RESOLUTION PROVIDING FOR THE VACATION OF A PORTION OF THE 25' WIDE DRAINAGE
AND UTILITY EASEMENT LOCATED ALONG THE SOUTH PROPERTY LINE OF LOT 17, BLOCK
1, NORTHWOOD OAKS ESTATES 2ND ADDITION

WHEREAS, a petition for the vacation of a portion of the 25' wide drainage and utility easement
located along the south lot line of Lot 17, Block 1, Northwood Oaks Estates 2nd
Addition, has been duly presented to the City of Prior Lake, signed by the owners
of the property abutting the following described easement situated in the City of
Prior Lake, Scott County, Minnesota to wit:
LEGAL DESCRIPTION:
The north 5.00 feet of the south 25.00 feet of Lot 17, Block 1, Northwood Oaks
Estates 2nd Addition, except the westerly 10.00 feet and the easterly 10.0 feet
thereof;
and
WHEREAS, notice of the hearing on said petition has been duly published and posted in
accordance with the applicable Minnesota Statutes, and
WHEREAS, a Public Hearing was held on said petition on Monday, October 16, 2000, at 7:30
p.m. in the Council Chambers at the Prior Lake Fire Station #1; and
WHEREAS, the City Council then proceeded to hear all persons interested in said petition and
persons interested afforded the opportunity to present their views and objections to
the granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the vacation of said easement
would be in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that pursuant to
Minnesota Statues 412.851, the following described drainage and utility easement situated on Lot 17,
Block 1, Northwood Oaks Estates 2nd Addition, is hereby vacated:

Request for Vacation of Easement
We would like the City of Prior Lake to Vacate part of the easement on the South side of
Lot 17, Block 1, Northwood Oaks Estates Second Edition. The City currently has a 25-
foot easement on the south side of our lot and we request that this be changed to a 20-foot
easement, with the City vacating the Northern 5-feet of this easement.
This is a City Sewer easement and is greater than necessary for the sewer at this site.
Where our house would be located on the lot, the sewer is approximately 20 feet deep
(according to the records We have been shown at the City of Prior Lake Engineering
Department). The requirement for this type of easement is usually a 1: 1 slope on either
side of the sewer. This means that at the location of our proposed house, the easement
should be 20 feet. When the sewer was installed, there was a much steeper grade than
the 1: 1 that the city is now requiring and they only needed to dig about 10 feet into my lot
because the soil in that area is heavy clay, not a sandy soil base. This type of soil stays in
place very well when excavated.
Our house plans have the garage on that side of the lot, so there will not be a foundation
there.
We have been planning to build this house for months. We were not advised of this
easement until the survey was completed to apply for our building permit. We request
that the City issue a Vacation of the Easement and reduce the required easement to 20
feet.
We have contacted the owner of the adjacent lot (Kurt Larson, Lot 16, Block 1,
Northwood Oaks Estates Second Edition) in accordance with section D of the Submission
Requirements. Kurt is in agreement that a IS-foot easement would be acceptable and has
signed a document to that fact (see Attached).

PUBLIC HEARINGS:
Public Hearing to Consider Approval of a Resolution Vacating a Portion of the 25-Foot Wide
Drainage and Utility Easement Located on Lot 17, Block 1, Northwood Oaks estates 2"D
Addition.
PETERSEN: Declared the public hearing open.
BOYLES: Briefly reviewed the item in connection with the staff report.
No persons wished to address the Council on this item.
MOTION BY PETERSEN, SECOND BY ERICSON TO CLOSE THE PUBLIC HEARING.
VOTE: Ayes by Petersen, Gundlach, Ericson and Zieska, the motion carried.
GUNDLACH: Asked how often the City sees this type of request, and why the request was to vacate 5
feet rather than more.
McDERMOTT: Explained that a sewer line runs through the easement and requires a 1: 1 ratio for
maintenance access on each side of the property line (i.e. if the sewer is 24 feet deep, 24 feet of
access is required on each side of the line). The easement was originally 25 feet on each side of the
property line because the sewer was to be placed centered. During construction the sewer was placed
5 feet south of the property line. Therefore, the City is comfortable vacating a 5-foot strip, but no more.
MOTION BY ERICSON, SECOND BY ZIESKA, TO APPROVE RESOLUTION 00-108 VACATING THE

VOTE: Ayes by Petersen, Gundlach, Ericson and Zieska, the motion carried.
The next item on the agenda skipped to Item A of Old Business in order to
accommodate the scheduled time for the next public hearing.

