CONSIDER APPROVAL OF A TWO RESOLUTIONS APPROVING:
1. THE PLANS AND SPECIFICATIONS AND COOPERATIVE AGREE-
MENT WITH SCOTT COUNTY FOR CR 21 EXTENSION
2. THE COOPERATIVE AGREEMENT FOR THE CR 21 TRANSIT STA-
TION
Introduction
The purpose of this agenda item is to seek approval two resolutions related
to the CR 21 Extension Project.
Historv
On December 1, 2009 the City Council approved the design and layout for
the extension of CR 21 between CR 42 and CR 16.
Current Circumstances
The final design for CR 21 Extension Project has been completed. Based
on the final design a cost sharing agreement for the project has been de-
veloped for the roadway construction project and transit station project.
CR 21 Extension
The final plans and specifications have been completed in accordance with
the layout and design approved by the City Council. The Cooperative
Agreement is in the standardized format that has been previously ap-
proved by our City Attorney and used on several projects.
The County anticipates beginning tree removal in early April. The initial
bidding of the project for grading is expected in Mayor early June. This
project is expected to be substantially completed in late 2011.
Prior to bidding the project the County requires that the City approve a Co-
operative Agreement that details the estimated costs that the City will be
responsible for. A separate maintenance agreement will be entered into in
the future to determine responsibility for various items such as trails and
stormwater ponds. The County also requires that the City Engineer sign
the final plans and therefore final plan approval by the City Council is also
required.
CR 21 Transit Improvements
The CR 21 project includes two transit improvements. The first is a bus-
only ramp from Stagecoach Road to TH 169. The second transit im-
provement is a new regional park and ride facility, known as the Eagle

been completed in accordance with the layout and design approved by the
City Council.
Prior to bidding the project the County requires the City approve a Coop-
erative Agreement that details the estimated costs that the City will be re-
sponsible for. The Cooperative Agreement is in the standardized format
that has been previously approved by our City Attorney and used on the
South bridge Crossings Park and Ride project.
ISSUES:
CR 21 Extension
The proposed final design is consistent with the alignment and geometric
approval granted in 2008 by the City Council. The Cooperative Agreement
does involve one issue that is unique to this project and should be consid-
ered by the City Council.
This project will involve substantial tree removal in Prior Lake, Shakopee
and on Shakopee Mdewakanton Sioux property for roadway construction.
In accordance with the City of Prior Lake's tree preservation ordinance the
project will remove 1,425 caliper inches of significant trees. Replacement
of trees is required in non-roadway right-of-way areas impacted by the pro-
ject. This equates to 725 2-inch trees required for replacement. The
County has maximized replacement of the trees in the CR 21 Corridor but
only 190 of the trees can be replaced on the project. In addition, the
County is proposing to provide the City with 535 2-inch caliper equivalent
trees as bare root stock to be planted in the City's tree nursery. These
trees will be purchased over a 2 year period and raised for re-planting
along City/County roads and in City Parks. Staff believes this is an ac-
ceptable off-site mitigation for the tree impacts.
CR 21 Transit Station
The CR 21 project includes two transit improvements. The first is a bus-
only ramp from Stagecoach Road to TH 169. This ramp will allow com-
muter buses to access TH 169 directly from the South bridge Crossing Park
and Ride. This ramp is considered a "transit advantage" since it will elimi-
nate several minutes from the morning commute.
The second transit improvement is a new regional park and ride facility,
known as the Eagle Creek Park and Ride and located at the intersection of
CR 16 and CR 21. The Eagle Creek Park and Ride will be able to accom-
modate 545 cars, with room for an additional 216 cars in the future. The
need for this park and ride lot was identified in the Unified Transit Man-
agement Plan (UTMP) in approved in 2005.
The park and ride lot is located on SMSC fee property. The SMSC has
agreed to enter into a long-term lease (50 years) with Scott County for the
use of the property. The total cost of the lease is $74,400. The County will
pay for the City's share of the lease cost.
The project will be constructed in two phases. Phase 1 will include com-
plete construction of the bus only ramp and site grading and clearing of the
park and ride site. Phase 2 will include the completion of the park and ride

facility, including grading, paving, lighting, census and surveillance sys-
tems, sewer and water main and a prefabricated shelter. These improve-
ments will be completed with the CR 21 project.
CR 21 Extension
The total project cost to the City is estimated to be $1,260,000. The City of
Prior Lake's street and storm sewer cost share is allocated as follows:

Funding for this project has been identified in the CIP previously. The Fi-
nance Director has reviewed the proposed amounts and verified that the
funding sources are available. The City's share of the project costs in-
cludes a $215,000 credit from the project Federal Funding. The Coopera-
tive agreement requires the City to pay 50% of our costs in 2009 after the
bid opening and the remaining 50% in 2010.
CR 21 Transit Station
The total cost for the transit improvements on the CR 21 project is esti-
mated at $2,732,953.00. Scott County has obtained a Federal grant which
will cover 80% of this cost. The remaining 20% will be split by the cities of
Shakopee and Prior Lake in the manner prescribed by the South bridge
Crossing Memorandum of Understanding. Shakopee is responsible for
60% of the cost and Prior Lake's share will be 40 percent.
The City of Prior Lake's Transit Station cost is allocated as follows:

Scott County for the CR 21 Extension Project; and
WHEREAS, The final design for CR 21 has been completed; and
WHEREAS, A Cooperative Agreement for the completion of the CR 21 Extension Project has been
completed based on the final design; and
WHEREAS, The City of Prior Lake's street and storm sewer cost share is allocated as follows:

WHEREAS, The City of Prior Lake shall reimburse Scott County approximately $1,130.00 for the
CR 21 Extension project as estimated above. This amount excludes the City's
Administration and Engineering costs for Utility Construction of $30,000 and $100,000
for street lighting and monumentation.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein
2. The Mayor and City Manager are authorized to execute a Cooperative Agreement on behalf of the
City with Scott County for the CR 21 Improvement Project.
3. The City will reimburse Scott County and estimated $1,130,000 for the CR 21 Extension Project in
accordance with the Cooperative Agreement. The actual amounts reimbursed by the County
based on construction bids shall be approved by the City Council prior to payment.
4. Construction costs will be recorded in the Construction Fund (#501-48366)
5. City Staff is authorized to request $425,000 from the City's Municipal State Aid Account for the
project to be deposited in Construction Fund Account #501-33419
6. City Staff is authorized to transfer the following amounts to Construction Fund Account #501-39203:
o Trunk Reserve Fund: $535,000 (#502-49303)
o Street Oversize Fund: $100,000 (#503-49303)
o Water Quality Fund: $50,000 (#602-49303)
7. City Staff is authorized to include $150,000 in Street Reconstruction Bonds for this project as part of
the 2010 Bond sale. Proceeds from the bond sale will be deposited in the Construction Fund.
8. The City Engineer is authorized to sign the CR 21 Extension Project Plans.

A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO A
COOPERATIVE AGREEMENT WITH SCOTT COUNTY FOR THE CR 21 TRANSIT
IMPROVEMENTS

WHEREAS, The City Council recognizes the value of providing quality, cost-effective transit
services for the Prior Lake community; and
WHEREAS, The City's 2030 Vision and Strategic Plan identifies addressing transit needs as
a goal in providing a better quality community; and
WHEREAS, The City values its partnerships with Scott County and other Scott County
communities; and
WHEREAS, In August, 2005, the Prior Lake City Council and the other Scott County
communities adopted a Unified Transit Management Plan (UTMP) which
identified the need for 1,100 park and ride stalls; and
WHEREAS, In June, 2006, the City Council entered into a Memorandum of Understanding
outlining the roles and obligations of the parties in transit improvements; and
WHEREAS, In July, 2007, South bridge Crossing Transit Station was constructed, completing
the first 500 parking stalls; and
WHEREAS, Scott County, the City of Shakopee, the Shakopee Mdewakanton Sioux
Community and the City of Prior Lake have been working cooperatively to
identify additional transit improvements as part of the CR 21 project; and
WHEREAS, The Cooperative Agreement is consistent with the terms of the Memorandum of
Understanding; and
WHEREAS, Scott County requires the parties to enter into a Cooperative Agreement which
sets out the terms, conditions and responsibilities of the parties for the CR 21
transit improvements; and
WHEREAS, The City of Prior Lake's transit cost is allocated as follows:
