CONSIDER APPROVAL OF TWO RESOLUTIONS: 1) ACCEPTING
PROPOSALS AND AUTHORIZING MFRA TO PROVIDE SURVEYING AND
WETLAND DELINEATION SERVICES; AND, 2) ACCEPTING PROPOSALS
AND AUTHORIZING NTS TO PROVIDE TESTING SERVICES FOR THE 2009
WATER QUALITY POND MAINTENANCE PROJECT.
Introduction
The purpose of this agenda item is to accept the proposals for professional
services related to design and construction surveying, wetland delineation, and
pond sediment testing for the 2009 Water Quality Pond Maintenance Project
#09-013.
History
The City of Prior Lake owns the majority of the stormwater conveyance and
treatment system that provides flood protection and water quality treatment of
rainwater runoff. Periodic maintenance is required to keep the system in good
working order, and maintain the mandated average designed level of service.
The City of Prior Lake inspects its entire stormwater system on a 3-5 year
rotating basis. The result of these inspections triggers minor maintenance work
that is completed annually by City Staff. Inspections also lead to large full pond
dredging projects which occur biennially (currently every odd year). Pond
dredging projects are prioritized and completed based on the following criteria:
current level of service, cost efficiency, and rights of access.
City Staff solicited proposals for surveying and testing services needed to collect
information to assist in the process of prioritizing these ponds, and creating
maintenance cost estimates and plans.
Current Circumstances
Seven water quality treatment ponds have been selected for surveying and
testing. These seven ponds show signs of underperforming their design level of
service and are in need of repair. Results of the surveying and testing will allow
City Staff to produce maintenance plans and cost estimates for full pond
dredging to be completed in late Fall 2009.
Surveying Services
Staff has requested proposals from the three firms from our consultant pool for
surveying services. They include: Bolton and Menk Inc., WSB and Associates,
and MFRA. Each of these firms has a positive history of construction staking for
the City of Prior Lake. The bids received by these firms are tabulated below:

The proposals received were each analyzed and City Staff is recommending that
MFRA perform the surveying and wetland delineation services for the 2009
Water Quality Pond Maintenance project. MFRA recently performed the
construction staking for City utilities on the County Road 82, County Road 21,
and County Road 12 projects and was selected for the 2009 road reconstruction
project. The quoted prices represent a "Base Bid" that was based on
assumptions about the amount of ponds to be maintained. Since that amount is
not known until the design survey and testing has been complete, and the
contract is bid, the actual cost will vary.
Soil Testing Services
Staff has requested proposals from three qualified testing firms. They include:
NTS, Braun Intertec, and Pace Analytical. Each of these firms has the unique
ability to provide the state mandated soil tests:

The proposals received were each analyzed and City Staff is recommending
NTS to perform the soil testing services for the 2009 Water Quality Pond
Maintenance project. Each firm provided a "Base Bid" based on assumptions of
numbers of tests required. The testing protocol requires a varying level of effort
based on the sample content and a predefined decision matrix. The actual cost
will vary depending on the soil sample content.
Surveying, Wetland delineation, and soil chemical tests must be done by or
under the supervision of a registered land surveyor, or certified testing
laboratory. The City of Prior Lake is not equipped or licensed to perform
surveying and testing for these projects.
The surveying and testing for this project will be funded through the City Water
Quality Utility, Capital Outlay Budget Account #49420-530.
The alternatives are as follows:
1. Approve a resolution accepting proposals and authorizing the Mayor and City
Manager to execute the City's Standardized Contract for Professional
Services with MFRA for Surveying and Wetland Delineation Services for the
Water Quality Pond Maintenance project #09-013
2. Approve a resolution accepting proposals and authorizing the Mayor and City
Manager to execute the City's Standardized Contract for Professional
Services with NTS for Soil Testing Services for the Water Quality Pond
Maintenance project #09-013
3. Table the Resolutions for a specific reason.
4. Deny the Resolutions.

RESOLUTION AUTHORIZING MFRA TO PROVIDE
CONSTRUCTION STAKING SERVICES FOR THE 2009 CONSTRUCTION PROJECT

WHEREAS, Design Survey and Construction Staking are necessary to properly install and maintain
City infrastructure; and,
WHEREAS, Survey and staking is needed for the 2009 Water Quality Pond Maintenance Project
#09-013; and
WHEREAS, The City does not have the in house expertise to complete this work; and,
WHEREAS, The City solicited and evaluated proposals from three qualified firms to provide
surveying and staking for the 2009 Water Quality Pond Maintenance Project and MFRA
provided the low proposal in the amount of $9,370.00.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. MFRA is hereby selected to provide Surveying Services for the 2009 Water Quality Pond
Maintenance Project for a base price in the amount of $9,370.00.
3. The Mayor and City Manager are authorized to execute the City's Standardized Professional
Services Agreement with MFRA on behalf of the City.
4. Funding for these services will be drawn from the Water Quality Fund #49420-530.

RESOLUTION AUTHORIZING NTS TO PROVIDE SOIL TESTING
SERVICES FOR THE 2009 WATER QUALITY POND MAINTENANCE PROJECT

WHEREAS, Soil testing of pond sediment is a necessary service required by the State prior to pond
maintenance projects; and
WHEREAS, Soil testing is needed for the 2009 Water Quality Pond Maintenance Project #09-013;
and
WHEREAS, The City does not have the equipment or expertise to complete this work; and
WHEREAS, The City solicited and evaluated proposals from three qualified firms to provide soil
testing for the 2009 Water Quality Pond Maintenance Project and the lowest cost
proposal was submitted by NTS in the amount of $4,239.50.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. NTS is hereby selected to provide Soil Testing Services for the 2009 Water Quality Pond
Maintenance Project for a base price in the amount of $4,239.50 and the unit pricing rates shown in
the proposal and attached to the City's Standard Professional Services Contract.
3. The Mayor and City Manager are authorized to execute the City's Standard Professional Services
Agreement on behalf of the City.
