EROSION CONTROL MEASURES FOR BUILDING CONTRACTORS Whenever grading or excavating for the purpose of constructing a building occurs, the City of Prior Lake erosion control standards must be applied. The standards will reduce the erosion of soils into the City's storm sewers, waterways and roads. This handout provides you with the information you need to comply with these standards. An erosion control plan will be created for the site as part of the permit review process. Failure to comply with the approved plan during construction will result in the loss of the $1,500.00 deposit, plus the builder will pay for the cost of the correction work. Build a rock construction entrance and erect silt fence. The silt fence will be in place prior to the footing inspection. The rock construction entrance will be constructed concurrently with the backfilling of the footings. Silt fence will be required, as needed, to intercept water flowing off the lot. Silt fence perpendicular to and across rear or side drainage swales shall be 20' long, centered on the swale, and spaced no more than 100' apart. Silt fence will be required behind all curb at a distance of five feet behind the curb, except at the rock construction entrance, and will extend 10' beyond the property line. The 10' extension may be waived when the adjacent lot is sodded and installation of silt fence would damage the sod. For spring construction, silt fence will be constructed as soon as the frost is out of the ground. Posts will be spaced at four feet or less and driven at least 2 feet in the ground. Posts will be two-inch square or heavier wood posts or standard T or U section steel posts. The rock construction entrance shall be 20' wide and 5' deep and be constructed of l' - 2' clear rock from the back of the curb to the front of the house. It will be the resoonsibilitv of the aeneral contractor to: 1. Maintain the entrance and silt fence in working condition. 2. Ensure that all sub-contractors and suppliers use the rock construction entrance only. 3. Keep the silt fence and the rock construction entrance in operation until final grading and sodding have been completed and the driveway paved. Penaltv for failina to comoly with the Erosion Control Standards. If a deficiency is noted in erosion control on site, you will be given 24 hours to correct the deficiency. It is important that you inform the City as soon as correction is made, as the City will consider the work undone until so informed. Failure to correct the deficiency within this time will result in forfeiture of the Builder's Deposit and the City will direct a third party to correct the work. In addition to the forfeiture, you will be billed for the cost of corrective action. Inspections will not resume until a new Builder's Deposit has been submitted. Minnesota License No.42309 Our File No. 10552 SUBSECTIONS: 403.100: 403.200: 403.300: 403.400: 403.500: 403.600: 403.700: Building Regulations SECTION 403 RESIDENTIAL SWIMMING POOLS DEFINITION ENFORCEMENT OF PROVISIONS PERMIT REQUIRED FEES MINIMUM REQUIREMENTS LOCATION RESTRICTIONS PENAL TV 403.100: 403.200: 403.300: 403.400 : DEFINITION: "Swimming pool" shall include any enclosure, in ground or above ground, having a water surface area exceeding one hundred (100) square feet and a water depth of not less than one and one-half feet (1 1/2'). ENFORCEMENT OF PROVISIONS: The City Building inspector, or his duly authorized representative, shall be charged with the enforcement of this Section. This Section shall apply retroactively only with regard to the safety features such as wiring and fencing to all existing swimming pools, and the owners thereof shall have until April 1 , 1975, to conform to the requirements hereof. PERMIT REQUIRED: No swimming pool shall be constructed, excavated or established in the City without first obtaining a permit therefor. An application for a permit shall be submitted to the Building Inspector which includes the type and size of pool, together with a site plan containing the following information: Location of pool; location of all structures on the building lot including house, garage, fencing or other improvements; location of pumps, filter, wiring, protective fencing, back flush and drainage outlets, grading plans and finish elevation around the pool; location of existing underground or overhead wiring, utility easements, trees and similar features; together with location of structures on adjacent lots. FEES: Normal building permits fees shall be charged, as now established and as established subsequent hereto, from time to time by the City Council. City of Prior Lake 403/p 1 Building Regulations 403.602 Multi-Familv Dwellina: Private swimming pools intended for and used by occupants and guests of occupants of multiple-family dwellings shall adhere to the following regulations: (1) No part of the water surface of the swimming pool shall be closer than fifty feet (50') to any lot line. (2) No pumps, filter or other apparatus used in connection with the pools shall be located closer than fifty feet (50') to any lot line. (3) The pool areas shall be adequately fenced to prevent uncontrolled access from the streets or adjacent as contained in Subsection 403.507. Adequate screening including, but not limited to, a landscape shall be placed between the pool area and adjoining single-family district Jot lines. (4) All deck areas, adjoining patios or other similar areas used in conjunction with the pools, shall be located at least fifteen feet (15') from any lot line in an adjoining Single-Family District. 403.800: PENALTY: Any person violating the provisions of this Section shall be guilty of a misdemeanor and subject, upon being found guilty, to the payment of a maximum fine of five hundred dollars ($500.00) or ninety (90) days in County jail, or both, together with the cost of prosecution. City of Prior Lake 403/p3 403.500: (1) 403.600: 403.601 Building Regulations MINIMUM REQUIREMENTS: Pools shall not be located within ten feet (10') (measured horizontally) from underground or overhead utility lines of all types. (2) Pools shall not be located within any private or public utility, drainage, walkway or other easement. (3) Construction of pools shall be undertaken so as to avoid hazard, damage or considerable inconvenience to adjacent property. (4) The lot owner shall be liable for damages to any business or private property caused during pool construction. (5) To the extent feasible, back-flush water or water from pool drainage shall be directed onto the owners' property or onto approved public drainage ways, and shall not drain onto adjacent private land. Drainage onto public streets or other