HomeMy WebLinkAbout7A - Ordering 2003 Street Impro DATE: AGENDA #: PREPARED BY: REVIEWED BY: SUBJECT: DISCUSSION: CITY COUNCIL AGENDA REPORT FEBRUARY 18, 2003 7A LARRY POPPLER, ASSISTANT CITY ENGINEER SUE MCDERMOTT, CITY ENGINEER PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDERING THE 2003 IMPROVEMENT PROJECT AND PREPARATION OF PLANS AND SPECIFICATIONS. HISTORY On July 15, 2002, Council adopted Resolution 02-110 ordering the preparation of a feasibility report for those projects in the 2003 Capital Improvement Program (CIP) required to follow the Minnesota Statutes Chapter 429 process. The Minnesota Statutes Chapter 429 process is required because the City Council intends to specially assess a portion of the project. The projects studied in the report includes Condons Street, Hope Street, Mitchell Circle, and 150th Street. The recommendation of the feasibility report was to proceed with this project. On January 21,2003, Council adopted Resolution 03-14 accepting the feasibility report and calling for a public hearing on February 18, 2003 for the 2003 improvement project. CURRENT CIRCUMSTANCES The purpose of the Public Hearing is to determine if plans and specifications should be prepared for Council consideration. The Public Hearing will cover the reconstruction of Condons Street, Hope Street, Mitchell Circle, and 150lh Street, including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work. Details of the project and proposed financing will be presented to the public at the hearing. Financing of the improvements is recommended as follows: Assessments Tax Le Utili Fund Trunk Reserve Fund Water uali Fund Collector Street Fund Pro' eet Total Cost $602,163 $994,591 $475,657 $73,176 $80,000 $141,795 $2,367 382 The proposed assessment rate for Condons Street, Hope Street, and Mitchell Circle is $5,209.07/unit (Five units were never assessed for street and storm sewer and are proposed to be assessed at the 100% level of $13,022.67/unit). Each of the affected property owners has been notified in accordance with the statute prior to the Public Hearing. ISSUES ~ Public Informational Meetings were held on January 28t" and 29th, 2003 to }Jj', provide the property owners an opportunity to discuss the project in an informal setting prior to the Public Hearing. Twenty-six residents representing twenty (20) properties attended the meetings. Staff presented the proposed improvements, project costs, estimated assessments and answered questions. In general, the need for the project was understood by the residents. Concerns that were brought up both at the meetings and subsequent conversations are as follows: . Sidewalk on 15dh Street - Staff is proposing to construct sidewalk along 150'" Street. Originally the sidewalk was proposed south of 150'" Street. Conversations with residents, analysis of the utilities and topography show that the sidewalk would fit better north of 150t" Street. Staff is currently proposing the sidewalk along the north side of 150'" from Fairlawn Shores Trail to Estate Avenue. A mid block crosswalk is proposed on 150'" Street at Green Oaks Park. . Road width on Condons Street - Staff is proposing to construct Condons Street to a width of 24' instead of the previously proposed 28'. This is due to the narrow right of way. Any widening would diminish resident's driveway lengths, creating a problem for parking cars in their driveway. . Street lighting - Staff is proposing street lighting on 150th Street. The street lighting will be located at intersections and approximately 300' between intersections. Street lighting will be at properly lines and will be located adjacent to the sidewalk. Street lighting is proposed on Condons Street, Hope Street, and Mitchell Circle. The residents in attendance at the informational meeting were not in favor of street lights. . 100% Assessment - One resident who lives on the gravel portion of Hope Street was in attendance and expressed concern about the 100% assessment rate. The City staff will be prepared to discuss each of these concerns at the hearing. If, in the council's judgment, the issues should be addressed in the plans and specifications, direction could be given to staff. The purpose of this public hearing is to determine whether the project should move forward to the next step, which is preparation of plans and specifications which will provide greater information about expected project cost and, therefore, the assessments associated with these improvements. Once the plans and specifications are completed, they are submitted to the City Council for approval. At the same time approval is sought to advertise for bids, the Council could decide not to continue with the project upon receipt of bids. A separate assessment hearing will be conducted following review of the proposed assessments by the City Council's Special Assessment Committee. CONCLUSION The project is feasible from an engineering and economic standpoint. If the preparation of plans and specifications is approved, the work will be completed by City staff. 031MPRQV ALTERNATIVES: There are three alternatives for the City Council to consider: 1. SECOND BY: }t- WHEREAS, the Prior Lake City Council on its own initiative has determined that it desires to complete the 2003 Public Improvement Project; and WHEREAS, on January 21, 2003, the City Council adopted Resolution 03-14 accepting the Feasibility Report and calling for a Public Hearing to be held on the 2003 Improvement Project which includes the reconstruction of Condons Street, Hope Street, Mitchell Circle, and 1501" Street sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 18th day of February, 2003, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, since the project is initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota Statutes 429.031 Subdivision 1 (f). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 03-14 adopted January 21, 2003 and by the required statutory 4/5ths vote does hereby order the project. 3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer shall prepare plans and specifications for the making of such improvements.
