HISTORY On November 4, 2002, Council adopted Resolution 02-183 ordering the preparation of a feasibility report for the CSAH 23/Five HawkslTrunk Highway 13/170'h StreetITower Street (Ring Road, Phase 3) Improvements. Because the City Council intends to specially assess a portion of the project the City is required to follow the Minnesota Statutes Chapter 429 process. The recommendation of the feasibility report was to proceed with this project. On January 21, 2003, Council adopted Resolution 03-13 accepting the feasibility report and calling for a public hearing on February 18, 2003. CURRENT CIRCUMSTANCES The purpose of the Public Hearing is to determine if plans and specifications should be prepared for Council consideration. The Public Hearing will cover the realignment and reconstruction of CSAH 23 and Five Hawks intersection with TH 13, and the third phase of the Ring Road from Duluth Avenue to TH 13 including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, sidewalk, traffic signal, retaining walls and appurtenant work. Details of the project and proposed financing will be presented to the public at the hearing. Financing of the improvements is recommended as follows: Assessments $370,600.00 MnDOT $378,000.00 Scott Countv $400,000.00 Trunk Reserve $368,590.00 MSA $780,980.00 Collector Street $274,000.00 Proiect Total Cost $2,572,170.00 The properties abutting the streets located in the project area are subject to assessment. (952) 447-4230 / Fax (952) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER ISSUES Street and Storm Sewer Reconstruction . Five parcels are proposed to be assessed with this project. . Pursuant to the assessment policy, the street and storm sewer reconstruction should be assessed at 40% of the total project cost against four of the benefiting properties. One properly is proposed to be assessed at 100% as a first time improvement. . The City will pay for its portion of the assessment for the City-owned property using Municipal State Aid funds. Water and Sanitary Sewer Extension . One parcel is proposed to be assessed for watermain and sanitary sewer at the rate outlined in the 2003 fee schedule ($20/front foot for watermain, $40/front foot for sanitary sewer). Indirect Costs . The Engineer's Estimate outlined in the feasibility report used 30% for indirect costs (17% engineering, 5% administration, 8% financing). We were able to reduce the financing to 4% for a total indirect cost of 26%. Attached is a revised assessment roll reflecting this revision. Assessment Method . The assessment committee recommends the front footage method due to the fact that lots in the project area are of differing size and/or value. The proposed assessment rates are as follows: CSAH 23 - Paving: $96.18/front foot Ring Road - Paving (100%) $224.42/front foot Ring Road - Paving (40%) $89.77/front foot . When Rademacher's First Addition was approved by the City Council in 1992, the Development Contract provided for future assessments for the upgrade of CSAH 23 and 170th Street (Ring Road). A copy of the provisions from the Development Contract is attached to this report. The cost differential which would have otherwise been assessed to the benefiting properties are proposed to be funded through the City's MSA funds. . A Special Benefit Valuation Analysis was prepared for the parcels proposed to be assessed. The proposed assessments are appropriate according to the analysis. The City staff will be prepared to discuss each of these concerns at the hearing. If, in the council's judgment, the issues shouid be addressed in the plans and specifications, direction could be given to staff. The purpose of this public hearing is to determine whether the project should move forward to the next step, which is preparation of plans and specifications which will provide greater information about expected project cost and, therefore, the assessments associated with these improvements. Once the pians and speCifications are completed, they are submitted to the City Council for approval. A separate assessment hearing will be conducted following review of the proposed assessments by the City Council's Special Assessment Committee. If the preparation of plans and specifications is approved, the work will be completed by WSB and Associates as approved by Resolution 02-143 at the August 19, 2002 City Council meeting. There are three alternatives for the City Council to consider: 1. Conduct the Public Hearing and approve a resolution that orders the CSAH 23/Five Hawks/Trunk Highway 13/170'h StreetITower Street (Ring Road, Phase 3) Improvements and authorizes City staff to prepare plans and specifications. 2. Deny this item for a specific reason and provide staff with direction. 3. Table this item until some date in the future. WHEREAS, the Prior Lake City Council on its own initiative has determined that it desires to complete the CSAH 23/Five HawkslTrunk Highway 13/170'h StreetITower Street (Ring Road, Phase 3) Improvement Project; and WHEREAS, on January 21, 2003, the City Council adopted Resolution 03-13 accepting the Feasibility Report and calling for a Public Hearing to be held on the CSAH 23/Five HawkslTrunk Highway 13/170'h StreetITower Street (Ring Road, Phase 3) Improvement Project which includes the realignment and reconstruction of CSAH 23 and Five Hawks intersection with TH 13 and the third phase of the Ring Road from Duluth to TH 13 including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, sidewalk, traffic signal, retaining walls and appurtenant work; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 18th day of February, 2003, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, since the project is initiated by the City council it must be approved by 4/5ths vote in accordance with Minn esota Statutes 429.031 Subdivision 1 (f). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 03-13 adopted January 21, 2003 and by the required statutory 4/5ths vote does hereby order the project. 3. The WSB & Associates is hereby designated as the Engineer for these improvements. The Engineer shall prepare plans and specifications for the making of such improvements.
