Prior Lake, MN 55372-1714 RESOLUTION 09-039 RESOLUTION APPROVING A PROPOSED AMENDMENT TO THE 2030 COMPREHENSIVE PLAN LAND USE MAP FOR PROPERTIES LOCATED AT 6880 BOUDIN STREET, 14291 TIMOTHY AVENUE AND 14311 TIMOTHY AVENUE MOTION BY: Hedberg SECOND BY: Millar WHEREAS, EFH Realty Advisors, Inc. submitted an application for an amendment to the City of Prior Lake 2030 Comprehensive Plan Land Use Map to change the designation of property located at 6880 Boudin Street, 14291 Timothy Avenue, and 14311 Timothy Avenue from an R-LD (Urban Low Density) designation to a C-CC (Commercial Retail Shopping Commercial) designation. WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS, The Planning Commission conducted a public hearing on March 9, 2009, for those interested in this request to present their views; and WHEREAS, The Planning Commission recommended approval of the proposed amendment to the Comprehensive Plan on the basis the C-CC designation is consistent with the goals and objectives of the Comprehensive Plan; and WHEREAS, On April 6, 2009, the Prior Lake City Council considered the proposed amendment to the 2030 Comprehensive Plan Land Use Map to designate the above described property to the C-CC designation and; WHEREAS, The City Council received the recommendation of the Planning Commission to approve the proposed Comprehensive Plan amendment along with the staff reports; and WHEREAS, The City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. The recitals set forth above are incorporated herein. 2. The proposed amendment to the 2030 Comprehensive Plan Land Use Map to designate the above described property as C-CC (Commercial Retail Shopping Commercial) is hereby approved. Approval of this amendment is subject to the approval of the Metropolitan Council. (Note: Resolution 09-039 passed originally on March 16, 2009, was reconsidered and amended on April 6, 2009).