public drainage ways shall require permission of the appropriate local City officials. (6) Any pool lighting shall be directed toward the pool and not toward adjacent property. (7) The pool area shall be enclosed with a non-climbable type safety fence at least five feet (5') in height to prevent uncontrolled access to the pool area, and the fence shall have a gate self-closing, and self-latching with the latch inaccessible to small children and at least four feet (4') from the ground level. The fence shall be completely installed before filling the pool. (8) All wiring, installation of heating units, grading, installation of pipe or other construction shall be subject to inspection. (9) Nuisances, such as undue noise, lighting of adjacent property, health and safety hazards, damage to vegetation on adjoining property, and the like, shall not be permitted. (10) Filling of pools from fire hydrants or other public facilities shall require the permission of the appropriate local City officials. LOCATION RESTRICTIONS: Sinale-Familv Residential: Pools shall not be located within eight feet (8') of any rear lot line nor within five feet (5') of any side lot line, nor within six feet (6') of any principal structure or frost footing. Pools shall not be located within any required front yard. The filter unit, pump, heating unit and any other noise making mechanical equipment shall be located at least twenty five feet (25') from any residential structure on adjacent property and not closer than eight feet (8') to any lot line. Chlorine reacts with most metals at high temperatures. Titanium will burn at ambient temperature in the presence of dry chlorine. SECTION VI- HEALTH HAZARD DATA Threshold Limit Value: See Section II. Primary Routes of Exposure: Inhalation, skin and eye contact. Effects of Overexposure: Acute: Low concentrations of chlorine can cause itching and burning of the eyes, nose, throat and respiratory tract. At high concentrations chlorine is a respiratory poison. Irritant effects become severe and may be accompanied by tearing of the eyes, headache, coughing, choking, chest pain, shortness of breath, dizziness, nausea, vomiting, unconsciousness and death. Bronchitis and accumulation of fluid In the lungs (chemical pneumonia) may occur hours after exposure to high levels. Liquid as well as vaDor contact can cause irritation, burns and blisters. Ingestion can cause nausea and severe burns of the mouth, esophagus and stomach. Chronic: Prolonged or repeated overexposure may result in many or all of the effects reported for acute exposure (including pulmonary function effects). Emerqency and First Aid Procedures: Inhalation (of process emissions): Take proper precautions to ensure rescuer safety before attempting rescue (wear appropriate protective equipment and utilize the "buddy system"). Remove source of chlorine or move victim to fresh air. If breathing has stopped. trained personnel should immediately begin artificial respiration or, if the heart has stopped, cardiopulmonary resuscitation (CPR). Avoid mouth-to-mouth contact. Oxygen may be beneficial if administered by a person trained in its use. preferably on a physician's advise. Obtain medical attention immediately. Eye Contact: Immediately flush the contaminated eye(s) with lukewarm, gently flowing water for at least 20 minutes while the eyelid(s) are open. Take care not to rinse contaminated water into the non-affected eye. If irritation persists, obtain medical attention immediately. Skin Contact: As quickly as possible, flush contaminated area with lukewarm. gently running water for at least 20 minutes. Under running water, remove contaminated clothing, shoes. and leather watchbands and belts. If irritation persists, obtain medical attention immediately. Completely decontaminate clothing, shoes and leather goods before re-use, or, discard. Ingestion: Not an anticipated hazard. Issue a warning: POISON GAS. DO NOT TOUCH SPILLED LIQUID. Do no use water on a chlorine leak (corrosion of the container can occur, increasing the leak). Shut off leak if safe to do so. Wear NIOSH/MSHA.approved, self-contained, full- face, positive pressure respirator and full protective clothing capable of protection from both liquid and gas phases. Persons without suitable respiratory and body protection must leave the area. The following evacuation guide was developed by the U.S. Department of Transportation (DOT): Spill or leak from a smaller container or sma!! leak from a tank - isolate in all directions 250 feet. Large spill from a tank or from a number of containers - first, isolate 520 feet in all directions: secondly, evacuate in a downwind direction 1.3 miles wide and 2.0 miles long. Keep upwind from leak. Vapors are heavier than air and pockets of chlorine are likely to be trapped in low-lying areas. Use water spray on the chlorine vapor cloud to reduce vapors. Do not flush into public sewer or water systems. Chlorine can be neutralized with caustic soda or soda ash. Alkaline solutions for absorbing chlorine can be prepared as follows: For 100 pound containers: 125 Ibs. of caustic soda and 40 gallons of water For 2.000 pound containers: 2,500 Ibs. of caustic soda and 800 gallons of water For 100 pound containers; 300 Ibs. of soda ash and 100 gallons of water For 2,000 pound containers: 6,000 Ibs. of soda ash and 2,000 gallons of water CAUTION: Observe appropriate safety prec.autions for handling alkaline chemicals. Heat will be generated during the neutralization process. Waste Disposal Method: Due to its inherent properties, hazardous conditions may result if the material is managed improperly. It is recommended that any containerized waste chlorine be managed as hazardous waste in accordance with all applicable federal, state, and local health and environmental laws and regulations. SECTION VIII - SPECIAL PROTECTION INFORMATION Ventilation: Effective exhaust ventilation should always be provided to draw fumes or vapors away from workers to prevent routine inhalation. Ventilation should be adequate to maintain the ambient workplace atmosphere below the legislated levels listed in Section II. Respiratory Protection: Use NIOSH approved acid gas cartridge or canister respirator for routine work purposes when concentrations are above the permissible exposure limits. Use full facepiece respirators when concentrations are irritating to the eyes. A cartridge-type escape respirator should be carried at all times when handling chlorine for escape only in case of a spill or leak. Re-enter area only with NIOSH approved, self-contained breathing apparatus with full facepiece. The respiratory use limitations made by NrOSH or the manufacturer