Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT JUNE 15, 2009 8A JANET RINGBERG, LICENSE CLERK PUBLIC HEARING TO CONSIDER APPROVAL OF THE LIQUOR LICENSE RENEWALS FOR 2009-2010 Historv The Prior Lake City Code provides that the City Council may approve the renewal of annual On-Sale Intoxicating, Sunday Liquor, Off-Sale Intoxicating, Off-Sale 3.2 Malt Liquor, On-Sale Intoxicating, and Club Licenses following the opportunity for a hearing and testimony. A public hearing has been scheduled and all applicants have been informed that they may be present if they wish. All of the licenses expire on June 30 of each year. Current Circumstances Attached is a list of establishments who have applied for renewal of their liquor license pursuant to city code. In considering this item, the City Council should consider, among other things, the following information. The Prior Lake Police Department has completed a background check for each of the licensees and has reported that the following establishments have been cited with selling alcohol to minors: Narayan Gas and Groceries-2009, Fongs Chinese Cuisine - 2008, T J Hooligan's - 2006, Junction Liquor - 2005, O'Malley's On Main - 2005, Viking Liquor - 2005, Prior Lake VFW - 2004. This is the complete history for all applicants. Our ordinance focuses upon the last 36 months only. Each of these businesses have or will be subject to the civil penalty portion of the City Code. All applicants have provided the City with renewal applications, fees and proof of liquor liability insurance. See Exhibit A for a detailed list of licenses being requested and the revenue from the renewals. The Basement Bar & Grill has provided the City with a listing of the new officers for Basement Holding LLC, which is the licensee for Basement Bar & Grill. Since this establishment attracts the largest number of young adults for drinking and dancing, there are some unique issues to be addressed. The police department continues to work with Basement representatives to minimize and eliminate issues which can arise from time to time with this type of business. www.cityofpriorlake.com Phone.~54 -44-7. ~$PQ /, FC;\K..Q5~d~47A24Q Narayan Gas & Groceries has chosen not to renew their off-sale 3.2 malt liquor license, which will expire June 30, 2009 as a result of a sale to an under- age person made by an employee earlier this year. Prior Lake City Ordinance 301.600 states that no license shall be granted for operation on any premises for which taxes, assessments or other financial claims of the City are delinquent or unpaid. The Scott County Treasurer's records and City records show that all property taxes and money owed to the City are current for all applicants. The City Council should provide an opportunity for persons to be heard with respect to the renewals. Following that, the Council may act upon the renewal request. ALTERNATIVES: The City Council has the following alternatives: 1. Conduct the public hearing and let all persons who wish to speak and then approve the renewal of the liquor licenses listed on Exhibit A for 2009- 2010 unless new information is offered. 2. Deny a specific renewal request following the public hearing. 3. Take no action following the public hearing and direct the staff to provide additional information. RECOMMENDED MOTION: Alternative 1. In the absence of new information offered at the public hearing, staff recommends Council approve the 2009-2010 liquor license renewals.
