ORDINANCE NO. 03-03
AN ORDINANCE AMENDING SECTION 1101.504 OF THE PRIOR LAKE CITY CODE
REGARDING CONSTRUCTION OF FENCES ON CORNER LOTS ABUTTING
COLLECTOR STREETS
The City Council of the City of Prior Lake does hereby ordain that:
1. Section 1101.504 of the Prior Lake Ci1y Code is hereby amended to add the paragraph as follows:
~ A fence on a comer lot abuttinq a collector street shall be subiect to the followinq conditions:
1. The fence shall not exceed 6 feet in heiqht alonq the side street lot line.
2. The front vard shall be determined bv the location of the aaraqe. The direction the
aaraae is facinq 5hall be considered the front yard.
3. For lots with drivewav access on a collector street, the fence shall not be
constructed within a siqht trianqle described as beainninq from a point at the
intef5ection of the extension of the existinq curb lines of the 5treet or pavement
edae and driveway, and extendinq 50 feet alonq the edae of the street and alona the
lenqth of the driveway to the aaraae front. This defines two sides of the trianqle.
The third line is a line connectinq the end points of the two sides described above.
4. The side street shall be desiqnated as a collector street in the comprehensive plan.
5. A 6 foot fence 5hall be located behind the rear comer of the principal buildinq or
detached acces50ry structure alonq the front lot line abuttina the collector street.
6. A 6 foot fence shall maintain a 10 foot setback alona the collector street in front of
the rear comer of the principal structure or detached accessory structure.
7. The fence shall maintain a 1 foot setback from a trail or sidewalk.
2. Section 1101.504 of the Prior Lake City Code is hereby amended to add the paragraph as follows,
(7) A zonina permit shall be obtained prior to the installation of a fence not exceedinq 6
feet in heiqht. A site plan showina the location of the fence in relation to the
property lines shall be submitted with the permit application. A buildina permit shall
be required for a fence exceedinq 6 feet in heiqht.
This ordinance shall become effective from and after its passage and publication.
Passed by the City Council of the City of Prior Lake this 3rd day of February, 2003.