must be observed. Respiratory protection programs must be in accordance with 29 CFR 1910.134. Eve/Face Protection: Non-ventilated chemical safety goggles or a full face shield. Safety shower/eyewash fountain should be readily available in the work area. Some operations may require the use of an impervious full-body encapsulating suit and respiratory protection. Note: Neoprene, polyvinyl chloride (PVC), Viton, and chlorinated polyethylene show good resistance to chlorine. Additional: Do not eat, drink or smoke in work areas. Maintain good housekeeping. SECTION IX . SPECIAL PRECAUTIONS Material Handlinq: Do not use near welding operations, flames or hot surfaces. Move cylinders by hand truck or cart designed for that purpose. Do not lift cylinders by their caps. Do not handle cylinders with oily hands. Secure cylinders in place in an upright position at all times. Do not drop cylinders or permit them to strike each other. Leave valve cap on cylinder until cylinder is secured and ready for use. Close all valves when not in actual use. Insure val lies on gas cylinders are fully opened when gas is used. Open and shut valves at least once a day while cylinder is in use to avoid valve "freezing". Use smallest possible amounts in designated areas with adequate ventilation. Have emergency equipment for fires. spills and leaks readily available. Wash thoroughly after handling product. Provide a safety shower/eyewash station in handling area. An emergency contingency program should be developed for facilities handling chlorine. Storaqe: Store in steel pressure cylinders in a coal, dry area outdoors or in well-ventilated, detached or segregated areas of noncombustible construction. Keep out of direct sunlight and away from heat and ignition sources. Cylinder temperatures should never exceed S1"C (12SoF). Isolate from incompatible materials. Store cylinders upright on a level floor secured in position and protected from physical damage. Use corrosion resistant lighting and ventilation systems in the storage area. Keep cylinder valve cOlier on. Label empty cylinders. Store full cylinders separately from empty cylinders. Avoid storing cylinders for more than six months. Comply with applicable regulations for the storage and handling of compressed gases. MAY i L,. 2008 ~ MECHANICALLY FASTENED SYSTEMS SECTION 1-..GENERAL INTRODUCTION The following is the information required to install the Duro-Last roofing system. Each installation should be in compliance with the detail drawings, instructions, material descriptions, and other information stated herein. REQUIREMENTS 1. The Duro-Last Roofing System must be installed by an authorized Duro-Last contractor. 2. The proper slip sheets must be installed between the Duro-Last membrane and the substrate. 3. A Duro-Last quality assurance specialist must inspect the Duro-Last Roofing System for compliance with the Duro-Last specifications before a commercial/industrial warranty is issued. 4. All materials used in the installation of the Duro-Last Roofing System must be products of Duro-Last Roofing, Inc., or accepted products as defined and described in the specification. Other materials must be accepted in writing by the Duro-Last Engineering Services Department prior to being used in the Duro-Last Roofing System. 5. The Duro-Last contractor is responsible for following all applicable building, plumbing and electrical codes. 6. Fastening for buildings that are located in high wind zones (120 mph.:!:) and/or those equal to or greater than 40-feet (12 m) in height will be fastened no greater than 12-inches (.31 m) on center and will have fastener tab/row spacings no greater than 60-inches on center. In addition, the roof system may require additional securement tabs near the roof edge, spaced 28-inches (.7 m) on center. If you have a building that is greater than 40-feet in height or located in a high wind zone, contact the Duro-Last Engineering Services Department at 800-248-0280. ~ 7. The 10-Foot Tab system is not intended for buildings in excess of 40-feet and in some high wind zone applications. DELIVERY The Duro-Last roofing system and related materials will be shipped in the original packaging and with shipping labels intact. Containers will be labeled with manufacturer/supplier's name, product name and identification. Upon arrival, each shipment should be checked for damage or shortages. The freight agent should be made aware of any problems and must note the damage or shortage on the freight bill. Concealed damage must be reported to the freight agent immediately upon discovery. Materials damaged in shipping, handling or storage cannot be used. HANDLING Once the Duro-Last roofing system is delivered to the job site, the contractor is responsible for all handling and installation. Adequate personnel and equipment should be available to safely lift and place the Duro- Last roofing system onto the rooftop. The components of the roofing system should be staged near load- bearing supports in a manner convenient to final placement. STORAGE Duro-Last materials should be kept clean and dry. Materials should be stored on pallets and covered with tarps. Care should be taken to place materials away from areas where water may pond or areas that water falls onto from higher elevations. All sealants must be stored at temperatures above 400F (SoC). Keep combustible materials away from heat, sparks, and open flames. (20 Kg/m\ Then, a minimum 3/8-inch (10 mm) Duro-Last supplied underlayment or 1-inch (25 mm) thick insulation must be used. If the loose stone on an old BUR is vacuumed or swept, a separator sheet of a minimum 3/8-inch (12 mm) thickness, such as a Duro-Last approved re-covery board, must be used. CAUTION: Removing more than the loose gravel may affect the resulting fire rating. Consult the Duro-Last Engineering Services Department at 800-248-0280 for fire rated assemblies. b) If the BUR is a smooth or granular surfaced application and is free of sharp edges and debris, then it can be re-covered with a minimum of a 3-mil polyethylene sheet, though a 3/8" underlayment is recommended. c) EPS insulation cannot be used over coal tar pitch or asphalt without a slipsheet between the coal tar pitch and the insulation as well as between the membrane and the insulation. Duro-Last underlayments are approved for direct application over aged coal tar pitch roofs. d) When roofing over asphalt or coal tar roofs (including tear-off), an approved separator sheet must be used. Asphalt-based products are incompatible with the Duro-Last roofing membrane. Note: Should the Duro- Last membrane become soiled with roofing asphalt, the affected membrane must be cleaned immediately using approved cleaners and procedures. If the asphalt cannot be properly cleaned from the membrane, the affected membrane must be removed and new membrane installed, or overlay the affected area with an approved slipsheet and new membrane. Extreme caution should be taken if you are doing a tear-off while installing the membrane. '-/ RE-COVER - Single-Ply Roofs a) All existing single-ply roofing membrane must be cut free from the entire roof perimeter, cut free around all penetrations, and cut in between fastener rows prior to the installation of the Duro-Last membrane. When reroofing after a tear-off, caution should be used to prevent the Duro-Last membrane from contacting incompatible materials. (See "Getting Started" [Item 9] within the Introduction Section for approved substrates) b) If the existing system is mechanically fastened, there is often a problem with loose fasteners. Because of this problem, cut the membrane open and remove all loose fasteners before installing the slipsheet. c) If a PVC membrane has been installed directly over styrene insulation without a separation sheet, then the old membrane must be removed, damaged insulation replaced, and an approved slip sheet installed. d) If the existing membrane is ballasted and the Duro-Last membrane is to be mechanically fastened, it is necessary to do fastener pull-out tests on the deck. Also, the type of insulation and its density needs to be determined to ensure that the insulation will meet Duro-Last Roofing, Inc. requirements. (See Substrate Separation within the "General Specifications" section for approved substrates). Be aware that if the existing insulation is "loose-laid" it must be fastened with an approved fastening pattern. (See Detail 1020) ~ RE-COVER - Metal Roof Re-cover/Retrofit a) The metal roof panel must be clean, smooth, free of sharp edges and loose foreign material. Damaged areas and other factors affecting the installation of the Duro-Last roofing system must be repaired prior to the installation of the membrane. b) A metal roof panel must be separated from the Duro-Last membrane by at least 7/16-inch (13 mm) hardboard (gypsum, plywood, or oriented strand board(OSB)) or 1-inch (25 mm) rigid insulation. Duro-Last 1/2-inch fan fold insulation may be used if the flutes are comoletelv filled. The gaps between the ribs of the metal and the insulation fill can not exceed 1/4-inch in width. c) Flute filler material must consist of polyisocyanurate insulation. Flute filler must be mechanically fastened with Duro-Lastfasteners and plates, as needed, to hold. the insulation in place. d) Insulation/re-cover board must be neatly fitted to the roof deck and its penetrations. 4' x 8' boards must have a minimum of five fasteners/distribution plates. The insulation/re-cover board must be the minimum thickness required by the manufacturer to span any gaps between the flute filler and the center of the rib. Gaps between insulation/re-covery boards cannot exceed 1/4-inch (6 mm) in width. No more insulation/re- covery board will be installed than can be covered with membrane and completed before the end of the I ;~/'i1tNI(f}At.LYFASr:I5NED SPEC/FICA nONS S~eF'J&S$ I 6 b) The minimum compression characteristics of insulation products as determined by ASTM D-1621 will be as follows: ~ · Polyisocyanurate products: 20 PSI (137.8 kPa) · Fiberglass products: 16 PSI (110.3 kPa) · Extruded polystyrene products: 25 PSI (172.3 kPa) · Expanded polystyrene products: 15 PSI (124.1 kPa) and 1.5 PCF (24 Kg/m3) density (certified) and a minimum 1-inch (25 mm) thick. · Expanded polystyrene products covered with or laminated to a hardboard facer: 12 PSI (82.7 kPa) and 1.25 PCF (20 Kg/m3) densities and a minimum of 1-inch (25 mm) thick. ~ MEMBRANE INSTALLA TION a) The prefabricated roof section is positioned on the deck to expose the first securement tab. The securement tab is mechanically fastened to the deck with approved fasteners, and stress distribution plates (see Fastener Selection and Deck Combinations in this section). The roof section is then unrolled and pulled taut to remove any wrinkles exposing the second securement tab. This process is repeated until the entire roof section has been mechanically fastened to the deck, including all securement tabs and all edges. The next section of roofing membrane is then positioned to provide a minimum 6-inch (.15 m) overlap. The above processes are repeated until the substrate is completely covered. b) The edge of a 2-inch (50 mm) Poly-Plate must be installed flush with the outside edge of a fastening tab. c) The maximum fastener spacing is 18-inches (.30 m) on center in rows 60-inches (1.52 m) apart. For tab spacings greater than 60-inches, the maximum fastener spacing is 12-inches. Refer to the fastener spacing table. d) When installing membrane, ensure that the appropriate side of the membrane is exposed to elements. For white and gray membrane, the smooth side should be exposed. On the tan membrane, it will be the embossed side of the membrane that should be exposed. e) If the membrane is attached to the support structure beneath the roof deck, special precautions must be taken. If the membrane is attached to a steel purlin structure, all fasteners must penetrate a minimum of 1 3/4-inch (44 mm) from the top of the purlin using Duro-Last purlin fasteners. If the membrane is being attached to a wood truss structure, all fasteners must penetrate a minimum of 1-inch (25 mm) from the top surface of the truss with approved Duro-Last fasteners. PERIMETER MEMBRANE INSTALLA TION a) The first tab on all perimeter roof sections that have tabs parallel with the roof edge or parapet wall, must be between 24-36 inches (.6 m and .9 m) from the edge or the wall. If the parapet wall is greater than 24- inches (.6 m) tall, a perimeter tab may be placed at 63" away from the roof edge (5-foot tab system only). b) On 10-foot tab systems, the first tab on all perimeter roof edges must be between 24-36 inches (.6 m and .9 m) from the edge followed by a second tab placed 84-96 inches (2.1 m and 2.4 m) from all exterior roof edges. Parapet wall height does not change this minimum requirement. c) On buildings with multiple roof levels, such as equipment penthouses, a roof perimeter edge is defined as any roof having a vertical height difference 3-feet or greater than the lower roof areas surrounding it. If this condition exists, that area must be treated as a separate roof and will require a perimeter tab. See note "a". d) On buildings located in high wind zones (greater than 120-mph) or on structures that are 40-feet or higher, additional wind tabs and an increased fastener spacing may be required. HOT AIR WELDING a) Position the membrane so that an overlap of the top membrane overlaps the bottom membrane a minimum of 6-inches. Ensure the welding area is dry, clean and free of foreign material. b) Weld the top membrane to the bottom membrane using a hand-held welder or an automatic welding machine, and silicone roller. At that time I could only answer general questions about it because we had no survey, plans or information to make specific conunents. Reponse: The 2007 Minnesota State Building Code chapter 1341. 