Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT MARCH 16, 2009 5H BILL O'ROURKE, CHIEF OF POLICE CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE PURCHASE OF A 2009 HARLEY -DAVIDSON POLICE MOTORCYCLE FROM FORFEITURE FUNDS Introduction The Police Department is asking for Council approval to purchase a 2009 Harley-Davidson Electra Glide Police Motorcycle from an account created through the sale of forfeited vehicles. Historv Since 2003, the Prior Lake Police Department has leased a Harley Davidson motorcycle for use in patrolling not only the roadways in town, but also the ever-increasing trail system as well. Through a special program with Harley Davidson, we were initially able to lease the motorcycle for $1 per year. Freight and setup, emergency equipment and manufacturer's recommended service intervals were additional. The $1 per year program ended in 2005. Since then the Police Department has leased a motorcycle for $125.00 per month ($1,500 per year) plus an annual fee of $999 for freight and switch over of the emergency equipment. For the past four years the total cost of the lease has been $10,000.00. Each year these funds have been a part of the general operating budget for the Police Department. Current Circumstances Minnesota Statutes authorized the administrative forfeiture of motor vehicles and other property used or related to the commission of designated offenses; for example, driving while under the influence (DWI), as well as prostitution and drug offenses. Property forfeited administratively may be kept by the law enforcement agency and used in the performance of official duties, or the property may be sold and the proceeds from the sale distributed to the appropriate law enforcement agency, the county attorney or other prosecuting agency that handled the forfeiture, and to the state. The proceeds forwarded to the appropriate law enforcement agency must be used to supplement the agency's operating fund for use in law .enforcement and/or DWI-related enforcement, training, and education. The Prior Lake Police Department recommends using funds from the forfeiture account to purchase a motorcycle rather than continue to incur monthly leasing fees and not having equity in the vehicle. As stated above, in just the past four years alone, we have spent $10,000.00 on leasing a motorcycle. We have received three purchase quotes for a 2009 Electra Glide with ABS brakes and two-tone paint. The bids are as follows: St. Paul Harley-Davidson $15,996.00 Twin Cities Harley-Davidson $15,999.00 Faribault Harley-Davidson $16,227.00 Even if the lease were to remain at its present $1,500.00 per year, when that is coupled with the annual freight and set-up charges we should see a return on investment in as little as eight years. Our intent is to retain the new motorcycle for at least ten years. The lease on our current motorcycle, a 2006 Harley-Davidson Road King, expires in June. Zylstra Harley-Davidson has quoted a buy-out price of $13,500.00. We are recommending the purchase of a new motorcycle rather than buying the one we are currently leasing because the new motorcycle will be a 2009 model, have the added safety feature of ABS brakes, but more importantly, being new it comes with a two year warranty. FINANCIAL IMP ACT: It is recommended that the funds allocated for this equipment purchase come from the forfeiture account and not from tax dollars. Currently, there are sufficient funds in the City's forfeiture account to cover this expense. AL TERNATIVES: 1. Approve Resolution 09-XXX authorizing an expenditure of up to $15,996.00 from the forfeiture account to purchase a 2009 Harley- Davidson police motorcycle from St. Paul Harley-Davidson. 2. Deny the approval and provide direction to staff. Vendor St. Paul Harley-Davidson Twin Cities Harley-Davidson Faribault Harley-Davidson $15,996.00 $15,999.00 $16,227.00 NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1) The recitals set forth above are incorporated herein. 2) The Police Department is authorized to purchase a 2009 Harley-Davidson police motorcycle for a price not to exceed $15,996.00 from St. Paul Harley-Davidson. 3) Funding for this purchase is to be drawn from the forfeiture account as authorized by state statute for such purposes.
