HISTORY
Historic concerns about access and egress to Trunk
Highway 13 resulted in the City Council adopting a Long
Term Development and access Plan with the Minnesota
Department of Transportation. This plan sets forth the
status of improvements to various intersections along Trunk
Highway 13.
Development of the Marketplace at County Highway 42 retail
center in Savage last year created additional impetus for the
City of Prior Lake to look at access and safety issues in the
Trunk Highway 13 and County Highway 42 intersection area.
A feasibility report was authorized by the Council to look at
frontage road systems along both Trunk Highway 13 and
County Highway 42. Specifically, a frontage road connecting
Commerce Avenue and Boudin Street along Trunk Highway
13 with a full access signalized intersection was investigated
as well as frontage roads along CH 42 connecting
Commerce Avenue to Rutgers Street and Rutgers Street to
Harbor Place. This agenda report does not address the CH
42 frontage roads.
The City Council accepted the Feasibility Report for the
Trunk Highway 13 - Commerce Avenue and Boudin Street
frontage road and intersection safety improvements at the
May 17, 1999 meeting and called for a Public Hearing to be
conducted on June 7, 1999.

CURRENT CIRCUMSTANCES
A project to address access and safety issues along TH 13
in the vicinity of the Commerce Avenue and Boudin Street
intersections is programmed for the year 2000 in the recently
adopted 5 year Capital Improvement Program. In order to
move forward on this project it is important for the City
Council to adopt a "Preferred Alternative" for the alignment
of a frontage road along TH 13 and the location for a full
access (signalized) intersection.
The Feasibility RepOrt outlined three alternatives for the
alignment of a frontage road and location for the signalized
intersection; Option 1, Option 1 R, and Option 2, copies of
each of the alternatives are attached to this report.
Both Option 1 & 1 R locate the signalized intersection
approximately midway between the existing Boudin Street
and Commerce Avenue intersections. The difference
between Option 1 & 1 R is the alignment of the connecting
frontage road. Option 1 frontage road alignment is located
outside existing trunk highway right-of-way, while Option 1R
uses trunk highway right-of-way for the frontage road
alignment to minimize impacts to the Assembly of God
Church property. Both options propose to close the existing
access at Boudin Street and propose that the existing
Commerce Avenue intersection become a right in only
access.
Option 2 locates the signalized intersection at the existing
Boudin Street intersection with TH 13, but does not use
existing trunk highway right-of-way for the frontage road
alignment. As in Options 1 & 1 R, Commerce Avenue is
proposed to become a right in only access.
The cost of construction of each of the alternatives is
estimated to be in the neighborhood of $1.5 - $1.6 million
dollars. The City of Prior Lake's share of the cost is
estimated to be from $400,000 to $450,000, not including
engineering. Right-of-way acquisition costs are the most
significant share of this amount, in the neighborhood of
$300,000 (which is probably low as it was estimated using
County data). Using the trunk highway right-of-way, Option
1 R reduces the amount of additional right-of-way required.
Right-of-way acquisition for Option 1 R is estimated at

approximately $250,000 (estimated from the same County
data).
ISSUES
A frontage road and intersection improvement in the
Commerce/BoudinffH 13 area will provide the following
benefits:
1. Eliminate a full access intersection (Commerce) that
is only 700 feet from CH 42 and is considered
dangerous. '
2. Provides for a new full access intersection with traffic
signal at a safe and appropriate distance from CH 42.
3. Improves access and egress to the residential
neighborhoods, business area, and church.
4. Aligns with a future Savage roadway to maximize
safety.
Impact to the Prior Lake Assembly of God Church property
is a major issue (see attached correspondence).
The Prior Lake Assembly of God Church has submitted a
petition, attached, that outlines their formal position. Of the
issues presented in the petition, the impact on the Church's
property, jeopardizing their ability to complete long range
plans is probably the most significant. Option 1 R tries to
address this issue by pushing the frontage road into the
trunk highway right-of-way. While this does not guarantee
the Church's plans for future expansion can still be
accomodated on the site, it does provide for the greatest
flexibility in achieving their plans and demonstrates
responsiveness to this concern.
Potential assessments to the Church are no longer an issue,
as the recently adopted Capital Improvement Program
identifies the funding sources as 1) Intergovernmental, 2)
Municipal State Aid, and 3) Collector Street funds.
Right-of-way acquisition will be the most expensive part of
this project for the City. Although estimates of this cost were
included in the Feasiblity Report, solid numbers will not be