111l.l states: Swimming Pools, Wading pools, Spas, Saunas, and Steam rooms are to be accessible. The Minnesota Department of Health administers the Minnesota Pool Code and conducts Plan Review and inspection of pool construction or alteration. Their definition of a "Public pool" includes any pool, other than a private residential pool operated by any person whether the person is an owner, lessee, operator, or concessionaire. Pools include swimming pools, spa pools (hot tubs), waterparks, plunge pools with Burne slides, therapy pools, wave pools, splash pads and interactive water features. Public pools are those located in parks, schools, licensed child care facilities, Home Owners Associations, group homes, motels, camps, resorts, apartment buildings, clubs, condominiums and hotels or any licensed lodging facility. Question: However, we are also planning on appealing to the City Council to reconsider these requirements. Reponse: The requirements are in State of Minnesota Statues. The State of Minnesota Department of Labor and Industry that administers State Building Code was contacted for conformation on the applicability of the regulations. Question: One important item to note is that the city's insistence that we comply with these rules has nothing to do with whether or not we build a bathroom area. Reponse: The bathroom facilities are not required as per MN rules 4717.3650 TOILETS, LA V A TORIES, SHOWERS, AND DRESSING ROOMS. Subpart I.GeneraI.Toilets, showers, and dressing rooms must be conveniently available to pool patrons.A.Toilets, showers, and dressing rooms may be in a nearby toiletroom, locker room, or, if conveniently available, within the living units of an apartment building, hotel, or similar occupancy. Question: Just late last week, the city said we have to provide evidence of the easements for the pool area. Response: This requirement was included in the Engineering plan review comments faxed to Dolphin Pools on April 2, 2008. For this reason, Aquatic Access offers this ADA Advisor, with quotations from the actual guidelines, explanations of the meaning, and the ease of compliance with the help of Aquatic Access products. The technical requirements for public pools and spas are found in section 15.8 of the guidelines document, but there are some important additions in the addenda to the overall document. When reading the complete set of guidelines, regulations with additional information about them in the addenda are marked with an asterisk. It is important to check on the additional data for these regulations. There are some pool lift companies alleging that their lifts are compliant, when they are not. Unfortunately there is no government program to prevent false claims at this time. Therefore, a careful reading of the regulations AND the associated addenda is the only way one can be certain that the lift they purchase is in complete compliance. You can find the entire document online at www.access-board.gov/recreation if you care to review it in its entirety. We have extracted the main points regarding pool lifts from the Architectural and Transportation Barriers Compliance Board, 36 CFR Parts 1190 and 1191 for your reference. We will add updates as they become available. The text in red is extracted verbatim from the guidelines. The text in black is an explanation of the requirement. The text in blue tells you how the Aquatic Access IGA T-180, IGA T-180/135, and IGA T-180AD pool lifts provide the best solution to your accessibility needs. The recommendations for public pools require that at least two means of entry and exit be provided for each public and common use swimming pool. A sloped entry or lift must be the primary means of access. The secondary means of access is not permitted to duplicate the primary means and also allows transfer walls, transfer systems, stairs, or moveable floors as a means of access. An exception permits swimming pools with less than 300 linear feet of swimming pool wall to have only one means of access, but that means of access must be either a lift or sloped entry. When more than one means of access is provided into the water, it is recommended that the means be different. Providing different means of access will better serve the varying needs of people with disabilities in getting into and out of a swimming pool. It is also recommended that where two or more means of access are provided, they not be provided in the same location in the pool. Different locations will provide increased options for entry and exit, especially in larger pools. Wave action pools, leisure rivers, sand bottom pools, and other pools where user access is limited to one area, shall provide at least one accessible means of entry that complies with 15.8.5 (Swimming Pool Lifts), 15.8.6 (Sloped Entries) or 15.8.8 (Transfer systems). Sections 15.8.2 and A 15.8.2 The secondary means of access must be different than the primary means and could include a pool lift, sloped entry, transfer wall, transfer system, or pool stairs. The Aquatic Access Models IGAT-180, IGAT-180/135, and IGAT-180AD offer a perfect solution to a pool http://www.aquaticaccess.com/adaadvisor.htm 5/2312008 ABC's of the ADA Page 2 of 4 owner's dilemma as a cost-effective and space-saving improvement to a pool measuring less than 300 feet in length. A lift can be either primary or secondary access to a large (more than 300 linear feet) pool. Aquatic Access ADA-compliant lifts can be easily installed on an existing pool, or incorporated in the design of a new facility. The first technical requirement states that pool lifts need to be located where the water level does not exceed 48 inches. There are two exceptions to this rule. One states that it can be placed where the water level is greater in pools where all depths exceed 48 inches. The other exception states that if multiple lifts are used in one pool, only one must be located where the water depth does not exceed 48". Section 15.8.5.1 Because of the ease of installation, Aquatic Access lifts can be placed in almost any pool area. Check with our engineering team to determine the best location at your pool. The