Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: MAY 18,2009 AGENDA #: SF PREPARED BY: LARRY POPPLER, ASSISTANT CITY ENGINEER AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION ACCEPTING BIDS AND AWARDING THE CITY'S STANDARDIZED CONSTRUCTION CONTRACT FOR STREET CONSTRUCTION FOR MAPLE GLEN SECOND PROJECT DISCUSSION: Introduction This agenda item accepts bids and awards a contract for the Maple Glen Second Construction Project. Historv On October 3, 2005, the City Council approved the Development Contact for Maple Glen 2nd Addition. Construction of Maple Glen 2nd Addition, with the exception of final paving (wear course) and individual lot landscaping, was completed in the fall of 2006. On October 16, 2007 the City notified Tollefson Development Inc. (Developer) that streets in certain areas of the plat had settled and needed to be repaired, but that due to poor soil conditions the City would prefer the Developer wait to complete the final paving until 2008 when weather conditions permitted. On December 1, 2008 the City Council approved an amendment to the Development Contract for Maple Glen 2nd Addition. Due to problems with the Letter of Credit and the inability to secure additional funds, the Developer petitioned the City to complete the final wear course paving and landscaping and has agreed the cost will be specially assessed against the lots within the plat still owned by the Developer. The Developer waived their right to appeal the special assessments. At the January 20, 2009 Public Hearing, no one spoke opposing the completion of the project. On April 6, 2009, the City Council held the Assessment Hearing and adopted the assessment roll for the project. Thirty days have elapsed since the hearing and no appeals have been submitted within the allotted time. Current Circumstances The City received 12 bids on March 18, 2009. The bids have been checked and tabulated. Valley Paving from Shakopee, Minnesota submitted the low bid in the amount of $122,500.00. The lowest bid was 12% or $17,364.50 below the engineer's estimate of $139,864.50. The City worked with Valley Paving on the Boudins/CommercelTH 13 project near the Target Store in Savage. As the lowest responsible bidder, City Staff recommends that the City Council award the contract to Valley Paving. FINANCIAL IMPACT: Adding contingency and bonding costs bring the total project cost for the Maple Glen Second project to $138,115.00. This cost is proposed to be funded entirely through special assessment. These improvements will be financed through the issuance of $138,115.00 of general obligation bonds. The alternatives are as follows: 1. Approve a resolution accepting bids and awarding the City's Standardized Construction Contract for street construction to Valley Paving for the Maple Glen Second Project. 2. Deny this item for a specific reason and provide Staff with direction. 3. Defer this item until a specific date in the future. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Valley Paving of Shakopee, Minnesota is the lowest responsible bidder. 3. The Mayor and City Manager are hereby authorized to enter into the City's standard contract with Valley Paving of Shakopee, Minnesota in the name of the City of Prior Lake for the Maple Glen Second Project in the amount of $122,500.00. 4. The City Manager is hereby authorized and directed to return to all bidders the deposits that accompanied their respective bids.
