Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT JUNE 1, 2009 10C DANETTE PARR, COMMUNITY DEVELOPMENT AND NATURAL RESOURCES DIRECTOR CONSIDER APPROVAL OF AN ORDINANCE AMENDING SECTION 1102 OF THE CITY ZONING ORDINANCE RELATED TO SHOPPING CENTERS Introduction The purpose of this report is to consider an amendment to Section 1102.1203 of the City Zoning Ordinance. Historv During a recent City Council workshop related to updating the Zoning Ordinance, the Council expressed a desire to allow more oversight of larger scaled shopping center areas. In order to incorporate this change within the Code, a public hearing was necessary, so the item was referred to the Planning Commission to host a public hearing. On May 26, 2009 the Planning Commission held a public hearing and unanimously recommended approval of the Ordinance amendment. Current Circumstances Currently the Ordinance allows for shopping centers with gross areas of 275,000 square feet to be permitted with conditions in the C-4 General Business Use District. All shopping centers with a square footage greater than 275,000 square feet are required to receive a Conditional Use Permit. The proposal would decrease the square footage threshold to 150,000 square feet. Larger scaled shopping centers can at times be associated with increased traffic, noise, and other impacts on the local community. Due to these impacts, additional conditions may be appropriate to alleviate any possible negative impacts to the community. There are no noted financial impacts related to the proposed Ordinance amendment as being proposed. The Council has the following alternatives: 1. Adopt an ordinance amending the text of the City Code as proposed or with changes specified by the City Council. 2. Deny the amendment to the ordinance. 3. Defer consideration of the item and provide staff with specific direction.. Prior Lake, MN 55372-1714 CITY OF PRIOR LAKE ORDINANCE NO.1 09-XX AN ORDINANCE AMENDING SECTION 1102.1203 OF THE PRIOR LAKE CITY CODE The City Council of the City of Prior Lake does hereby ordain that: 1. Section 1102.1203 (6) of the Prior Lake City Code is hereby amended to read as follows: Shopping Centers Over 275,000150.000 Square Feet of Gross Floor Area. This ordinance shall become effective from and after its passage and publication. Passed by the City Council of the City of Prior Lake this 151 day of June, 2009.