centerline of the seat, when in the raised position, must be located over the deck and a minimum of 16" from the edge of the pool and not on a slope any greater than 1 :48. There are a variety of seats available on pool lifts ranging from sling seats to those that are preformed or molded. Pool lift seats with backs will enable a larger population of persons with disabilities to use the lift. Pool lift seats that consist of materials that resist corrosion and provide a firm base to transfer will be usable by a wider range of people with disabilities. Sections 15.8.2 and A 15.8.5 In order for an individual to move safely from wheelchair to lift and lift to wheelchair, there needs to be a comfortable distance from the edge of the pool to the place where the transfer will occur. A significant slope would increase the danger of the wheelchair rolling away. The properly installed Aquatic Access IGAT-180, IGAT-180/135, and IGAT-180AD with standard seats meet these space requirements. While some models of Aquatic Access lifts can be built with sling seats, the IGAT-180, IGAT-180/135, and IGAT-180AD have a standard seat of molded polypropylene on a sturdy stainless steel frame. There must be at least 36" of clear deck space on the side of the seat opposite the water. That clear deck space is not to be on a slope any greater than 1 :48. Section 15.8.5.3 In order for an individual to bring a wheelchair alongside the lift and slide safely onto the lift seat (and return to the wheelchair after a swim), there must be enough space for positioning the chair. Again, a significant slope would increase the danger of the wheelchair's rolling. Again, the Aquatic Access engineering team is well trained in ADA regulations and can take the guesswork out of lift placement. The height of a lift seat needs to be designed to allow a stop between 16" and 19" from the surface of the deck to the top of the seat surface when the seat is in the raised position. Additional stops at other heights are acceptable as long as one stop falls between 16" and 19". Section 15.8.5.4 The height of the seat was determined as a compromise to accommodate the needs of an adult or a child in a standard wheelchair. The Aquatic Access Seat has a standard stop at 19" from the pool deck, which meets this requirement. Further, standard Aquatic Access seats can be adjusted to stop at 19" or 21" or 23"and can be customized when ordered to stop at any desired height. The width of the lift seat is to be 16" wide minimum. Section 15.8.5.5 The standard Aquatic Access seating surface is 16" wide, with 18" between the arms for further seating comfort. A number of adaptations can be made to suit particular customer needs. Footrests that move in conjunction with the seat are required to be provided except for pool lifts that provide access to some spas. Footrests are encouraged on lifts used in larger spas, where the foot well water depth is 34 inches or greater. Additional options such as armrests, head rests, seat belts, and leg support will enhance accessibility and better accommodate people with a wide range of disabilities. http://www.aquaticaccess.comJadaadvisor.htm 5/23/2008 ABC's of the ADA Page 3 of 4 Sections 15.8.5.6 and A 15.8.5 An adjustable padded footrest is standard equipment for the Aquatic Access Models IGAT-180 and IGAT- 180AD. Although it is not required by the ADA, the Aquatic Access footrest easily flips up to a vertical position so it will not interfere with the transfer to the seat. The accessories available for the IGAT-180, IGAT-180/135, and IGAT-180AD lifts include a flip-up arm, seat belts that can be positioned at hip and chest levels, and a headrest. If provided, the armrest opposite the water needs to be either removable or fold clear of the seat when the seat is in the raised position. This provision is included to guarantee an easy side-to-side transfer from wheelchair to lift seat. Sections 15.8.5.6 and A 15.8.5 The Aquatic Access Optional Flip-Up Arm rotates 1150 from horizontal to past vertical, placing it well out of the way of a bather sliding into the lift seat from a wheelchair. It is required that a pool lift be capable of unassisted operation from both the deck and water levels. The controls and operating mechanisms must be unobstructed when a lift is in use and not require tight grasping, pinching or twisting of the wrist to operate. Further, pressure to the operating mechanism cannot exceed 5 Ibs. Pool lifts must be capable of unassisted operation from both the deck and water levels. This will permit a person to call the pool lift when the pool lift is in the opposite position. It is extremely important for a person who is swimming alone to be able to call the pool lift when it is in the up position so he or she will not be stranded in the water for extended periods of time awaiting assistance. The requirement for a pool lift to be independently operable does not preclude assistance from being provided. This section stipulates that the lift must have controls at the deck level and at water level all of the time. This guarantees that a person in the water does not become stranded in the water, and allows multiple individuals to utilize the lift within a swimming session. It is important that a lift buyer consider carefully whether or not this requirement is met. The regulation also implies in its final sentence that, while total independence is desirable, prudence must be exercised in any potentially dangerous situations. Sections 15.8.5.7 and A 15.8.5. 7 The Aquatic Access Models IGAT-180, IGAT-180/135, and IGAT-180AD feature controls at deck and water levels that require less than 5 Ibs. of pressure to operate. Unlike some other products on the market, the Aquatic Access IGAT-180, IGAT-180/135, and IGAT-180AD have controls that are always in reach at both levels, so that once the lift has delivered a swimmer to the pool, it can be recalled to the deck for another swimmer's use. Similarly, if the seat has been recalled to the deck, the swimmer in the pool can call the seat back to underwater level to exit the pool. The implications of this ruling cannot be overstated, and it is unfortunate that some lifts are being marketed as "ADA-compliant" that do not have stationary controls at both the deck and water levels and could potentially leave a handicapped individual stuck in the water for extended periods of time. Another requirement is that the lift be designed so that the seat will submerge to a water depth of 18" minimum. This depth is deemed necessary to ensure that natural buoyancy assists the individual in moving from the lift into the pool. The standard models of the IGAT-180, IGAT-1801135, and