. This permit is permissive only. No liability shall be imposed by the State of Minnesota or any of its officers, agents or
employees, officially or personally, on. account of the granting hereof or on account of any damage to any person or ,
property resulting from any act or omission of the permittee or any of its agents, employees, or contractors. This permit
shall not be construed as estopping or limiting any legal claims or right of action of any person other than the state
against the permittee, its agents, employees, or contractors, for any damage or injury resulting from any such act or
omission, or as estopping or limiting any legal claim or right of action of the state against the permittee, its agents,
employees, or contractors for violation of or failure to comply with the permit or applicable provisions of law.
10. Any extension of the surface of protected waters from work authorized by this permit shall become protected waters and
left open and unobstructed for use by the public.
11. Where the work authorized by this permit involves the draining or filling of wetlands not subject to DNR regulations, the
permittee shall not initiate any work under this permit until the permittee has obtained official approval from the
responsible local government unit as required by the Minnesota Wetland Conservation Act.
12. The perimeter of the fill area shall be protected with silt fence to minimize sedimentation.
13. Upon completion of the authorized work, the permittee shall submit representative photographs and any as-built surveys,
as appropriate, of the project area to DNR Metro Region Waters (1200 Warner Road, St. Paul, MN 55106).
14. The permittee shall obtain any local grading and filling permits from the City of Prior Lake before commencing placement
of fill or any other grading authorized under this permit.
15. Any trees larger than 6" in diameter removed by the grading and filling must be replaced at a ratio not less than 1: 1.
Replacement trees must be native species not less than 2.5" in diameter.
