It is one of the few remaining gravel streets within the City. At the April 19, 1999 Council Meeting, the Council approved plans and specifications and authorized the advertisement for bids for Centennial Street Improvements (Project 99-12). Residents of Centennial Street expressed their opposition to the project both at informational meetings and in a letter to the Mayor and councilmembers, dated November 18, 1998 (attached). One resident has since expressed support of the project in the attached letter dated April 3, 1999. Staff and members of the Council have advocated for the elimination of gravel streets within the City considering maintenance, safety and property values. The Assessment Review committee met on March 10, 1999 to review the project and the proposed assessments. The purpose of the committee is to assist the staff in its evaluation of all properties in accordance with the City's Assessment Policy and review the staff proposed assessment rolls. The committee consists of two councilmembers (currently Councilmembers Petersen and Schenck), the City Manager, Finance Director, and City Engineer. The unit basis assessment means each property owner, regardless of front footage will have the same assessment. CURRENT CIRCUMSTANCES Bids for the Centennial Street Improvements were opened on May 25, 1999. The results are as follows: CONTRACTORS K. A. Witt Construction, Inc. McNamara Contracting, Inc. Northwest Asphalt, Inc. BID AMOUNT $59,085.75 $66,183.25 $66,990.35 1. The bid consists of $6,005.00 for watermain and hydrant improvements proposed to be paid through Trunk Reserve. The remainder of the project cost, $53,080.75 plus 30% for indirect project costs ($15,924.23) or $69,004.98 is proposed to be assessed to the benefiting properties. 2. This compares with the Engineer's Estimate for his project as follows: Engineer's Estimate: $52,741.75 Actual Bid: $59,085.75 3. In accordance with the Assessment Review Committee's recommendations, staff recommends to assess the Centennial Street properties on a unit basis and to conduct the assessment hearing on July 6, 1999. The proposed unit rate based on the low bid is $11,500.83/unit. Staff recommends that the City Council declare the costs to be assessed, order preparation of the assessment roll, and establish the Assessment Hearing date as July 6, 1999. The City Council can elect whether or not to proceed with the project following the special assessment hearing. If the proposed assessments are adopted after an assessment hearing, financing of the improvements will be as follows: Funding Amount Source Assessments $69,004.98 Trunk $6,005.00 Reserve Project Total $75,009.98 The numbers shown above include 30% indirect costs for design, survey, inspection, administration, and financing. The alternatives are as follows: 1. Approve Resolution 99-XX declaring the costs to be assessed, and ordering the preparation of the proposed assessment roll for Projects 99-12 Centennial Street Improvements and Approve Resolution 99-XX establishing July 6,1999 for the assessment hearing. 2. Deny the resolutions for a specific reason and provide staff with direction. 3. Table this item for a specific reason. RECOMMENDED MOTION: A motion and second to adopt Resolution 99-XX declaring costs to be assessed and ordering preparation of the proposed assessment roll and Resolution 99-XX setting the assessment hearing date for Centennial Street Improvements for July 6, 1999. WHEREAS, a CQ~tr.,~t h~. hn9n let and costs have been determined for the improvement of Centennial Street Project 99-12 and the contract price for such improvements is $59,085.75 and the expenses incurred or to be incurred in the making of such improvements amount to $15,924.23, so that the total cost of the improvements will be $75,009.98. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The portion of the cost of such improvements is to be paid by the City is hereby declared to be $6,005.00 to be drawn from the Trunk Reserve, and the portion of the cost to be assessed against benefited property owners is declared to be $69,004.98. 2. Assessments shall be payable on an equal principal installment method extending over a period of 10 years for street improvements. The first installment shall be the annual principal plus interest calculated from the pUblic hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of a minimum of 8% per annum from the date of the adoption of the assessment resolution. 3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvements against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 4. The City Manager shall upon the completion of such proposed assessment, notify the Council thereof. Passed and adopted this 7th day of June, 1999. A hearing shall be held on the 6th day of July, 1999 in City Council Chambers at 7:45 P.M. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given the opportunity to be heard with reference to such assessment. 2. The City Manager is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Finance Director, except that no interest will be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid, excepting the installment portion appearing upon the current year's property tax statement. The area proposed to be assessed is every lot, piece, and parcel benefiting from said improvements, whether abutting or not, within the following described areas: Centennial Street west of Candy Cove Trail within the north half of Section 2, Township 114 North, Range 22 West, Scott County Minnesota. Specific property descriptions included in the above described area, but not inclusive, are as follows: Centennial Addition Cable First Addition The estimated total of the assessment roll is $69.004.98. The Council proposes to proceed under the authority granted by Chapter 429 M.S.A. The proposed assessment roll is on file in the City Manager's office and any written or oral objections will be considered at the public hearing. No appeal may be taken as to the amount of any assessment unless a signed, written objection is filed with the City Manager prior to the hearing or presented to the presiding officer at the hearing. The City also has adopted a deferred assessment ordinance whereby the City Council may defer the payment of special assessments for those individuals who are permanently disabled or have attained the age of 65 or older. Guideline criteria and applications are available at City Hall. Applications must be made within 30 days following the adoption of the assessment roll by the City Council. As wi understand it, there will not need to be a storm sewer and therefore the cost should be somewhat less. Mader lIIld members of PriO!' Lake City C01lllcil:, We, the residents of Centennial Street SE in the City ofPriO!' Lake would like to thank the City of Prior Lake for com;idering Centennial Street among its citY improvement projects. However none of the residents living on Centennial street are in favor of this proje~t In its present state, Centennial St SE requires very minimal maintenance. The project would also necessitate removal of many nalural mature trees. We also believe the paved road would not significantly increase the value of our property. The costs of the road is a burden to us as well. At this time, we are happy with the road as it is, and feel the upkeep of our road is not a significant burden to taxpayers ofPriO!' Lake.