IGAT-180AD fulfill this requirement. Section 15.8.5.8 The versatile design of the Aquatic Access IGAT-180, IGAT-180/135, and IGAT-180AD is such that these lifts can accommodate any depth requirement. The swimmer totally controls the seat's travel, stopping and starting wherever and whenever desired. This important feature allows children or shorter adults to stop before they are submerged to an uncomfortable level. Single person pool lifts shall have a minimum weight capacity of 300 Ibs. (136 kg) and be capable of sustaining a static load of at least one and a half times the rated load. Pool lifts should be provided to meet the needs of the population it is serving. Providing a pool lift with a weight capacity greater than 300 pounds may be advisable. This requirement serves to guarantee that the lift can provide access to the majority of the population and has been tested with weights exceeding the rated load by 50%. Sections 15.8.5.9 and A 15.8.5.9 The Models IGAT-180 and IGAT 180/135 have a 400 lb. weight capacity at 55-60 PSI (normal city water pressure), and the ModeIIGAT-180AD has a 350 lb. weight capacity. All Aquatic Access lifts models are available as custom heavy-duty units. End of February or early March 2008: I received a phone call from someone representing the Harbor Association with questions about the existing pool and what the City would require for the work on the pool, retaining walls and adding a new building for facilities and pool equipment. At that time I could only answer general questions about it because we had no survey, plans or information to make specific comments. Based on the information I was given during the phone conversation, these were the comments I recall; . SAC charges Determined by Metropolitan Council. . Building plans and submittals from a licensed Architect. . Minnesota State Accessibility code (Chapter 1341), which includes accessibility to the pool area and facilities, handicap parking, access isle, signage and an accessible means of entering the pool by a ramp or a lift. . How and where sanitary and water services would be connected to City sanitary and potable water with curb stop valves and provide access to shut-off. . Complete survey with impervious area established by a certified surveyor to show it remains under 30%. . Pool barrier of 5' - 0" at pool perimeter and self-closing, self-latching gates to prevent uncontrolled access to pool area. . Department of Health Plumbing and Public Pool Division plan reviews. . Retaining walls over 4' -0" require Engineering, permits and are to meet setback requirements. On March 6 or 7: Danette Moore asked Jeff, Nate and me to take a look at some preliminary plans for the pool remodel and the proposed new facilities building. March 10: I discussed the plans with Nate and Jeff and sent comments to Danette. March 11: Danette emailed these comments to Kevin Gardner at Dolphin Pool and Spa. (See attachment) March 25 Dolphin Pool and Spa submitted a Building Permit Application. April 2 After reviewing these documents from all departments a memo for plan review corrections were faxed to Kevin Gardner. (See attachments) April 29: I received a phone call from Kevin and discussed some questions on the requirements from the plan review memo. May 1: Kevin came in to talk to me but I was not available at the time so Robert Hutchins went over the comments with Kevin. Bob told me later Kevin was just here to see me. May 6: Kevin came into the office again and informed us that they cannot find easements recorded from Scott County so the surveyor couldn't include them on a revised survey. We went to the Engineering department and Ross Bintner assisted us into finding a record of these easements, but City records did not show them for that phase of development. Kevin left after that to try and find or establish recorded easements with Scott County Records. May 9: Kevin called me and asked about the sanitary profile drawings and I referred him to Engineering Department to answer those requests. Kevin informed me he almost has all the information needed and will bring it in as he completes the list of corrections. Survey is necessary to assure the percentage of impervious area is not exceeded. What are the existing conditions? A survey should include the current conditions related to impervious, setbacks, elevations, etc. Pool and pool deck area will serve approximately 70 occupants. Minnesota Department of Health revision along with the Plumbing Division Review. Show that the pool meets Section 403.602 of City Code of Ordinances. Public pools need to be ADA compliant-may require a handicap lift. SAC (Sewer Area Charge) charges for handicap accessible restroom. Retaining wall over four feet in height will require engineering and must meet setbacks. Details on the 5 foot fence and self-closing, self-latching gates are required to show they meet required guidelines. Need site plan/survey to show where and how sanitary and water services are connected and fall/pitch from the restroom/shower room. Under 1800.5900 of the Building Code, an Architect needs to deign an A-4 occupancy pool-must meet ADA accessibility. Survey must show grade has met ADA, parking, ramps, etc for accessible per chapter 11 ,IBC, MN State Building Code (MSBC) with ANSI. On March 6 or 7: Danette Moore asked Jeff, Nate and me to take a look at some preliminary plans for the pool remodel and the proposed new facilities building. March 10: I discussed the plans with Nate and Jeff and sent comments to Danette. March 11: Danette emailed these comments to Kevin Gardner at Dolphin Pool and Spa. (See attachment) March 25 Dolphin Pool and Spa submitted a Building Permit Application. April 2 After reviewing these documents from all departments a memo for plan review corrections were faxed to Kevin Gardner. (See attachments) April 29: I received a phone call from Kevin and discussed some questions on the requirements from the plan review memo. May 1: Kevin came in to talk to me but I was not available at the time so Robert Hutchins went over the comments with Kevin. Bob told me later Kevin was just here to see me. May 6: Kevin came into the office again and informed us that they cannot find easements recorded from Scott County so the surveyor couldn't include them on a revised survey. We went to the Engineering department and Ross Bintner assisted us into finding a record of these easements, but City records did not show them for that phase of development. Kevin left after that to try and find or establish recorded easements with Scott County Records. May 9: Kevin called me and asked about the sanitary profile drawings and I referred him