CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE CITY
MANAGER TO ENTER INTO A JOINT POWERS AGREEMENT WITH THE
CITY OF CHASKA FOR THE 2009 PGA CHAMPIONSHIP
Introduction
The purpose of this agenda item is to seek Council approval to enter into a
Joint Powers Agreement with the City of Chaska for police services during the
2009 Professional Golfers Association (PGA) Championship to be held at
Hazeltine National Golf Club.
Current Circumstances
Hazeltine National Golf Club, in Chaska, Minnesota, will once again be the site
of a major professional golf tournament. This year's PGA Championship will
take place August 10 through August 16.
The Chaska Police Department has the command and control responsibility for
law enforcement and security functions on the golf course. These "inside-the-
fence" functions include any and all tournament public safety and security
issues occurring relative to the players, spectators, vendors and other course
protection needs. As in 2002 when this tournament was last hosted in Chaska,
the Chaska Police Department is seeking the assistance of uniformed officers
with such duties as player escort, dignitary protection, and for a high profile
presence on the course.
Prior Lake officers have expressed an interest in assisting the Chaska Police
Department with these responsibilities. If approved, the officers from the Prior
Lake Police Department will volunteer to be assigned by the Chaska Police
Department command staff to any of the various duties outlined above on their
own time - they will not be paid by either the City of Prior Lake, the City of
Chaska, or the PGA. (The PGA is offering a meal and a free pass to the
tournament in exchange for a full day's work.)
This joint powers agreement allows for the City to grow its partnerships with
other communities at no cost to the taxpayers.

A RESOLUTION APPROVING A JOINT POWERS AGREEMENT WITH THE CITY OF
CHASKA FOR THE 2009 PROFESSIONAL GOLFERS' ASSOCIATION
CHAMPIONSHIP

WHEREAS, Hazeltine National Golf Club in Chaska, Minnesota is the host to the 2009
PGA Championship August 10 - 16, 2009; and
WHEREAS, the Chaska Police Department asking for assistance in meeting the public
safety needs of this event; and
WHEREAS, the Prior Lake Police Department has officers willing to volunteer their
services to meet those demands.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
PRIOR LAKE, MINNESOTA as follows:
1) The recitals set forth above are incorporated herein.
2) The City Manager is hereby authorized to enter into a Joint Powers Agreement with
the City of Chaska for law enforcement services during the week of August 10 - 16,
2009.

POLICE SERVICES JOINT POWERS AGREEMENT
2009 PGA CHAMPIONSHIP - AUGUST 10 - 16, 2009
AGREEMENT, Made this day of ,2009, by and
between the CITY OF PRIOR LAKE, a Minnesota municipal corporation,
and the CITY OF CHASKA, a Minnesota municipal corporation (hereinafter
"Chaska");
WHEREAS, the Chaska Police Department has requested the aid and
assistance of the City of Prior Lake with the provision of policing services
and other related activities at the 2009 PGA Championship, August 10 - 16,
2009; and
WHEREAS, the cities of Chaska and Prior Lake are authorized to
enter into an agreement authorizing the exercise of police powers within the
jurisdiction ofChaska, pursuant to Minnesota Statutes, Section 471.59; and
WHEREAS, it is in the best interest of the City of Chaska to enter
into this Agreement in the interest of public health, safety and welfare.
NOW, THEREFORE, the parties agree as follows:
1. PURPOSE.
As requested by the City of Chaska, the City of Prior Lake will
provide policing services at the 2009 PGA Championship and other
related activities on August 10 - 16,2009, in the City ofChaska.
2. COMMAND OF SCENE.
The City of Chaska shall be in command of the scene and will
make issue and duty assignments. When appropriate and practical,
Chaska officers, at the request of City of Prior Lake officers, will
handle the citing and arrests of persons, as circumstances require.
The personnel and equipment of the City of Prior Lake shall be
under the direction and control of the City of Chaska until the City
of Prior Lake withdraws assistance.
3. WORKER'S COMPENSATION.
Each party shall be responsible for injuries or death of its own
personnel. Each party will maintain worker's compensation
insurance or self-insurance coverage, covering its own personnel
while they are providing assistance pursuant to this Agreement.
Each party waives the right to sue any other party for any worker's
compensation benefits paid to its own employee or volunteers.
4. DAMAGE TO EOUIPMENT.
Each party shall be responsible for damages to or loss of its own
equipment. Each party waives the right to sue any other party for
any damages to or loss of its equipment, even if the damages or
losses were caused wholly or partially by the negligence of any
other party or its officers, employees or volunteers.
5. LIABILITY.
A. For the purposes of the Minnesota Municipal Tort Liability Act
only (Minnesota Statutes, Section 466), the employees and
officers of the City of Prior Lake are deemed to be employees
(as defined in Minnesota Statutes, Section 466.01, Subdivision
6) of the City of Chaska.
B. The City of Chaska agrees to defend and indemnify the City of
Prior Lake against any claims brought or actions filed against
the City of Prior Lake or any officer, employee or volunteer of
the City of Prior Lake for injury to, death of, or damage to the
property of any third person or persons, arising from the
performance and provision of assistance pursuant to this
Agreement.
C. Under no circumstances, however, shall a party be required to
Pay on behalf of itself and other parties, any amounts in excess
of the limits on liability established in Minnesota Statutes,
Chapter 466, applicable to anyone party. The limits of liability
for some or all of the parties may not be added together to
determine the maximum amount of liability for any party.
6. COMPENSATION.
Officers will not be monetarily compensated for shifts worked.
The City of Chaska will provide meals to uniformed officers
working shifts. Officers will be offered from the Professional
Golfers Association (PGA) a day of free admission to the
Championship in exchange for each full day (minimum of 8 hours)
of uniformed shift work.
7. SEVERABILITY.
If any portion of this Agreement is found to be illegal, that portion
of the Agreement shall be severed and the remainder of the
Agreement shall remain in full force.
8. AMENDMENT.
This Agreement may only be amended in writing by agreement by