available until an appraisal of the required right-of-way is
completed. The required right-of-way will not be identified
until we have MnDOT approved plans. The use of trunk
highway right-of-way will reduce the required right-of-way
and associated acquisition costs.
SUMMARY AND CONCLUSION
Based on the feedback from neighborhood meetings, cost, a
compromise between resident and business interests, and
barring the presentation of new data or issues at the Public
Hearing, staff recommends adoption of Option 1 R as the
Preferred Alternative.
Upon completion of the Public Hearing, the Council should
formally adopt a Preferred Alternative that can then be
forwarded to the City of Savage and MnDOT for
consideration.
It is important for the City of Prior Lake to act expeditiously
with respect to adoption of a Preferred Alternative and then
get Savage's concurrence in order to be ahead of any
potential development in the southeast quadrant of the
intersection of Trunk Highway 13 and County Highway 42.
In this manner, the two Cities will be in agreement as to
where a full access intersection will be located, and it will not
be Developer driven.
Project execution will be subject to the participation of both
Savage and MnDOT. Upon adoption of a Preferred
Alternative serious discussion can begin with both parties to
expedite this project.
Action to adopt a Preferred Alternative does not commit the
City financially in anyway at this time. Once Savage and
MnDOT concur with this action, the Council can consider a
fee proposal to provide engineering services to prepare
plans and specifications for this project.
The alternatives are as follows:
1. Approve Resolution 99-XX adopting Option 1 R as the
Preferred Alternative for the Trunk Highway 13 _
Commerce Avenue and Boudin Street frontage roads and
intersection safety improvements.

intersections with Commerce Avenue and Boudin Street, and
WHEREAS, the feasibility report has been completed and presented to the City Council
and the community, and
WHEREAS, the City Council has conducted a Public Hearing to take testimony
regarding these proposed improvements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, the City of Prior Lake hereby adopts Option 1R, copy attached, as the
City's Preferred Alternative for frontage roads and intersection safety improvements in
the area of the Trunk Highway 13 intersections with Commerce Avenue and Boudin
Street.

RESPONSE: Prior Lake Assembly of God Church & Board of Deacons
After a thorough review of the suggested plans and options regarding a stoplight,
intersection and frontage road improvements on and along Trunk Highway 13
between Boudin Street N.E. and Commerce Avenue we have come to the following
conclusions.
Our current access from Highway 13 is adequate and not difficult. The
majority of our services are during lower traffic volume times.
All of the proposed projects have significant impact in reducing our land use
and jeopardize our ability to complete long, range plans.
Any project of this magnitude and impact could incur significant assessment
cost.
The significant burden and impact of this project rest primarily upon the
church property.
There is no demonstrated benefit for the church that would justify the cost or
impact ofthe project.
PETITION: This response is supported by those members and regular attendees of
the Prior Lake Assembly of God church listed on the attached petition.

Re: Proposed Road Changes Intersection of Highway 13 and Commerce Avenue, Prior Lake
Dear Mayor and City Council Members,
This letter is in response to the above referenced proposed frontage road changes.
First, please be advised that Burdick Properties has been informed by city staff of the previous
neighborhood meetings relating to these proposed frontage road changes. In addition, Burdick
Properties has been in attendance at one of these meetings and voiced our opinion and concerns.
Assuming that there needs to be a change in the frontage road access at Highway 13 and Commerce
Avenue, Burdick Properties agrees that Option 1R is the most reasonable and sensible solution for
these proposed road changes. However, we have several very important concerns and considerations
which have not been addressed. These concerns include the following:

1. Move Proposed Frontae:e Road to the MNDOT Rie:ht ofWav
We would like to see the proposed frontage road affecting our property moved towards or on to
the right of way as it is currently proposed on the southern portion of the Option 1 R drawing.
This seems both reasonable and sensible. I might add, this would allow for huge dollar savings
for this project. It is my current understanding from the drawing that the proposed road goes
across and through our property including destroying a lot of beautiful green space area, affects
or eliminates our current monument signage for all three buildings, affects or eliminates the New
Horizon pylon sign, and goes directly through our current existing trash enclosure for Building
No.1. We do not believe it is necessary to incur additional expense in disrupting our properties.
Furthermore, we believe there are some serious safety and maintenance service hazards related
to moving the frontage road so close to our existing curb and parking areas.
2. Rie:ht-In Southbound Hie:hwav 13
We believe it is important to continue a right-in at this location. This will continue to give
southbound traffic on Highway 13 reasonable access to Commerce Avenue.
In closing, Burdick Properties is in favor of Option 1R of the feasibility report for the frontage road
intersection at Highway 13 and Commerce Avenue. However, as I explained above, we feel there
are some changes and considerations that could reasonably be incorporated into this Option 1R in
order to make this a win/win situation for the City of Prior Lake, Burdick Properties, and the
neighboring property owners affected by this project. Burdick Properties sincerely hopes that you
will give our comments, ideas and suggestions fair consideration throughout this planning process.
I might add, we are willing to work with city staff, the project engineers, and other persons
associated with this project.
We would like to see this proposed frontage project be a winlwin situation for all those involved.

Re: Proposed Road Changes Intersection of Highway 13 and Commerce Avenue, Prior Lake
Dear Mayor and City Council Members,
This letter is in response to the above referenced proposed frontage road changes.
First, please be advised that Burdick Properties has been informed by city staff of the previous
neighborhood meetings relating to these proposed frontage road changes. In addition, Burdick
Properties has been in attendance at one of these meetings and voiced our opinion and concerns.
Assuming that there needs to be a change in the frontage road access at Highway 13 and Commerce
Avenue, Burdick Properties agrees that Option 1R is the most reasonable and sensible solution for
these proposed road changes. However, we have several very important concerns and considerations
which have not been addressed. These concerns include the following:
1. Move Proposed Frontal!e Road to the MNDOT Ril!ht ofWav
We would like to see the proposed frontage road affecting our property moved towards or on to
the right of way as it is currently proposed on the southern portion of the Option 1R drawing.
This seems both reasonable and sensible. I might add, this would allow for huge dollar savings
for this project. It is my current understanding from the drawing that the proposed road goes
across and through our property including destroying a lot of beautiful green space area, affects
or eliminates our current monwnent signage for all three buildings, affects or eliminates the New
Horizon pylon sign, and goes directly through our current existing trash enclosure for Building
No.1. We do not believe it is necessary to incur additional expense in disrupting our properties.
Furthermore, we believe there are some serious safety and maintenance service hazards related
to moving the frontage road so close to our existing curb and parking areas.
2. Ril!:ht-In Southbound Hil!:hwav 13
We believe it is important to continue a right-in at this location. This will continue to give
southbound traffic on Highway 13 reasonable access to Commerce Avenue.
In closing, Burdick Properties is in favor of Option lR of the feasibility report for the frontage road
intersection at Highway 13 and Commerce Avenue. However, as I explained above, we feel there
are some changes and considerations that could reasonably be incorporated into this Option 1R in
order to make this a win/win situation for the City of Prior Lake, Burdick Properties, and the
neighboring property owners affected by this project. Burdick Properties sincerely hopes that you
will give our comments, ideas and suggestions fair consideration throughout this planning process.
I might add, we are willing to work with city staff, the project engineers, and other persons
associated with this project.
We would like to see this proposed frontage project be a win/win situation for all those involved.