to Engineering Department to answer those requests. Kevin informed me he almost has all the information needed and will bring it in as he completes the list of corrections. HUTCHINS RE: THE HARBORS 2008 POOL PROJECT BLDG PERMIT # 08-0317 In a response to your inquiry regarding The Harbors 2008 pool project the following information was collected: On Monday June 2, 2008 I contacted the Cities of Lakeville, Eagan and Burnsville to verify projects that Dolphin Pool or companion company, Minnesota Pools Inc. installed any pools in their cities: City of Lakeville: I contacted the plan reviewer and they stated that a Community townhome association projects lronton and Kingsway had new pools installed in 2003 and 2004 by Dolphin Pools. Both projects were required to provide Accessible parking, route and chair lift into the pools. The Lakeville field inspectors verified that all were installed. City of Burnsville: I spoke with the plan reviewer and they stated that in 1997 the Walden Pond homeowner's association pool project was a remodel for the existing lavatory facility. A building permit was obtained by Midwest Landscape. The work consisted of remodeling the existing structure to as close as possible to the Minnesota Accessibility Code without any structural alterations. There was a note to the file stating that the Curt Wiehle of the State of MN Building and Standards Division was contacted for guidance. I also spoke to a homeowner in the association who is an acquaintance and they stated that in 2007 there was a project that entailed a retiling of the pool. The City had no record of a building permit for the project. City of Eagan: I contacted the Building Official and he stated that Dolphin Pools obtained building permits for five residential pools from 1996 to 2003. No public pool building permits have been issued to Dolphin or Minnesota Pools Inc. The BO stated that any public pool would be required to meet the MN Accessibility Code. Harbor Community Association Pool Proiect Update 5-6-08 Hello Friends, As many of you may have noticed, construction has not yet begun on the pool project here in ~:__ . Z.7' ',y" the Harbor. We obtained approval for our proposal from the State of Minnesota back in January.....- /": I '-' We needed to have that approval before we could apply for construction permits from the City of Prior Lake. Our representative, Kevin Gardner from Dolphin Pools, has been diligent in trying to obtain these permits. We have, however, encountered a number of unexpected bumps in the road. (-C1 . or t11\J First, the office of planning has been extremely carefulf.i examining our documents. Actually, ( '1 O-<.J C:, " that's quite understandable. As far as we are aware, we re the only community in the entire city' - r~e '..!.Ct-M; " that has a commu~ity owned pool. ~n the eyes of th~_f.it~ we a~e operating a pu?lic pool. We also understand that, in the light of recent tragedies in public pools, people that may have the authority to grant permission to renovate and operate public pools might be awfully cautious that they follow every rule and regulation that they may deem applicable. - l' ? The least expensive way to accomplish this is to install a handicap lift for our pool. That in itself is not necessarily expensive. But, another caveat of this act is that we must also provide wheelchair access to and from the pool at an elevation grade that doesn't naturally occur here in the Harbor. In short, our pool is down a couple of large hills that are very steep, too steep for a person in a wheelchair. So, the city's solution is that we make the little access road by the tennis courts 'J.I>~\ ~o')" t;:. .5 usable for disabled people to drive down. Then, we need to make a hard surfaced parking area for their vehicle that has ample access for easy exit and entry. We will also need to provide a paved path to and from the parking area to the pool. We are proceeding in the permit process "r S,~'l~ with intent to comply with the rules set forth. However, we are also planning on appealing to the <: cp,; City Council to reconsider these requirements. Just late last week, the city said we have to provide evidence of the easements for the pool area. Those are the documents that describe the legal description of the sewer and plumbing for that plot of land. The City of Prior Lake does not have them. Scott County does not have them. It appears that they may have never been created. Of course, this is certainly not our Community's fault. Reponse: The 2007 Minnesota State Building Code chapter 134 L III LI states: Swimming Pools, Wading pools, Spas, Saunas, and Steam rooms are to be accessible. The Minnesota Department of Health administers the Minnesota Pool Code and conducts Plan Review and inspection of pool construction or alteration. Their definition of a "Public pool" includes any pool, other than a private residential pool operated by any person whether the person is an owner, lessee, operator, or concessionaire. Pools include swimming pools, spa pools (hot tubs), waterparks, plunge pools with flume slides, therapy pools, wave pools, splash pads and interactive water features. Public pools are those located in parks, schools, licensed child care facilities, Home Owners Associations, group homes, motels, camps, resorts, apartment buildings, clubs, condominiums and hotels or any licensed lodging facility. Question: However, we are also planning on appealing to the City Council to reconsider these requirements. Reponse: The requirements are in State of Minnesota Statues. The State of Minnesota Department of Labor and Industry that administers State Building Code was contacted for conformation on the applicability of the regulations. Question: One important item to note is that the city's insistence that we comply with these rules has nothing to do with whether or not we build a bathroom area. Reponse: The bathroom facilities are not required as per MN rules 4717.3650 TOILETS, LA V A TORIES, SHOWERS, AND DRESSING ROOMS. Subpart I.GeneraI.Toilets, showers, and dressing rooms must be conveniently available to pool patrons.A.Toilets, showers, and dressing rooms may be in a nearby toiletroom, locker room, or, if conveniently available, within the living units of an apartment building, hotel, or similar occupancy. Question: Just late last week, the city said we have to provide evidence of the easements for the pool area. Response: This requirement was included in the Engineering plan review comments faxed to Dolphin Pools on April 2, 2008. The City requires that public utilities (Sewer and Water) be located in public easements. The easements must be indicated on the Certificate of Survey.