Consider Approval of a Resolution Awarding Bid for Concession/Restroom Facility for Thomas
Ryan Memorial Park.
BOYLES: Reviewed the agenda item in connection with the staff report.
PETERSEN: Asked how long the bids are good for? Asked if the project can be re-bid with a general
contractor to possibly save money.
OSMUNDSON: Advised that the bids are good until 60 days from the bid date of September 27th.
Discussed the timeline and additional costs and process necessary to re-bid the construction of the
building.

History: Northwood Oaks Estates 2nd Addition was originally platted
in July, 2000. A 25' wide drainage and utility easement was platted
along the south property line of Lot 17, Block 1, to accommodate the
placement and maintenance of a sewer line. While the final plat
identified a 25' wide easement at this location, the construction plans
indicated a 20' wide easement.
Karl and Denise Tremmel are in the process of purchasing this lot.
The house they plan on the lot was based on the 20' wide easement
shown on the construction plans. The 25' wide easement was
discovered when the purchasers had a survey drawn to locate the house
on the lot. The applicants are requesting the vacation of 5' of the 25'
wide easement. The purpose of this petition is to allow the
construction of a new dwelling on this lot.
Current Circumstances: The Planning Commission reviewed this
vacation request on October 9,2000. The Planning Commission
recommended approval of the proposed vacation.
The Issues: Minnesota Statutes 412.851 allows the Council to vacate
easements or right-of-way by resolution. The statute states, "no such
vacation shall be made unless it appears to be in the public interest to
do so." The Comprehensive Plan does not specifically discuss utility
easements, other than as a function of ensuring access to public
utilities. The vacation of this easement is not inconsistent with any
specific goal or objective of the Comprehensive Plan. The City
Engineer has noted a 20' wide easement is sufficient for the location
and the maintenance of the existing sewer line.

There is an existing sanitary sewer line located within this easement.
As noted above, the City Engineer has noted a 20' wide easement is
sufficient for the location and the maintenance of the existing sewer
line. The approval of this vacation would allow the construction of a
new dwelling on this property.
Con('Im.:ion. The Planning Commission and the staff recommend
approval of the easement vacation.
The City Council has three alternatives:
1. Adopt a Resolution approving the vacation.
2. Direct staff to prepare a resolution denying the vacation.
3. Defer this item and provide staff with specific direction.
The Planning Commission and staff recommend Alternative #1. A
motion and second to adopt a Resolution approving the vacation of the
easement as requested is required.

Request for Vacation of Easement
We would like the City of Prior Lake to Vacate part of the easement on the South side of
Lot 17, Block 1, Northwood Oaks Estates Second Edi#on. The City currently has a 25-
foot easement on the south side of our lot and we request that this be changed to a: 20-foot
easement, with the City vacating the Northern 5-feet of this easement.
This is a City Sewer easement and is greater than necessary for the sewer at this site.
Where our house would be located on the lot, the sewer is approximately 20 feet deep
(according to the records We have been shown at the City of Prior Lake Engineering
Department). The requirement for this type of easement is usually a 1: 1 slope on either
side of the sewer. This means that at the location of our proposed house, the easement
should be 20 feet. When the sewer was installed, there was a much steeper grade than
the 1: 1 that the city is now requiring and they only needed to dig about 10 feet into my lot
because the soil in that area is heavy clay, not a sandy soil base. This type of soil stays in
place very well when excavated.
Our house plans have the garage on that side of the lot, so there will not be a foundation
there.
We have been planning to build this house for months. We were not advised of this
easement until the survey was completed to apply for our building permit. We request
that the City issue a Vacation of the Easement and reduce the required easement to 20
feet.
We have contacted the owner of the adjacent lot (Kurt Larson, Lot 16, Block 1,
Northwood Oaks Estates Second Edition) in accordance with section D of the Submission
Requirements. Kurt is in agreement that a 15-foot easement would be acceptable and has
signed a document to that fact (see Attached).

