U ~ / Prior Lake, MN 55372-1714 / ~lArNES~ CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: ISSUES: CONCLUSION: JUNE 15, 2009 50 STEVE ALBRECHT, DIRECTOR OF PUBLIC WORKS CONSIDER APPROVAL OF RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE A COOPERATIVE AGREEMENT WITH SCOTT COUNTY FOR THE COUNTY ROAD 83 RECONSTRUCTION Introduction The purpose of this agenda is for the City Council to approve the cooperative agreement between the City and Scott County for the CR 83 Reconstruction between CR 42 and the northern City limits. Historv CR 83 has been previously reconstructed in segments, however the portion of CR 83 between CR 42 and 1 ih Avenue in Shakopee is under-designed. This segment of two-lane roadway does not currently meet capacity and safety needs. The roadway traffic volumes are expected to more than double by 2030. This project has not been rated as a top priority by the Cities of Prior Lake and Shakopee or Scott County due to funding constraints. The Shakopee Mdewakanton Sioux Community (SMSC) however rates this as a top priority for reconstruction. On January 5, 2009 the City Council approved the layout and design for the CR 83 Reconstruction Project. Current Circumstances The County plans to begin construction this summer with completion scheduled for 2010. In order to proceed with bidding of the project the County needs to enter into Cooperative Agreements with the Cities of Prior Lake and Shakopee. The SMSC are funding the project which will save the County and Cities an estimated $5 million. Currently, this roadway has traffic volumes in excess of 17,000 trips per day which is expected to double by 2030. The Cooperative Agreement is in the standardized format previously reviewed by the City Attorney. This project is a great leverage of funding for the Cities and the County. This roadway does impact Prior Lake residents and so its improvement is a benefit to the City. www.cityofpriorlake.com Phone 952.447.9800 / Fax 952.447.4245 FINANCIAL IMPACT: The City's estimated cost of $57,000 is approximately 40% of what the City would contribute if the County were completing this project without SMSC assistance. The Cooperative Agreement does not require reimbursement by the City to the County until June 1, 2015. The City's Transportation Plan has been amended to show this payment in 2015. Included in the resolution is a declaration of official intent to issue bonds for the estimated cost of $57,000. In order to satisfy federal regulations and state statute the City Council must adopt a resolution that provides a notice of intent to bond. The resolution is necessary if the City intends to reimburse itself for costs incurred on a project that will be funded by bonds but for which bonds have yet to be issued. The approval of this resolution only approves the City's intent to bond. It does not approve the sale of bonds. ALTERNATIVES: 1. Approve a resolution authorizing the Mayor and City Manager to execute a Cooperative Agreement with Scott County for CR 83 Reconstruction. 2. U ~ Prior Lake, MN 55372-1714 try "'''!'!~ RESOLUTION 09-XXX A RESOLUTION APPROVING THE COOPERATIVE AGREEMENT WITH SCOTT COUNTY FOR THE CR 83 RECONSTRUCTION PROJECT SAP 70-683-10 Motion By: Second By: WHEREAS The traffic volumes on CR 83 are expected to more than double in the 20 years; and WHEREAS, The City of Prior Lake has not allocated funding for reconstruction in our Transportation Plan; and WHEREAS, The Shakopee Mdewakanton Sioux Community has agreed to fund the project for construction in 2009 and 2010; and WHEREAS, This project will provide benefit to the residents and businesses in Prior Lake; and WHEREAS, The Mayor and City Manager are authorized to execute a Cooperative Agreement with Scott County for the CR 83 Reconstruction Project; and WHEREAS, The final design for CR 83 has been completed in accordance with the layout and design approved by the City Council on January 5, 2009; and WHEREAS, A Cooperative Agreement for the completion of the CR 83 Reconstruction Project has been completed based on the final design; and WHEREAS, The City of Prior Lake's street and storm sewer cost share is estimated to be $57,000 with payment required by June 1, 2015; and WHEREAS, The City has determined to make a declaration of official intent ("Declaration") to reimburse these estimated costs from proceeds of bonds in accordance with the Internal Revenue Service Reimbursement Regulations (Treasury Reg. 1.150-2). NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein 2. The Mayor and City Manager are authorized to execute a Cooperative Agreement on behalf of the City with Scott County for the CR 83 Reconstruction Project. 3. The City will reimburse Scott County an estimated $57,000 for the CR 83 Reconstruction Project in accordance with the Cooperative Agreement. The actual amounts reimbursed by the County based on construction bids shall be approved by the City Council prior to payment. Staff is directed to include the payment in the 2015 Transportation Plan and to bring back a resolution at the time of payment with actual costs and funding source. 5. The City reasonably expects to reimburse the expenditures made for these costs from the proceeds of bonds. 6. The City Engineer is authorized to sign the CR 83 Reconstruction Project Plans.
