CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON
INTEREST COMMUNITY NUMBER 1191 (PARK AVENUE CONDOMINIUM)
CIC PLAT
Introduction
Almac Inc. is requesting approval of a Common Interest Condominium plat for
a 4-unit apartment building located at 16392 Park Avenue. The staff
recommends approval of this CIC plat as part of the consent agenda.
Historv
The existing apartment building was constructed in 1970. The 0.37 acre
property is zoned R-1 Low Density Residential thereby making the existing
four-unit apartment building a legal nonconforming structure.
Current Circumstances
The purpose of a CIC plat is to allow the subdivision of townhouse or
condominium units into lots for each individual unit for sale to individual
owners. Essentially, the plat creates a lot around the four walls of an individual
unit. CIC plats are typically done following the actual construction of the
buildings in question. The CIC plat does not change the number of units or the
density of the development. The subdivision of the single lot into a 4-unit
Common Interest Community Plat will not increase the legal nonconformity of
the site. The applicant is also requesting a common dock on the property.
This dock will require a permit from the City and must meet all required City
ordinances as stated in Section 1004 (Shoreland Districts) of the Zoning
Ordinance.
CIC plats do not require a development contract. The required improvements
were included under previous City improvement projects, so a Letter of Credit
is not necessary. In addition, the City fees normally associated with a final plat
were collected under previous sewer, water, and roadway improvement
projects in 1975 and 1987.
There are no budget impacts with the approval of this CIC plat since the
building has already been built.
The City Council has three alternatives:
1. Adopt a Resolution approving the Common Interest Community Number
1191 (Park Avenue Condominium) CIC Plat.
2. Deny the resolution approving the CIC plat.
3. Defer this item and provide staff with specific direction.

RECOMMENDED
MOTION:
A motion and second to adopt a resolution approving the Common Interest
Community Number 1191 (Park Avenue Condominium) CIC Plat and
authorizing the Mayor and City Manager to sign the CIC plat documents is
required.

A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE THE COMMON
INTEREST COMMUNITY NUMBER 1191 (PARK AVENUE CONDOMINIUM) CIC PLAT

WHEREAS, The City Council has found that the Common Interest Community Number 1191 (Park
Avenue Condominium) CIC Plat does the not increase the existing legal nonconformity
of the site.
WHEREAS, All required public utility improvements have been completed for the site and all fees
have been paid as part of previous City improvement projects.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council approves the Common Interest Community Number 1191 (Park Avenue
Condominium) CIC Plat.
3. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the
date of final plat approval. Failure to record the documents by July 18, 2009, will render the CIC
plat null and void.
4. A common dock permit is required for the approval of the proposed dock.
5. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