B. Case #00-076 Comprehensive Plan discussion regarding relocation of 20
acres of commercial property.
Planning Director Don Rye presented the Planning Report dated October 9, 2000, on file
in the office of the Planning Department.
The City Council recently approved a Comprehensive Plan amendment for Shepherd of
the Lake Church at McKenna Road and County Road 42. This amendment changed the
designation of 20 acres of property from Business Office Park to High Density
residential. Following this action, the Council directed staffto bring back an amendment
to the Planning Commission that would establish an additional 20 acres of commercially-
designated land elsewhere in the City.
Following a review ofthe available properties in the City, staff believes there are three
alternative locations where lands currently designated for residential use could be
considered for a change to a commercial designation. These areas were shown in the staff
report and overheads. The first area is located at the northeast comer of County Road 42
and County Road 21. Existing land use is three single family homes on large lots. The
second area is located on the northeast comer of County Road 42 and Pike Lake trail.
Existing land use is agricultural with an existing single family home. The third area is
located on the northeast comer of County Road 42 and County Road 18. Existing land
use is three single-family homes on large lots.

As required by State Statute 462.356 Subd.2, the Planning Commission is
required to make a recommendation to the City Council regarding the disposal or
acquisition of public lands as it relates to compliance with the Comprehensive
Plan.
Upon proper notification, State Statute 412.851 allows the Council to vacate
easement or right-of-way by resolution. The statute also states uno such
vacation shall be made unless it appears to be in the public interest to do so".
DISCUSSION
The Planning Commission must make two determinations. Does the vacation of
the existing easement comply with the Comprehensive Plan and is there a public
need or anticipated future need for the dedicated property?

Comprehensive Plan Review
The Comprehensive Plan does not specifically discuss utility easements, other
than as a function of ensuring access to public utilities. The vacation of this
easement is not inconsistent with any specific goal or objective of the
Comprehensive Plan. The City Engineer has noted a 20' wide easement is
sufficient for the location and the maintenance of the existing sewer line.
Public Need
There is an existing sanitary sewer line located within this easement. As noted
above, the City Engineer has noted a 20' wide easement is sufficient for the
location and the maintenance of the existing sewer line. The approval of this
vacation would allow the construction of a new dwelling on this property.
RECOMMENDATION
The intent of the Comprehensive Plan is satisfied by retaining 20' of the existing
easement. Furthermore, a 20' wide easement is sufficient to protect and
maintain the existing sanitary sewer line. The Planning staff therefore
recommends approval of this request.
ALTERNATIVES:
1. Recommend the City Council approve the proposed vacation of the
easement as presented or with changes recommended by the
Commission.
2. Continue the discussion to a date and time certain to allow the staff to
provide additional information specifically requested by the Planning
Commission.
3. Based upon expressed findings of fact, recommend the City Council deny
part or all of the applications based upon inconsistency of the proposal
with specific regulations of the Zoning and Subdivision Ordinances and/or
specific policies of the Comprehensive Plan.
RECOMMENDATION:
Alternative #1.

Dear Karl:
I have reviewed your house plans with Sue McDermott, City Engineer. We have
determined we will allow a 5" encroachment into the easement. While this
encroachment is not generally allowed, it will not adversely affect the City's interest in
this easement.
According to your letter, this will allow a 12" eave on your proposed home. You need
not submit a new survey; you must, however, submit a new house plan showing the
correct overhang.
